WHEREAS, on February 18, 1997, the City Council of the City of Huntington Beach adopted Resolution No. 9 7- i n declaring its intention to vacate an easement for public street purposes over a portion of Gothard Street, between Ellis Avenue and Main Street; and referring to maps and plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of April 7, 1997, at the hour of 7:00 P.M., or as soon thereafter as the matter could be heard, in the Council Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of this resolution. Notices of vacation were posted conspicuously along the easement section proposed for vacation, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On April 7, 1997, at the hour of 7:00 P.M., in the Council Chambers in the Civic Center, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of an easement for public street purposes over a portion of Gothard Street, between Ellis Avenue and Main Street, at which time no acceptable objection was made to said vacation, and evidence was presented showing that said easement is not necessary for present or prospective public uses and is not suitable for use or development as bicycle paths or routes. This RCA is to adopt the Resolution of Intent which will be followed by the Final Resolution and public hearing on April 7, 1997. Fundinci Source: There is no cost involved in the recommended action. Recommended Action: Adopt the attached Resolution of Intent No. to vacate Gothard Street, between Ellis Avenue and Main Street. Alternative Action(s): Deny the recommended action. REQUEST FOR COUNCIL ACTIO MEETING DATE: February 18, 1997 DEPARTMENT ID NUMBER: PW95-064 Analysis: The vacation of Gothard Street, between Ellis Avenue and Main Street is a result of measures outlined in the Holly-Seacliff General Plan Amendment No. 89-1, the Holly- Seacliff Development Agreement, Precise Plan of Street Alignment No. 90-2, and Ordinance No. 3102. Ordinance No. 3102 was adopted by City Council on April 1, 1991, approving Precise Plan of Street Alignment No. 90-2. The Precise Plan established the new alignment of Gothard Street between Ellis Avenue and Main Street, to the west of the old alignment. The new alignment is a component of the public improvement portion of the Development Agreement between the City and Pacific Coast Homes which is the major land owner in the area. The Department of Public Works, Fire Department, Real Estate.Management division and the Planning Division reviewed the alignment and determined that the precise plan properly implemented the circulation plan in the Holly-Seacliff Master Plan by reducing the impacts of acquisition of private property. Following Council approval of the Resolution of Intent, public notice of .the action will be given. The public will have the opportunity to object to the proposal. If no objections are received, a request to order the vacation will be presented to the City Council four to six weeks after approval of the Resolution of Intent. The Planning Commission, on January 8, 1993, approved General Plan Conformance No. 92-9 with:the findings that the proposed vacation conforms to the City's General Plan. Environmental Status: The proposed project is categorically exempt pursuant to Class V: Alterations in land Use Limitations, sub-section (a) Minor street, alley and utility easement vacations, of Resolution No. 4501 of the City of Huntington Beach. Alternative Action(s): Deny the recommended action. y- 1 REQUEST FOR COUNCIL ACTIO MEETING DATE: April 7, 1997 DEPARTMENT ID NUMBER: PW95-066 Analysis: The vacation of Gothard Street, between Ellis Avenue and Main Street is a result of measures outlined in the Holly-Seacliff General Plan Amendment No. 89-1, the Holly- Seacliff Development Agreement No. 90-1, Precise Plan of Street Alignment No. 90-2, and Ordinance No. 3102. Ordinance No. 3102 was adopted by City Council on April 1, 1991, approving Precise Plan of Street Alignment No. 90-2. The Precise Plan established the new alignment of Gothard Street between Ellis Avenue and Main Street. The new alignment is a component of the public improvement portion of the Development Agreement between the City and PLC Land Company which is the major land owner in the area. The Department of Public Works, the Fire Department, the Real Estate Management Division and the Planning Division reviewed the alignment and determined that the precise plan properly implemented the circulation plan in the Holly-Seacliff Master Plan by reducing the impacts of acquisition of private property. The Planning Commission, on January 8, 1993, approved General Plan Conformance No. 92-9 with the findings that the proposed vacation conforms to the City's General Plan. The City Council, on February 18, 1997, approved Resolution of Intent No. 97-10 to vacate Gothard Street, between Ellis Avenue and Main Street, and scheduled a public hearing for April 7, 1997 for the purpose of hearing all persons interested in or objecting to the proposed vacation. Environmental Status: Staff has determined that the proposed vacation of Gothard Street conforms with the alignment addressed in Environmental Impact Report No. 89-1. The Holly-Seacliff Master Plan and Environmental Impact Report No. 89-1, which were adopted by the City Council on January 8, 1990, and all applicable mitigation measures identified in Environmental Impact Report No. 89-1 have been complied with.
