APPROVED-AMENDMENT NO. 1 TO AGREEMENT WITH ALBERT GROVER AND
ASSOCIATES - TRAFFIC AND CIRCULATION SECTIONS -APPROVED-AMENDMENT NO. 2
TO AGREEMENT WITH PUBLIC ECONOMICS, INCORPORATED FOR FISCAL IMPACT
ANALYSIS-APPROVED (600.10)
The City Clerk presented a communication from the Director of Community Development
submitting contract amendments for the consulting firms of P and D Environmental Services,
Albert Grover.and Associates, and Public Economics, Incorporated in a total amount of$73,809.
On motion by Winchell, second Leipzig, Council approved the following recommended actions:
1. Approved and authorized execution by the Mayor and City Clerk of Amendment No. 2 to the
Agreement between the city and P and D Environmental Services for services regarding the
Review of the Bolsa Chica EIR for$34,469 for review and comment on the revised Bolsa
Chica Environmental Impact Report; and
2. Approved and authorized execution by the Mayor and City Clerk of Amendment No. 1 to the
Agreement between the city and Albert Grover and Associates for services regarding the
Review of the Bolsa Chica EIR for $17,300 for review and comment on the Traffic and
Circulation analysis sections of the revised Bolsa Chica Environmental Impact Report; and
3. Approved and authorized execution by the Mayor and City Clerk of Amendment No. 2 to the
Agreement between the city and Public Economics, Incorporated for services regarding the
Review of the Bolsa Chica EIR for$22,040 to prepare a fiscal impact analysis for the new
alternatives analyzed in the revised Bolsa Chica Environmental Impact Report subject to the
City Attorney's approval of the signatures.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE
VACATION OF AN EASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF KNOXVILLE AVENUE
WEST OF ALABAMA STREET.
WHEREAS, on September 6, 1994, the City Council of the City of Huntington Beach
adopted Resolution No. 6629 declaring its intention to vacate an easement for public
street purposes over a portion of Knoxville Avenue west of Alabama Street, and referring to
maps and plans on file in the office of the City Clerk for particulars as to the proposed
vacation; and
Said resolution fixed the time and place of October 3, 1994, at the hour of 7:00 P.M., or
as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center,
for hearing all persons interested in or objecting to the proposed vacation, which time was not
less than fifteen (15) days from the passage of this resolution. Notices of vacation were
posted conspicuously along the easement section proposed for vacation, and such notices
were posted not more than three hundred (300) feet apart and at least three (3) were posted.
On October 3, 1994, at the hour of 7:00 P.M., in the Council Chambers in the Civic
Center, the City Council of the City of Huntington Beach did convene for the purpose of
hearing all persons interested in or objecting to the proposed vacation of an easement for
public street purposes over a portion of Knoxville Avenue west of Alabama Street, at which
time no acceptable objection was made to said vacation, and evidence was presented showing
that said easement is not necessary for present or prospective public uses and its not suitable
for use or development as bicycle paths or routes.
NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to
Division 9, Part 3, Chapter 3 of the Califomia Streets and Highways Code, commencing with
Section 8320, does resolve that the easement for public street purposes over a portion of
Knoxville Avenue west of Alabama Street, is not necessary for present or prospective public
use, and is not suitable for use or development as bicycle paths or routes, and it is hereby
ORDERED that the easement for public street purposes over a portion of Knoxville
Avenue west of Alabama Street is hereby vacated; and that the section so vacated is more
particularly described as follows:
Being a portion of Knoxville Street, in the City of Huntington Beach, County of Orange, State of
California, as shown on the Map of Vista Del Mar Tract, filed in Book 4, page 3 Miscellaneous
Maps of said Orange County,more particularly described as follows:

Street as shown on said Vista Del Mar Tract to the northwest.corner of lot 12 of block 1001 of

The city hereby reserves and excepts from the vacation a permanent easement and
right at any time or from time to time, to construct, maintain, operate, replace, remove and
renew storm drains, sanitary sewers, water mains and appurtenant structures in, upon, over
and across such street or any vacated portion thereof, or otherwise to construct, maintain,
operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and
other convenient structures, equipment and fixtures for the operation of gas pipelines,
telegraphic and telephone lines, railroad lines, and for the transportation or distribution of
electric energy, petroleum and its products, ammonia, water and incidental purposes, including
access and the right to keep the property free from flammable materials, wood growth, and
otherwise protect same from all hazards in, upon and over the easement for public street
purposes proposed to be vacated of a portion of Knoxville Avenue.

The City Council of the City of Huntington Beach does hereby resolve as follows:
SECTION 1. A public meeting was held before the Planning Commission on July 26,
1994 at which time it was determined, pursuant to Govemment Code Section 65402, that the
proposed vacation of an easement for public street purposes over a portion of Knoxville
Avenue west of Alabama Street, conformed to the city's general plan.
SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the Califomia Streets and
Highways'Code, commencing with Section 8320, the City Council of the City of Huntington
Beach hereby declares its intention to vacate for public street purposes an easement over a
portion of Knoxville Avenue west of Alabama Street, more particularly described as follows:
Being a portion of Knoxville Street,in the City of Huntington Beach,County of Orange, State of
California,as shown on the Map of Vista Del Mar Tract,filed in Book 4,pages 3 Miscellaneous
Maps of said Orange County,more particularly described as follows:

SECTION 3. The City Clerk is directed to maintain on file in the office of the City Clerk
maps or plans showing the particulars of the proposed vacation for street purposes of a portion
of Knoxville Avenue west of Alabama Street, and reference is hereby made to such maps and
plans for particulars as to said proposed vacation.
SECTION 4. The City Council does hereby,fuc October 3, 1994, at the hour of 6:30
p.m., or as soon thereafter as the matter may be heard in Council Chambers in the Civic
Center, as the time and place for hearing all persons interested in or objecting to the proposed
vacation,which time is not less than fifteen (15) days from the passage of this resolution.
SECTION 5. The City Clerk is directed to cause a copy this resolution to be published
in a weekly newspaper, published and circulated in Huntington Beach for at least two
successive weeks prior to the time set herein for the public hearing.
SECTION 6. The Director of Public Works is directed to post, or cause to be posted,
notices of vacation conspicuously along the easement proposed to be vacated at least two
weeks before the date of the hearing. The notices shall be posted not more than 300 feet
apart, but at least three notices shall be posted. The notices shall state the day, hour, and
place of the hearing, and shall refer to the adoption of this resolution of intention, and shall
describe the easement or shall include a map or plan showing the location of the easement
proposed to be vacated.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting held thereof on the 6th day f September , 1994.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE
VACATION OF AN EASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF KNOXVILLE AVENUE
WEST OF ALABAMA STREET.
WHEREAS, on September 6, 1994, the City Council of the City of Huntington Beach
adopted Resolution No. 6629 declaring its intention to vacate an easement for public
street purposes over a portion of Knoxville Avenue west of Alabama Street, and referring to
maps and plans on file in the office of the City Clerk for particulars as to the proposed
vacation; and
Said resolution fixed the time and place of October 3, 1994, at the hour of 7:00 P.M., or
as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center,
for hearing all persons interested in or objecting to the proposed vacation, which time was not
less than fifteen (15) days from the passage of this resolution. Notices of vacation were
posted conspicuously along the easement section proposed for vacation, and such notices
were posted not more than three hundred (300)feet apart and at least three (3)were posted.
On October 3, 1994, at the hour of 7:00 P.M., in the Council Chambers in the Civic
Center, the City Council of the City of Huntington Beach did convene for the purpose of
hearing all persons interested in or objecting to the proposed vacation of an easement for
public street purposes over a portion of Knoxville Avenue west of Alabama Street, at which
time no acceptable objection was made to said vacation, and evidence was presented showing
that said easement is not necessary for present or prospective public uses and its not suitable
for use or development as bicycle paths or routes.
NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to
Division 9, Part 3, Chapter 3 of the Califomia Streets and Highways Code, commencing with
Section 8320, does resolve that the easement for public street purposes over a portion of
Knoxville Avenue west of Alabama Street, is not necessary for present or prospective public
use, and is not suitable for use or development as bicycle paths or routes, and it is hereby
ORDERED that the easement for public street purposes over a portion of Knoxville

The City Council of the City of Huntington Beach does hereby resolve as follows:

1994 at which time it was determined, pursuant to Govemment Code Section 65402, that the
proposed vacation of an easement for public street purposes over a portion of Knoxville
Avenue west of Alabama Street, conformed to the city's general plan.
SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the Califomia Streets and
Highways Code, commencing with Section 8320, the City Council of the City of Huntington
Beach hereby declares its intention to vacate for public street purposes an easement over a
portion of Knoxville Avenue west of Alabama Street, more particularly described as follows:
Being a portion of Knoxville Street,in the City of Huntington Beach, County of Orange, State of
California, as shown on the Map of Vista Del Mar Tract,filed in Book 4,pages 3 Miscellaneous

SECTION 3. The City Clerk Is directed to maintain on file in the office of the City Clerk
maps or plans showing the particulars of the proposed vacation for street purposes of a portion
of Knoxville Avenue west of Alabama Street, and reference is hereby made to such maps and
plans for particulars as to said proposed vacation.
SECTION 4. The City Council does hereby fix October 3, A994, at the hour of 6:30
p.m.,-or as soon thereafter as the matter may be heard in Council Chambers in the Civic
Center, as the time and place for hearing all persons interested in or objecting to the proposed

SECTION 5. The City Clerk Is directed to cause a copy this resolution to be published

notices of vacation conspicuously along the easement proposed to be vacated at least two
weeks before the date of the hearing. The notices shall be posted not more than 300 feet
apart, but at least three notices shall be posted. The notices shall state the day, hour, and
place of the hearing, and shall refer to the adoption of this resolution of intention, and shall
describe the easement or shall include a map or plan showing the location of the easement
proposed to be vacated.

STATEMENT OF ISSUE:
Seacliff Development Company, Inc. has requested that the City vacate Knoxville Avenue, from Alabama
Street westerly to its terminus at the railroad right-of way.
RECOMMENDED ACTION:
Adopt the attached resolution No. G to vacate Knoxville Avenue, from Alabama Street westerly
to its terminus at the railroad right-of way.
ANALYSIS:
The segment of Knoxville Avenue, from Alabama Street westerly to its terminus at the railroad right-of way,
is no longer needed for public access purposes. The owner of the property to the north, Seacliff
Development Company, Inc., has requested that the City vacate the segment.
In the past, Lake Street was connected to Alabama Street by Knoxville Avenue. In the late 1970's, a portion
of the connecting segment of Knoxville Avenue, from Lake Street to the railroad right-of-way, was vacated.
The.remaining portion of Knoxville Avenue serves only two lots on each side of the street. If the vacation is
approved, then the remnant halves of Knoxville will revert to the adjacent property owners. These remnant
halves will be of sufficient width to provide individual access to each lot.
On July 26, 1994, the Planning Commission approved General Plan conformance No. 94-3 with a finding
that the proposed vacation conforms to the City's General Plan.
The City Council, on September 6, 1994, approved Resolution of Intent No. 6629 to vacate Knoxville
Avenue, from Alabama Street westerly to its terminus at the railroad right-of way.

ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations.
sub-section (a)Minor street, alley, and utility easement vacations, of Resolution No. 4501 of the City
of Huntington Beach. Resolution No 4501 constitutes the City's implementing procedures for the
California Environmental Quality Act (CEQA) in the City, and it establishes additional categorical
exemptions for the City of Huntington Beach, pursuant to the State CEQA Guidelines, California
Government Code 115061(c).

That he is now and was during all the times mentioned the duly appointed, qualified, and
acting Street Superintendent of the City of Huntington Beach,in said County and State.
That on the 6th day of September 1994,the CITY COUNCIL of said city passed its
Resolution of Intention No. 6629, "A Resolution of the City Council of the City of Huntington'
Beach of Intention to Vacate an Easement for Public Street Purposes Over a Portion of Knoxville
Avenue,west of Alabama Street".
That after the adoption of said Resolution he posted conspicuously, along the street and
property described said Resolution,notices of the adoption of said Resolution headed"Notice of
Street Vacation", one of which notices, similar to the notice posted aforesaid, is annexed hereto and
made part hereof.
That he completed all the posting of said notices on the 16th day of September 1994, and
thereafter he made this affidavit and filed it with the City Clerk of the City of Huntington Beach.

SECTION 3. The City Clerk is directed to maintain on file in the office of the City Clerk
maps or plans showing the particulars of the proposed vacation for street purposes of a portion
of Knoxville Avenue west of Alabama Street, and reference is hereby made to such maps and
plans for particulars as to said proposed vacation.
SECTION 4. The City Council does hereby fix October 31 •1994, at the hour of 6:30
.p.m., or:as soon thereafter as the matter maybe heard in Council Chambers in the Civic .
Center, as the time and place for hearing all persons interested in or objecting to the proposed
vacation, which time is not less than fifteen (15) days from the passage of this resolution.
SECTION 5. The City Clerk is directed to cause a copy this resolution to be published
in a weekly newspaper, published and circulated in Huntington Beach for at least two
successive weeks prior to the time set herein for the public hearing.
SECTION 6. The Director of Public Works is directed to post, or cause to be posted,
notices of vacation conspicuously along the easement proposed to be vacated at least two
weeks before the date of the hearing. The notices shall be posted not more than 300 feet
apart, but at least three notices shall be posted. The notices shall state the day, hour, and
place of the hearing, and shall refer to the adoption of this resolution of intention, and shall
describe the easement or shall include a map or plan showing the location of the easement
proposed to be vacated.

STATEMENT OF ISSUE:
Seacliff Development Company, Inc. has requested that the City vacate Knoxville Avenue, from Alabama
Street westerly to its terminus at the railroad right-of way.
RECOMMENDED ACTION:
Adopt the attached resolution of intent No. (o(o,2!7_ to vacate Knoxville Avenue, from Alabama Street
westerly to its terminus at the railroad right-of way.
ANALYSIS:
The segment of Knoxville Avenue is no longer needed for public access purposes. The owner of the property
to the north, SeacliffDevelopment Company, Inc., has requested that the City vacate the segment.
In the past, Lake Street was connected to Alabama Street via Knoxville Avenue. In the late 1970's, that
segment of Knoxville Avenue, from Lake Street to the railroad right-of-way was vacated. The remaining
portion of Knoxville Avenue serves only two lots on each side of the street. If the vacation is approved, the
remnant halves of Knoxville will revert to the adjacent property owners. These remnant halves will be of
sufficient width to provide individual access to each lot.
Following Council approval of the Resolution of Intent, public notice of the action will be given. The public
will have the opportunity to object to the proposal. If no objections are received, a request to order the
vacation will be presented to the City Council four to six weeks after approval of the Resolution of Intent.
On July 26, 1994, the Planning Commission approved General Plan conformance No. 94-3 with the findings
that the proposed vacation conforms to the City's General Plan.

ENVIRONMENTAL STATUS:
The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations,
sub-section (a) Minor street, alley, and utility easement vacations, of Resolution No. 4501 of the City
of Huntington Beach. Resolution No 4501 constitutes the City's implementing procedures for the
California Environmental Quality Act (CEQA) in the City, and it establishes additional categorical
exemptions for the City of Huntington Beach, pursuant to the State CEQA Guidelines, California
Government Code §15061(c).
FUNDING SOURCE
There is no cost involved in the recommended action.

VACATION OF AN EASEMENT FOR PUBLIC STREET
PURPOSES OVER A PORTION OF KNOXVILLE AVENUE
WEST OF ALABAMA STREET.
WHEREAS, on September 6, 1994, the City Council of the City of Huntington Beach
adopted Resolution No. 6629 declaring its intention to vacate an easement for public
street purposes over a portion of Knoxville Avenue west of Alabama Street, and referring to
maps and plans on file in the office of the City Clerk for particulars as to the proposed
vacation; and
Said resolution fixed the time and place of October 3, 1994, at the hour of 7:00 P.M., or
as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center,
for hearing all persons interested in or objecting to the proposed vacation, which time was not
less than fifteen (15) days from the passage of this resolution. Notices of vacation were
posted conspicuously along the easement section proposed for vacation, and such notices
were posted not more than three hundred (300) feet apart and at least three (3) were posted.
On October 3, 1994, at the hour of 7:00 P.M., in the Council Chambers in the Civic
Center, the City Council of the City of Huntington Beach did convene for the purpose of
hearing all persons interested in or objecting to the proposed vacation of an easement for
public street purposes over a portion of Knoxville Avenue west of Alabama Street, at which
time no acceptable objection was made to said vacation, and evidence was presented showing
that said easement is not necessary for present or prospective public uses and its not suitable
for use or development as bicycle paths or routes.
NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to
Division 9, Part 3, Chapter 3 of the California Streets and Highways Code, commencing with
Section 8320, does resolve that the easement for public street purposes over a portion of
Knoxville Avenue west of Alabama Street, is not necessary for present or prospective public
use, and is not suitable for use or development as bicycle paths or routes, and it is hereby
ORDERED that the easement for public street purposes over a portion of Knoxville
Avenue west of Alabama Street is hereby vacated; and that the section so vacated is more
particularly described as follows:
Being a portion of Knoxville Street, in the City of Huntington Beach, County of Orange, State of
California,as shown on the Map of Vista Del Mar Tract, filed in Book 4,page 3 Miscellaneous
Maps of said Orange County, more particularly described as follows:

Parcel 1
Beguuiing at the southwest corner of lot 1 of block 1101 of said Vista Del Mar Tract;thence
easterly 125.00 feet along the south line of said lot 1 to the southeast corner of said lot 1;thence
southerly 60.00 feet along the southerly prolongation of the westerly right-of-way line of Alabama
Street as shown on said Vista Del Mar Tract to the northwest corner of..lot 12 of block 1001 of
said Vista Del Mar Tract;thence westerly 125.00 feet along the north line of said lot 12 to the
northwest corner of said lot 12;thence northerly 60.00 feet along the easterly line of the S.P.R.R.
right-of--way as shown on said Vista Del Mar Tract to the point of beginning.
Parcel 2
That portion lying northeasterly of a curve concave southwesterly and having a radius of 20,00
feet, said curve being tangent on the north to the south line of said parcel 1 and tangent on the east
to the east line of said lot 12.
The city hereby reserves and excepts from the vacation a permanent easement and
right at any time or from time to time, to construct, maintain, operate, replace, remove and
renew storm drains, sanitary sewers, water mains and appurtenant structures in, upon, over
and across such street or any vacated portion thereof, or otherwise to construct, maintain,
operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and
other convenient structures, equipment and fixtures for the operation of gas pipelines,
telegraphic and telephone lines, railroad lines, and for the transportation or distribution of
electric energy, petroleum and its products, ammonia, water and incidental purposes, including
access and the right to keep the property free from flammable materials, wood growth, and
otherwise protect same from all hazards in, upon and over the easement for public street
purposes proposed to be vacated of a portion of Knoxville Avenue.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
