A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE
VACATION OF AN EASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF HUNTINGTON STREET
NORTH OF MAIN STREET
WHEREAS, on October 4, 1993, the City Council of the City of Huntington Beach
adopted Resolution No. 6525 declaring its intention to vacate an easement for public street
purposes over a portion of Huntington Street north of Main Street, and referring to maps and
plans on file in the office of the City Clerk for particulars as to the proposed vacation; and o m

Said resolution fixed the time and place of November 1, 1993, at the hour of 7:00 P.M., o
or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic m v
Center, for hearing all persons interested in or objecting to the proposed vacation, which time z
was not less than fifteen (15) days from the passage of this resolution. Notices of vacation z
were posted conspicuously along the easement section proposed for vacation, and such �A
notices were posted not more than three hundred (300) feet apart and at least three (3)were m m
posted.

On November 1, 1993, at the hour of 7:00 P.M., in the Council Chambers in the Civic o,
Center, the City Council of the City of Huntington Beach did convene for the purpose of c
hearing all persons interested in or objecting to the proposed vacation of an easement for v rc
public street purposes over a portion of Huntington Street north of Main Street, at which.time tA rn
no acceptable objection was made to said vacation, and evidence was presented showing that
said easement is not necessary for present or prospective public uses and its not suitable for N
use or development as bicycle paths or routes. o

NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to CD
Division 9, Part 3, Chapter 3 of the California Streets and Highways Code, commencing with v
Section 8320, does resolve that the easement for public street purposes over a portion of
Huntington Street north of Main Street, is not necessary for present or prospective public use,
and is not suitable for use or development as bicycle paths or routes, and it is hereby
ORDERED that the easement for public street purposes over a portion of Huntington
Street north of Main Street is hereby vacated; and that the section so vacated is more
particularly described as follows:
That portion of Huntington Street(formerly Huntington Avenue)of Tract No. 7 in the City of
Huntington Beach in the County of Orange, State of California, as shown on a map filed in Book
9,page 8 of Miscellaneous Maps in the office of the County Recorder of said county, described as
follows:

The city hereby reserves and excepts from the vacation a permanent easement and
right at any time or from time to time, to construct, maintain, operate, replace, remove and
renew storm drains, sanitary sewers, water mains and appurtenant structures in, upon, over
and across such street or any vacated portion thereof, or otherwise to construct, maintain,
operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and
other convenient structures, equipment and fixtures for the operation of gas pipelines,
telegraphic and telephone lines, railroad lines, and for the transportation or distribution of
electric energy, petroleum and its products, ammonia, water and incidental purposes, including
access and the right to keep the property free from flammable materials, wood growth, and
otherwise protect same from all hazards in, upon and over the easement for public street
purposes proposed to be vacated of a portion of Huntington Street.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH OF INTENTION TO
VACATE AN EASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF HUNTINGTON
STREET NORTH OF MAIN STREET
The City Council of the City of Huntington Beach does
hereby resolve as follows :
SECTION 1. A public meeting was held before the Planning
Commission on August 3, 1993, at which time it was determined,
pursuant to Government code section 65402, that the proposed
vacation of an easement for public street purposes over a
portion of Huntington Street, north of Main Street, conformed
to the city' s general plan.
SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of
the California Streets and Highways Code, commencing with
section 8320, the City Council of the City of Huntington Beach
hereby declares its intention to vacate for public street
purposes an easement over a portion of Huntington Street, north
of Main Street, more particularly described as follows :
. That portion of Huntington Street (formerly Huntington
Avenue) of Tract No. 7 in the City of Huntington Beach,
County of Orange, State of California, as shown on. a map
filed in Book 9, page 9 of Miscellaneous Maps, in the
office of the County Recorder of said county, more
particularly described as follows :

and for the transportation or distribution of electric energy,
petroleum and its products, water, and incidental purposes,

Huntington Street to be vacated..
SECTION 3 . The City Clerk is directed to maintain on - file
in the office of the City Clerk maps or plans showing the
particulars of the proposed vacation for street purposes of a
portion of Huntington Street, north of Main Street, and
reference is hereby made to such maps and plans for particulars
as to said proposed vacation.
SECTION 4 . The City Council does hereby fig November 1,
1993, at the hour of 7: 00 p.m. , or as soon thereafter as the
matter may be heard in Council Chambers in the Civic Center, as
the time and place for hearing all persons interested in or
objecting to the proposed vacation, which time is not less than
fifteen (15) days from the passage of this resolution.
SECTION 5. The City Clerk is directed to cause a copy of
this resolution to be published in a weekly newspaper,
published and circulated in Huntington Beach for at least two
successive weeks prior to the time set herein for the public
hearing.
SECTION 6 . The Director of Public- Works is directed to
post, or cause to be posted, notices of vacation conspicuously
along the easement proposed to be vacated at least two weeks
before the date of the hearing. The notices shall be posted
not more than 300 feet apart, but. at least three notices shall
be posted. The notices .shall state the day, hour, and place of

the hearing, and shall refer to the adoption of this resolution
of intention, and shall describe the easement or shall include
a map or plan showing the location of the easement proposed to
be vacated.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on
the 4th day of ortober 1993 .

fifteen (15) days from the passage of this resolution.
SECTION 5. The City Clerk is directed to cause a copy of
this resolution to be published in a weekly newspaper,
published and circulated in Huntington Beach for at least two
successive weeks prior to the time set herein for the public
hearing.
SECTION 6 . The Director of Public- Works is directed to
post, or cause to be posted, notices of vacation conspicuously
along the easement proposed to be vacated at least. two weeks
before the date of the hearing. The notices shall be posted
not more than 300 feet apart, but. at least three notices shall
be posted. The notices shall state the day, hour, and place of

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE VACATION OF
AN EASEMENT FOR PUBLIC STREET PURPOSES OVER A
PORTION OF HUNTINGTON STREET NORTH OF MAIN REET.
WHEREAS, on October 4, 1993, the City Counc,/10f the City
of Huntington Beach adopted Resolution No. 652/5 declaring its
intention to vacate an easement for public street purposes over
a portion of Huntington Street north of/Main Street, and
referring to maps and plans on file in the office of the City
Clerk for particulars as to the pro-posed vacation; and
Said resolution fixed the time and place of November 1,
1993, at the hour of 7: 00 P.M. /or as soon thereafter as the
matter could be heard, in the Council Chambers in the Civic
Center, for hearing all/pe sons interested in or objecting to
the proposed vacation, w ich time was not less than fifteen
(15) days from the passage of this resolution. Notices of
vacation were posted conspicuously along the easement section
proposed for vacati/n, and such notices were posted not more
than three hundrei(300) feet apart and at least three (3) were
posted.
On November 1, 1993 , at the hour of 7: 00 P.M. , in the
Council Chambers in the Civic Center, the City Council of the
City of Huntington Beach did convene for the purpose of hearing
all perso/ns interested in or objecting to the proposed vacation
of anZasement for public street purposes over a portion of

Hunti gton Street south of Main Street, at which time no

acceptable objection was made to said vacation, and evidence
was presented showing that said easement is not necessa for
present or prospective public uses and is not suitable for use
or development as bicycle paths or routes .
NOW, THEREFORE, the City Council of the City ;,of Huntington
Beach, pursuant to Division 9, Part 3, Chapter,�3 of the
California Streets and Highways Code, commencing with Section
8320, does resolve that the easement for public street purposes
over a portion of Huntington Street so7h of Main Street, is
not necessary for present or prospect ve public use, and is not
suitable for use or development as bicycle paths or routes, and
it is hereby
ORDERED that the easement f r public street purposes over a
portion of Huntington Street outh of Main Street is hereby
vacated; and that the section so vacated is more particularly
described as follows :

on a map filed in Book 132, pages 35 and 36 of parcel
maps in the office of the County Recorder of said
County, said corn r being a point on the centerline of
said Huntington reet, said corner also being on the

The City Council of the City of Huntington Beach does
hereby resolve as follows:
SECTION 1. A public meeting was held before the Planning
Commission on August 3, 1993, at which time it was determined,
pursuant to Government code section 65402, that the proposed
vacation of an easement for public street purposes over a
portion of Huntington Street, north of Main Street, conformed
to the city' s general plan.
SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of
the California Streets and Highways Code, commencing with
section 8320, the City Council of the City of Huntington Beach
hereby declares its intention to vacate for public street
purposes an easement over a portion of Huntington Street, north
of Main Street, more particularly described as follows :
That portion of Huntington Street (formerly Huntington
Avenue) of Tract No . 7 in the City of Huntington Beach,
County of ..Orange, State of California, as shown on a map
filed in Book 9 ; page 9 of Miscellaneous Maps, in the
office of the County Recorder of said county, more

as to said proposed vacation.
SECTION 4 . The City Council does hereby fix November 1,
1993, at the hour of 7: 00 p.m. , or as soon thereafter as the
matter may be heard in Council Chambers in the Civic Center, as
the time and place for- hearing all persons interested in or
objecting to the proposed vacation, which time is not less than
fifteen (15) days from the passage of this resolution.
SECTION 5. The City Clerk is directed to cause a copy of
this resolution to be published in a weekly newspaper,
published and circulated in Huntington Beach for at least two
successive weeks prior to the time set herein for the public
hearing.
SECTION 6. The Director of Public Works is directed to
post, or cause to be posted, notices of vacation conspicuously
along the easement proposed to be vacated at least two weeks
before the date of the hearing. The notices shall be posted
not more than 300 feet apart, but a.t least three notices shall
be posted. The notices shall state the day, hour, and place of

the hearing, and shall refer to the adoption of this resolution
of intention, and shall describe the easement or shall include
a map or plan showing the location of the easement proposed to
be vacated.

STATEMENT OF ISSUE:
Planning Staff has requested that a portion of Huntington Street, north of Main Street, be
vacated.
RECOMMENDED ACTION:
Adopt the attached resolution ordering the vacation of that portion of Huntington Street
described therein.
ANALYSIS:
Background:
On October 4, -1993, the City Council adopted Resolution No. 6525 declaring the intention to
vacate a portion of Huntington Street, north of Main Street and setting the required public
hearing date for November 1, 1993. Final Council action, after the public hearing, is required to
complete the vacation process.
Location:
The subject portion of Huntington Street is located within the Holly-Seacliff Specific Plan area,
and is between Main Street to the south and the Huntington Lake Apartments and Huntington
Creek Condominiums to the north. The northerly terminus is approximately 1300 feet north of
Main Street, with through access to Ellis Avenue prevented by existing development to the north.
The proposed area of vacation is shown on Attachment (1).
Purpose of Vacation:
The purpose of the proposed vacation is to eliminate an unnecessary portion of street which has
become a maintenance problem and a difficult area to police. The subject portion of Huntington

Street has been brought to the attention of Planning Staff and Public Works Staff, by the Police
Department, as an area that presents access and patrol problems for the police. Since this portion
of Huntington Street is infrequently used it has also become an area where trash and hazardous
materials are occasionally dumped.
Disposition and Improvement of Vacated Portions of Huntington Street:
The west side of the vacated portion of Huntington Street would revert to the property owner to
the west, Seacliff Partners, and would be incorporated into their newly proposed subdivision,
Tentative Tract 14662. This portion of Huntington Street is shown as "Parcel 1" on Attachment
(1). Tentative Tract 14662 was approved by the Planning Commission on September 8, 1993.
The east half of the vacated portion of street would revert to the property owner to the east,
Village Court Homeowners' Association; This area is shown as "Parcel 2" on Attachment (1). All
necessary improvements to partition and landscape the vacated portions of street right of way will
be funded by Seacliff Partners as part of their development of Tentative Tract 14662.
Design Issues:
The following issues have been identified and resolved as described:
1. The Village Court Homeowners' Association located on the east side of the subject portion
of Huntington Street had expressed a concern about traffic that would be generated on
Huntington Street by proposed Tract No. 14662. This issue is related to the proposed tract
development rather than the vacation of Huntington Street. Nevertheless, the proposed
development has been designed to take only emergency access from Huntington Street in order
to eliminate this concern.
2. The Village Court Homeowners' Association had expressed a concern about proposed
improvements to be made to the vacated portion of Huntington Street. Seacliff Partners has
agreed to provide landscaping of that portion of the street which will revert to the Village Court
Homeowners' Association.
3. The Huntington Creek Homeowners' Association, to the north, had expressed a desire to
eliminate drainage from Huntington Street through their condominium complex. Improvements
to be constructed with proposed Tract No. 14662 will divert fifty percent of the area that currently
drains to the Huntington Creek Condominiums. The remaining 50 % can not be redirected
without improvements estimated to cost between $15,000 and $20,000. The Huntington Creek
project was designed and constructed, in 1973 to accept drainage from Huntington Street. There
does not seem to be an obligation on the part of the City or Seacliff Partners to eliminate the
runoff which drains through the Huntington Creek Condominiums.

However, the Planning Commission included a condition of approval with the Seacliff Partner's
proposed Tract No. 14662 to provide for a solution to the drainage problem subject to
reimbursement from the City. The suggested drainage modifications are beyond the limits of the
developers project and will be made only if a funding source can be identified. Seacliff Partners
has offered to do the necessary drainage improvements with the condition that credits be applied
to their drainage fees due for Tract No. 14662. The proposed modification of an existing drainage
system would, however, not be a proper application of Drainage Funds.
FUNDING SOURCE:
None. No funds necessary
ALTERNATIVE ACTION:
1. Deny the request and retain Huntington Street. Or,
2. Adopt the attached resolution ordering the vacation of that portion of Huntington Street
described therein. And, direct the Director of Public Works to provide a credit to Seacliff
Partners from their future drainage fees due for Tract No. 14662 for construction of
improvements necessary to direct drainage from Huntington Street to the east, through the
alley north of Amberleaf Circle, in accordance with conditions of approval for Tentative
Tract No. 14662.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH OF INTENTION TO
VACATE AN EASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF HUNTINGTON
STREET NORTH OF MAIN STREET
The City Council of the City of Huntington Beach does
hereby resolve as follows:
SECTION 1. A public meeting was held before the Planning
Commission on August 3, 1993, at -which time it was determined,
pursuant to Government code section 65402, that the proposed
vacation of an easement for public street purposes over a
portion of Huntington Street, north of Main Street, conformed
to the city' s general plan.
SECTION 2 . Pursuant to Division 9 , Part 3 , Chapter 2 of
the California Streets and Highways Code, commencing with
section 8320, the City Council of the City of Huntington Beach
hereby declares its intention to vacate for public street
purposes an easement over a portion of Huntington Street, north
of Main Street, more particularly described as follows :
That portion of Huntington Street (formerly Huntington
Avenue) of Tract No. 7- in the City of Huntington Beach,
County of Orange, State of California, as shown on a map
filed in Book 9 , page 9 of Miscellaneous Maps, in the
office of the County Recorder of said county, more
particularly described as follows :

on a map filed in Book 132, pages 35 and 36 . of parcel
maps in the office of the County Recorder of said
County, said corner being a point on the centerline of
said Huntington Street, said corner also being on the

filed in Book 342 pages 32 through 34, inclusive, of

permanent easement and right at any time or from time to time,
to construct, maintain, operate, replace, remove and renew
water mains and appurtenant structures in, upon, over and
across that portion of Huntington Street to be vacated, and
pursuant to any existing franchises .or renewals thereof, or
otherwise to construct, maintain, operate, replace, remove,
renew and enlarge lines of pipe, conduits, cables, wires, poles
and other convenient structures, equipment and fixtures for the
operation of gas pipelines, telegraphic and telephone lines,
and for the transportation or distribution of electric energy,
petroleum and its products, water, and incidental purposes,

flammable materials, and wood growth, and otherwise protect the
same from -all hazards in, upon and over that portion of
Huntington Street to be vacated.
. SECTION 3 . The City Clerk is directed to maintain on file
in the office of the City Clerk maps or plans showing -the
particulars of the proposed vacation for street purposes of a
portion of Huntington Street, north of Main Street, and
reference is hereby made to such maps and plans for particulars
as to said proposed vacation.
SECTION 4 . The City Council does hereby fix November 1,
1993, at the hour of 7: 00 p.m. , or as soon thereafter as the

matter may be heard in Council Chambers in the Civic Center', as
the time and place for hearing all persons interested in or
objecting to the proposed vacation, which time is not less than
fifteen (15) days from the passage of this resolution.
SECTION 5 . The City Clerk is directed to cause a copy of
this resolution to be published in a weekly newspaper,
published and circulated in Huntington Beach for at least two
successive weeks prior to the time set herein for the public
hearing.
SECTION 6 . The Director of Public Works is directed to
post, or cause to be posted, notices of vacation conspicuously
along the easement proposed to be vacated at least two weeks
before the date of the hearing. The notices shall be posted
not more than 300. feet' apart, but at least three notices shall
be posted. The . notices shall state the day, hour, and place of

STATEMENT OF ISSUE:
Planning Staff has requested that a portion of Huntington Street, north of Main Street, be
vacated.
RECOMMENDED ACTION:
Adopt the attached resolution of intent to vacate that portion of Huntington Street described
therein, and schedule the required public hearing for--_No v eiob.e r 1, 1993 .
ANALYSIS:
Location:
The subject portion of Huntington Street is located within the Holly-Seacliff Specific Plan area,
and is between Main Street to the south and the Huntington Lake Apartments and Huntington
Creek Condominiums to the north. The northerly terminus is approximately 1300 feet north of
Main Street, with through access to Ellis Avenue prevented by existing development to the north.
The proposed area of vacation is shown on Attachment (1).
Purpose of Vacation:
The purpose of the proposed vacation is to eliminate an unnecessary portion of street which has
become a maintenance problem and a difficult area to police. The subject portion of Huntington
Street has been brought to the attention of Planning Staff and Public Works Staff, by the Police
Department, as an area that presents access and patrol problems for the police. Since this portion
of Huntington Street is infrequently used it has also become an area where trash and hazardous
materials are occasionally dumped.

ANALYSIS (font):
Disposition and Improvement of Vacated Portions of Huntington Street:
The west side of the vacated portion of Huntington Street would revert to the property owner to
the west, Seacliff Partners, and would be incorporated into their newly proposed subdivision,
Tentative Tract 14662. This portion of Huntington Street is shown as "Parcel 1" on Attachment
(1). Tentative Tract 14662 was approved by the Planning Commission on September 8, 1993.
The east half of the vacated portion of street would revert to the property owner to the east,
Village Court Homeowners' Association; This area is shown as "Parcel 2" on Attachment (1). All
necessary improvements to partition and landscape the vacated portions of street right of way will
be funded by Seacliff Partners as part of their development of Tentative Tract 14662.
Design Issues:
The following issues have been identified and resolved as described:
1. The Village Court Homeowners' Association located on the east side of the subject portion
of Huntington Street had expressed a concern about traffic that would be generated on
Huntington Street by proposed Tract No. 14662. This issue is related to the tract development
rather than the vacation of Huntington Street. Nevertheless, the proposed development has been
designed to take only emergency access from Huntington Street in order to eliminate this concern.
2. The Village Court Homeowners' Association had expressed a concern about proposed
improvements to be made to the vacated portion of Huntington Street. Seacliff Partners has
agreed to provide landscaping of that portion of the street which will revert to the Village Court
Homeowners' Association.
3. The Huntington Creek Homeowners' Association, to the north, had expressed a desire to
eliminate drainage from Huntington Street through their condominium complex. Fifty percent of
the area that drains to the Huntington Creek Condominiums will be directed to other areas. The
remaining 50 % can not be redirected without extensive improvements. The Huntington Creek
project was designed to accept drainage from Huntington Street because that is the way the
natural drainage runs. There does not seem to be an obligation on the part of the City or Seacliff
Partners to eliminate the runoff which drains through the Huntington Creek Condominiums.
However, the Planning Commission included a condition of approval with the Seacliff Partner's
development to provide for a solution to the drainage problem subject to reimbursement from the
City. The drainage modifications will be made only if a funding source can be identified. Funding
alternatives will be presented to the City Council when the resolution to vacate is brought back
at a future date uncertain.
