Funding Source: There is no cost involved in the recommended action. Recommended Action: Adopt the attached resolution No. 797 to summarily vacate a portion of Garrett Circle at Education Lane. Alternative Action(s): Deny the recommended action. AUEST FOR COUNCIL ACTIuN MEETING DATE: December 18, 1995 DEPARTMENT ID NUMBER: PW 95-081 Analysis: On April 26, 1995, the Subdivision Committee reviewed Tentative Tract No. 14515. After a staff presentation on the proposed project, and the discussion on the suggested conditions of approval, the Subdivision Committee recommended approval of the tract map with the condition that the developer, Presley Companies, contact the property owners at 9862 and 9852 Garrett Circle in regard to vacating a portion of Garrett Circle, allowing for removal of the knuckle at Education Lane and Garrett Circle, and reconstructing a regular tee intersection. The property owners were contacted and have no objections to the street vacation and subsequent re-construction. On June 13, 1995, the Planning Commission approved Tentative Tract No. 14515 with the condition that a portion of Garrett Circle be vacated to allow for the removal of the knuckle at Education Lane and Garrett Circle and subsequent construction of a tee intersection. The street system within this development, when completed, will provide for better circulation from the existing streets with a four (4) way intersection at Education Lane and Constitution Drive, and a proposed straight tee intersection at Garrett Circle and Education Lane. The vacated portions of the street will be improved to match existing properties, as required by the Public Works Department. Environmental Status: The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations, sub-section (a) Minor street, alley, and utility easement vacations, of Resolution No. 4501 of the City of Huntington Beach. Resolution No 4501 constitutes the City's implementing procedures for the California Environmental Quality Act (CEQA) in the City, and it establishes additional categorical exemptions for the City of Huntington Beach, pursuant to the State CEQA Guidelines, California Government Code 115061(c).
