A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE SUMMARY VACATION OF A WALKWAY
RIGHT-OF-WAY LOCATED AT THE TERMINUS OF ARAGON CIRCLE AT
YORKTOWN AVENUE AND WARD STREET
WHEREAS, the City of Huntington Beach desires to summarily vacate a right-of-way for
walkway purposes located at the Terminus of Aragon Circle at Yorktown Avenue and Ward Street ,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as
follows:
1. Pursuant to Division 9, Part 3, Chapter 4 of the Califomia Streets and Highway Code,
commencing with Section 8334, the City Council of the City of Huntington Beach hereby orders the
summary vacation of excess right-of--way for walkway purposes located at the Terminus of Aragon
Circle at Yorktown Avenue and Ward Street.
2. The right-of-way hereby vacated is more particularly described as follows:
THE 10.00 FOOT WALKWAY EASEMENT AS SHOWN ON TRACT NO.4884, IN THE CITY OF
HUNTINGTON BEACH, COUNTY OF ORANGE,STATE OF CALIFORNIA,PER MAP THEREOF FILED
IN BOOK 189, PAGES 8 THROUGH 10,OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE
COUNTY RECORDER OF SAID COUNTY.
L7) The City hereby reserves and excepts from the vacation a permanent easement and
right at any time or from time to time,to construct, maintain, operate, replace, remove
and renew water mains and appurtenant structures in, upon, over and across that
portion of the walkway easement to be vacated.
Said parcel is as shown on attached Exhibit"A_.
3. The City Council does hereby confirm and declares that from and after the date of the
recordation of this resolution that the right-of-way herein identified is no longer necessary for walkway
purposes.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular
meeting thereof held on the 6th day of October , 1997.

Statement of Issue: Tim Henigman and Tim Karpinski, the property owners residing at
19502 and 19051 Aragon Circle respectively, have requested (see attached letter) that the
walkway easement leading from Aragon Circle to Ward Street and Yorktown Avenue be
vacated.
Funding Source: There is no cost involved in the recommended action.
Recommended Action: Motion to Adopt the attached resolution No. 9-7---7a to

Analysis: On July 3, 1997, a request was made (see attached letter) by Tim Henigman
and Tim Karpinski, the property owners residing at 19502 and 19051 Aragon Circle
respectively, to vacate the walkway easement leading from Aragon Circle to Ward Street
and Yorktown Avenue. This request was prompted by criminal activity in the area using the
walkway as an ingress and egress point, children wandering out onto the intersection of
Yorktown Avenue and Ward Street, growing concern for family safety and increased traffic
noise. Staff, including the Police Department supports this request.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE SUMMARY VACATION OF A WALKWAY
RIGHT-OF-WAY LOCATED AT THE TERMINUS OF ARAGON CIRCLE AT
YORKTOWN AVENUE AND WARD STREET
WHEREAS, the City of Huntington Beach desires to summarily vacate a right-of-way for
walkway purposes located at the Terminus of Aragon Circle at Yorktown Avenue and Ward Street ,
NOW, THEREFORE,the City Council of the City of Huntington Beach does hereby resolve as
follows:
1. Pursuant to Division 9, Part 3, Chapter 4 of the Califomia Streets and Highway Code,
commencing with Section 8334,the City Council of the City of Huntington Beach hereby orders the
summary vacation of excess right-of-way for walkway purposes located at the Terminus of Aragon
Circle at-Yorktown Avenue and Ward Street.
2. The right-of-way hereby vacated is more particularly described as follows:
THE 10.00 FOOT WALKWAY EASEMENT AS SHOWN ON TRACT NO.4884, IN THE CITY OF
HUNTINGTON BEACH, COUNTY OF ORANGE,STATE OF CALIFORNIA, PER MAP THEREOF FILED
IN BOOK 189, PAGES 8 THROUGH 10,OF MISCELLANEOUS MAPS,IN THE OFFICE OF THE
COUNTY RECORDER OF SAID COUNTY.
V The City hereby reserves and excepts from the vacation a permanent easement and
right at any time or from time to time,to construct, maintain, operate, replace, remove
and renew water mains and appurtenant structures in, upon, over and across that
portion of the walkway easement to be vacated.
Said parcel is as shown on attached Exhibit
3. The City Council does hereby confirm and declares that from and after the date of the
recordation of this resolution that the right-of-way herein identified is no longer necessary for walkway
purposes.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular
meeting thereof held on the 6th day of October , 1997.

Enclosed, please find our check for $300.00 to initiate the `vacation of easement process' for a
10' section of land between our two properties at 19502 and 19501 Aragon Circle(see
attachment 1).
On January 10, 1996 a man in his early twenties entered our cul-de-sac via this easement from the
Ward/Yorktown intersection, stole personal property from 19502 Aragon and again used the
easement as his exit route. The police officer, R. Velez, who responded to the above incident
suggested that we try to wall off the end of the cul-de-sac because of the ease at which a criminal
might enter and exit the neighborhood. This incident also brought to light the ease at which not
only personal property be stolen, but neighborhood children could wander onto the busy street or
be abducted from the cul-de-sac.
Due to the above incident, increasing traffic and noise from the.Yorktown/Ward intersection since
the traffic signal at the Ward/Garfield intersection was installed, and a growing concern for our
families safety, we would like to build a wall along the property lines of 19501 and 19502 Aragon
Circle which border the Ward/Yorktown intersection.
