WHEREAS, on October 3, 1994, the City Council of the City of Huntington Beach adopted Resolution No. 6635 declaring its intention to vacate an easement for public street purposes over a portion of Crystal Street north of Garfield Avenue, and referring to maps and plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of November 7, 1994, at the hour of 7:00 P.M., or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of this resolution. Notices of vacation were posted conspicuously along the easement section proposed for vacation, and such notices were posted not more than three hundred (300) feet apart and at least three (3)were posted. On November 7, 1994, at the hour of 7:00 P.M., in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of an easement for public street purposes over a portion of Crystal Street north of Garfield Avenue, at which time no acceptable objection was made to said vacation, and evidence was presented showing that said easement is not necessary for present or prospective public uses and its not suitable for use or development as bicycle paths or routes. NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Part 3, Chapter 3 of the Califomia Streets and Highways Code, commencing with Section 8320, does resolve that the easement for public street purposes over a portion of Crystal Street north of Garfield Avenue, is not necessary for present or prospective public use, and is not suitable for use or development as bicycle paths or routes, and it is hereby ORDERED that the easement for public street purposes over a portion of Crystal Street north of Gafield Avenue is hereby vacated; and that the section so vacated is more particularly described as follows: Being a portion of Lot 1 of Block"E"of the Garfield Street addition to Huntington Beach,in the City of Huntington Beach, County of Orange, State of California,as shown on a map recorded in Book 7,pages 27 and 28 of Miscellaneous Maps,in the office of the County Recorder of said county, being described as follows: 1 6/resollcrystalt/09/1 W94 Beginning at the northeast corner of said Lot 1,thence south 0°00'00"west 79.00 feet along the east line of said Lot 1 to the beginning of a tangent curve,concave northwesterly and having a radius of 34.00 feet;thence southwesterly 32.03 feet along said curve through a central angle of 53°58'27"to the beginning of a non-tangent curve concave northwesterly and having a radius of 32.00 feet,a radial line through said curve bears north 61*01'47"west;thence northeasterly 16.19 feet along said curve through a central angle of 28°58'13"to a point on a line, said line being 10.00 feet westerly measured at right angles from the east line of said Lot 1;thence north 0°00'00" west 91.00 feet along said line to a point;thence south 90°00'00"east 10.00 feet to the true point of beginning. RECOMMENDED ACTION: 1. Continue the public hearing open to November 21, 1994. AND THEN, ON NOVEMBER 21, 1994, 2. Adopt the attached resolution No. b 7 to vacate a portion of Crystal Street, north of Garfield Avenue ANALYSIS: A ten foot strip of dedicated street right-of-way located along the west side of Crystal Street, north of Garfield Avenue, is no longer needed for street purposes because of a change in the ultimate right-of-way plan which was adopted after the ten foot strip of land was dedicated. The adjacent property owner, who had previously dedicated the ten foot strip of land,has requested that the City vacate the unneeded right-of-way. The ten foot strip of land was dedicated for street purposes in 1987 in accordance with the precise plan of street alignment in effect at that time. Precise Plan of Street Alignment No. 90-2 was subsequently adopted in 1990. This new precise plan of street alignment eliminated the need for the ten foot strip of right-of-way along the west side of Crystal Street. The ten foot strip of land, if vacated, will revert to the adjacent property owner who originally dedicated the land, The adjacent parcel will then be increased in width from 50 feet to 60 feet On August 23, 1994, the Planning Commission approved General Plan conformance No. 94-4 with the findings that the proposed vacation conforms to the City's General Plan. Request for City Council Action Vacation of Crystal Street November 7, 1994 Page 2 The City Council, on October 3,1994, approved Resolution of Intent No. 6635 to vacate the subject portion of Crystal Street. The Council also set a public hearing date of November 7, 1994. The statutory requirement for posting of the site two weeks prior to the public hearing was not done. Therefore, the public hearing must be continued to November 21, 1994. The site was posted on November 3, 1994. ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations, sub-section (a)Minor street, alley, and utility easement vacations. RECOMMENDED ACTION: Adopt the attached resolution No. 35� declaring intent to vacate a portion of Crystal Street, north of Garfield Avenue. ANALYSIS: A ten foot strip of dedicated street right-of-way located along the west side of Crystal Street, north of Garfield Avenue, is no longer needed for street purposes because of a change in the ultimate right-of-way plan which was adopted after the ten foot strip of land was dedicated. The adjacent property owner, who had previously dedicated the ten foot strip of land,has requested that the City vacate the unneeded right-of-way. The ten foot strip of land was dedicated for street purposes in 1987 in accordance with the precise plan of street alignment in effect at that time. Precise Plan of Street Alignment No. 90-2 was subsequently adopted in 1990. This new precise plan of street alignment eliminated the need for the ten foot strip of right-of-way along the west side of Crystal Street. The ten foot strip of land, if vacated, will revert to the adjacent property owner who originally dedicated the land. The adjacent parcel will then be increased in width from 50 feet to 60 feet. If the proposed Resolution of Intent is approved, then public notice of the action will be given. The public will have the opportunity to object to the proposal. If no objections are received, then a request to order the vacation will be presented to the City Council within six weeks of approval of the Resolution of Intent. On August 23, 1994, the Planning Commission approved General Plan conformance No. 94-4 with the findings that the proposed vacation conforms to the City's General Plan. _ • Request for City Council Action Vacation of Crystal Street �Qctober 3, 1994 Page 2 ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations, sub-section (a)Minor street, alley, and utility easement vacations, of Resolution No. 4501 of the City of Huntington Beach.
