Notices of vacation were posted conspicuously along the easement section proposed for vacation, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On December 18, 1995, at the hour of 7:00 P.M., in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of an easement for public street purposes over a portion of Island Bay Lane, north of Palm Avenue, at which time no acceptable objection was made to said vacation, and evidence was presented showing that said easement is not necessary for present or prospective public uses and its not suitable for use or development as bicycle paths or routes. Tomaino, the property owner at 6812 Scenic Bay Lane (Lot 1, Tract No. 6904) has requested that a portion of the east side of Island Bay Lane, north of Palm Avenue, be vacated. Funding Source: There is no cost involved in the recommended action. Recommended Action: Adopt the attached Resolution No. 10 3,5�' to vacate a portion of the east side of Island Bay Lane, north of Palm Avenue, as shown on the attached plat map. Alternative Action(s): Deny the recommended action. RQUEST FOR COUNCOL ACTAIV MEETING DATE: December 18, 1995 DEPARTMENT ID-NUMBER: PW95-076 Analysis: This property to be vacated is bounded by Palm Avenue to the south, Island Bay Lane to.the west, and Scenic Bay Lane to the north. The owner is seeking to vacate excess right-of-way not required for street or highway purposes.located along the east side of Island Bay Lane north of Palm Avenue. This vacation would result in a reduction of the parkway Width from 10.00 feet to 6.00 feet which would be compatible with the surrounding neighborhood. The only modifications to the existing street improvements would consist of removing the existing sidewalk, relocating the existing private block wall to within 6.00 feet of the curb, and reconstructing the sidewalk to a width of 6.00 feet. Mr. Tomaino, the property owner, ;.is proposing to pay the cost of all required improvements. The Planning Commission, on October 24, 1995, approved General Plan Conformance No. 95-4 with a finding that the proposed vacation conforms to the City's General Plan. The City Council, on November 20, 1995, approved Resolution of Intent No. 6723 to vacate the subject portion of Island Bay Lane. Environmental Status: The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations, sub-section (a) Minor street, alley, and utility easement vacations, .of Resolution No. 4501 of the City of Huntington Beach. Resolution No 4501 constitutes the City's implementing procedures for the California Environmental Quality Act (CEQA) in the City, and it establishes additional categorical exemptions for the City of Huntington Beach, pursuant to the State CEQA Guidelines, California Government Code 115061(c). Alternative Action(s): Deny the recommended action. #QUEST FOR COUNCIL ACTIuN MEETING DATE: November 20, 1995 DEPARTMENT ID NUMBER: PW95-028 Analysis: This property to be vacated is bounded by Palm Avenue to the south, Island Bay Lane to the west, and Scenic Bay Lane to the north. The owner is seeking to vacate excess right-of-way not required for street or highway purposes located along the east side of Island Bay Lane north of Palm Avenue. This vacation would result in a reduction of the parkway width from 10.00 feet to 6.00 feet which would be compatible with the surrounding neighborhood. The only modifications to the existing street improvements would consist of removing the existing sidewalk, relocating the existing private block wall to within 6.00 feet of the curb, and reconstructing the sidewalk to a width of 6.00 feet. Mr. Tomaino, the property owner, is proposing to pay the cost of all required improvements. Following Council approval of the Resolution of Intent, public notice of the action will be given. The public will have the opportunity to object to the proposal. If no objections are received, a request to order the vacation will be presented to the City Council four to six weeks after approval of the Resolution of Intent. The Planning Commission, on October 24, 1995, approved General Plan Conformance No. 95-4 with a finding that the proposed vacation conforms to the City's General Plan. Environmental Status: The proposed project is categorically exempt pursuant to Class V: Alterations in Land Use Limitations, sub-section (a) Minor street, alley, and utility easement vacations, of Resolution No. 4501 of the City of Huntington Beach.
