A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ORDERING THE SUMMARY VACATION
OF A PORTION OF THE EAST SIDE OF ELM STREET,
NORTH OF CYPRESS .AVENUE
. WHEREAS, the City Council of the City of Huntington Beach
wishes to summarily vacate an excess right-of-way of a street or
highway not required for street or highway purposes, pursuant to
California Streets and Highways Code Section 8334 ; and
Said right-of-way is . a portion of the east sideof Elm
Street, north of. Cypress Avenue,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby resolve_ as_ follows:
1. Pursuant to Division 9,- Part 3, Chapter 4 of the
California Streets and Highways - Code, commencing with Section
8334, the City Council of the City of Huntington Beach hereby
orders the vacation of a portion of the east side of Elm Street,
north of Cypress Avenue.

STATEMENT OF ISSUE:
The affected owner is requesting the vacation of excess right-of-way
for street purposes located on the east side of Elm Street, north of
Cypress Avenue.
RECOMMENDED ACTION:
Adopt the attached resolution ordering a summary vacation of this
excess street right-of-way.
ANALYSIS:
Several years ago, the owner of the property at 17116 Elm Street
dedicated seven feet for street widening which was in conformance with
the master planned width. Subsequent to that dedication,' an additional
seven feet was mistakenly dedicated again by the recordation of a
parcel map, thus creating excess right-of-way. This recommended
vacation will eliminate the excess right-of-way and return the street
to its. master planned width.

HUNTINGTON BEACH ORDERING THE SUMMARY VACATION
OF A PORTION OF THE EAST SIDE OF ELM STREET,
NORTH OF CYPRESS AVENUE:
WHEREAS, the City Council of the City of Huntington Beach
wishes to summarily vacate an excess right-of-way of a street or
highway not required for street or highway purposes, pursuant to
California Streets and Highways Code Section 8334 ; and
Said right-of-way is a portion of the east side of Elm
Street, north of Cypress Avenue,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby resolve as follows :
1. Pursuant . to Division 9, Part 3, Chapter 4 of the
California Streets and Highways Code, commencing with Section
. 8334, the City Council of the City of Huntington Beach hereby
orders the vacation of a portion of the east side of Elm Street,
north of Cypress Avenue.
2 . The street hereby vacated is more particularly
described as follows :
The Westerly 7 feet of Parcel 2, in the City of
Huntington Beach, County of Orange, State of
California, as shown on a map recorded in book
100 page 9 of Parcel Maps, in the office of the
County Recorder of said county.

STATEMENT OF ISSUE:
The affected owner is requesting the vacation of excess right-of-way
for street purposes located on the east side of Elm Street, north of
Cypress Avenue.
RECOMMENDED ACTION:
Adopt the attached resolution ordering a summary vacation of this
excess street right-of-way.
ANALYSIS:
Several years ago, the owner of the property at 17116 Elm Street
dedicated seven feet for street widening which was in conformance with
the master planned width. Subsequent to that dedication, an additional
seven feet was mistakenly dedicated again by the recordation of a
parcel map, thus creating excess right-of-way. This recommended
vacation will eliminate the excess right-of-way and return the street
to its master planned width.

None. No funds necessary
