Resolution 99-94 - Vacation of an Easement for Public Street
RESOLUTION NO. 99-75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING INTENT TO VACATE AN EASEMENT FOR PUBLIC STREET PURPOSES OVER A PORTION OF THE ALLEY LOCATED NORTH OF LOMA AVENUE, SOUTH OF ADAMS AVENUE, EAST OF MAIN STREET AND WEST OF PARK STREET The City Council of the City of Huntington Beach does hereby resolve as follows: SECTION 1. A public meeting was held before the Planning Commission on July 13, 1999, at which time it was determined, pursuant to Government Code Section 65402, that the proposed vacation of a portion of the alley located north of Loma Avenue, south of Adams Avenue, east of Main Street and west of Park Street, conformed to the city's general plan. SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Highways Code, commencing with Section 8320, the City Council of the City of Huntington Beach hereby declares its intention to vacate for public street purposes an easement over a portion of the alley located north of Loma Avenue, south of Adams Avenue, east of Main Street and west of Park Street: BEING THAT PORTION OF BLOCK 1014 OF TRACT 68,IN THE CITY OF HUNTINGTON BEACH, COUNTY OF ORANGE, STATE OF CALIFORNIA,AS SHOWN ON A MAP RECORDED IN BOOK 10,PAGE 12,MISCELLANEOUS MAPS, RECORDS OF SAID COUNTY,BEING DESCRIBED AS FOLLOWS: THE NORTH 15.00 FEET OF THE SOUTH 195.00 FEET OF THE EAST 185.30 FEET OF SAID BLOCK 1014. EXCEPTING THEREFROM THOSE PORTIONS PREVIOUSLY DEDICATED FOR HIGHWAY PURPOSES. The City hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove, and/or renew telegraphic and telephone lines, and for the transportation or distribution of electric energy, including access and the right to keep the property free from flammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over that portion of the alley_located north of Loma Avenue, south of Adams Avenue, east of Main Street and west of Park Street to be vacated. SECTION 3. The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the particulars of the proposed vacation for street purposes of a portion of the alley located north of Loma Avenue, south of Adams Avenue, east of Main Street and west of Park Street, and reference is hereby made to such maps and plans for particulars as to said proposed vacation. SECTION 4. The City Council does hereby fix November 1, 1999, at the hour of 6:30 p.m., or as soon thereafter as the matter may be heard in Council Chambers in the Civic Center, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. 1 khesolu/vacate 1/10/6/99 Resolution 99-75 SECTION 5. The City Clerk is directed to cause a copy this resolution to be published in a weekly newspaper, published and circulated in Huntington Beach for at least two successive weeks prior to the time set herein for the public hearing. SECTION 6. The Director of Public Works is directed to post, or cause to be posted, notices of vacation conspicuously along the easement proposed to be vacated at least two weeks before the date of the hearing. The notices shall be posted not more than 300 feet apart, but at least three notices shall be posted. The notices shall state the day, hour, and place of the hearing, and shall refer to the adoption of this resolution of intention, and shall describe the easement or shall include a map or plan showing the location of the easement proposed to be vacated. Loma Alley vacation RCA -2- 09/13/99 9:29 AM D 77 REQUEST FOR COUNCIL ACTION MEETING DATE: September 20, 1999 DEPARTMENT ID NUMBER: PW 99-080 The proposed alley vacation would result in a transfer of land to Mr. Mike Ester and Mr. Frank Kurisu. This transfer of land would allow each property owner to capture approximately 7.50 feet along the side of their properties and 1,165 square feet in total lot area. Following Council approval of the Resolution of Intent, public notice of the action will be given. The public will have the opportunity to object to the proposal. If no objections are received, a request to order the vacation will be presented to the City Council at its October 18, 1999 meeting. PUBLIC COMMENTS VIRGINIA SIMS, expressed concern regarding the Fourth of July parade during which she believes Pat Boone the Fourth of July Parade Grand Marshal was treated unfairly by the announcers from KFI radio station assigned to cover the parade. She informed Council that she believes a letter of apology should be forwarded to Mr. Boone. DAVID COHEN, representing Southern California Roofing, informed Council of the reasons he believes their bid on the repair of the city hall roof should not have been rejected. He requested a review of the matter. Mr. Cohen was referred by Council to the Public Works Director. City Administrator Silver stated that a report would be sent to Council regarding Mr. Cohen's allegations. DON MC GEE, addressed Council in opposition to the planes towing banners in the downtown beach area location-. He spoke regarding the noise and asked if anything was going to be done or will it be left to the FAA when an accident occurs. JEANETTE CLAPP, spoke regarding the General Plan Conformance No. 99-1 alley vacation that was approved by the Planning Commission on June 20, 1999. She distributed a communication to Council regarding the proposed alley vacation. The communication consisted of a memorandum dated July 26, 1999 from the City Clerk to the Mayor and City Council titled Petition in Opposition to Permanent Closure to the Public Alley Running East and West in the Twelve Hundred Block Bounded by Main/Adam/Park/Loma with an Attachment of a Petition signed by Residents Opposed to Said Closure. The petition contained 17 signatures; attached to it was the Planning Department staff report and Planning Commission agenda on the subject. She distributed this communication to the City Councilmembers and the City Clerk. Ms. Clapp spoke regarding the reasons why she believes the alley is needed by the residents. Councilmember Bauer requested that the Council be informed regarding this matter. SHANAZ RAZA, stated she wished to bring a drainage problem to the City Council's attention. She stated the problem occurs because the water collects. She stated that years ago she and her husband had fallen on the area. She stated that she has submitted letters and requested a written response but had not yet received one. She requested that action be taken on this drainage problem in the area of Flagstaff Lane. BOB BOLEN, stated that he was to speak on the public hearing item relative to Zoning Text Amendment No. 98-4- Downtown Outdoor Dining w/Alcohol. He requested permission to speak at this time as he had to leave for a trip in the morning. He presented reasons for his opposition to outdoor dining with alcohol, including reference to a recent incident where a police officer was injured from a person drinking. He related an incident in the downtown area where police and fire had to respond which costs the city a considerable amount of money. KATHERINE JOHANSEN, stated that her family owned over 400 apartment units many of which are in the Oak View area. She stated that one recent murder had occurred at a unit adjacent to her property. Ms. Johansen read the letter to the City Council that she stated she had sent and to which she had not yet received a response. She spoke regarding what she believes is a lack of a safe, clean environment in this area. The vacation of the subject alley off Park Street is consistent with the following goals and- policies of the Land Use, Public Facilities & Services, Urban Design, and Circulation Elements of the General Plan: a. LUPolicy 4.3.2: "Promote and support community and neighborhood based effortsfor the maintenance, upkeep, and renovation of structures and sites. " The vacation of the subject alley off Park Street encourages the rational use of land and other natural resources. Since this portion of land is not necessary to maintain vehicular traffic in an orderly manner, and no other property owners need to access the alley for entrance and exit purposes, vacation of the property and transfer to the adjacent property owners will allow the land to be utilized to its full potential. Once the alley becomes private property, the adjacent property owners will be able to clean-up the alley and make necessary aesthetic improvements. b. " The vacation of the subject alley off Park Street will not adversely impact the City's transportation system and is consistent with efforts to minimize adverse environmental and aesthetic effects. In addition to using the major streets that surround the project site, neighboring residents will still be able to utilize the alley that runs north-south between Adams and Loma to access their properties. Once vacated, the subject alley will still support the two residences with garages off this alley. 2. The vacation of the subject alley off Park Street is not necessary to provide efficient circulation to the area. It will be utilized to its full potential if the two property owners, who are the only ones who access the alley for vehicular purposes, are able to capture a portion of the alley. They will be able to make necessary improvements to enhance the visual appearance of the alley and as result, enjoy their properties to a greater extent. They intend to install landscaping if the alley vacation is approved. Staff Report—7/13/99 2 (99sr23) ISSUES: General Plan Conformance: The proposed project is consistent with the goals and objectives of the City's General Plan.and the Land Use Element designation of Residential-Low Density on the subject property. The following is a summary of the specific policies with which the vacation complies: Land Use LU Policy "Promote and support community and neighborhood based efforts for the maintenance, upkeep, and renovation of structures and sites. " The proposed vacation of the alley would result in a transfer of land to the two adjacent property owners who own lots to the north and south of the alley, on Park Street. This transfer of land would allow each property owner to c9ture approximately 7.5 feet along the side of their properties and 1,165 square feet in total lot area. If the vacation is approved and the alley becomes private property, the property owners will be able to make improvements to the alley as they deem necessary. This will help to avoid future deterioration of the alley. In addition, once the alley is fenced off the general public will no longer be able to walk through the alley and litter it. Urban Design UD Goal 1: "Enhance the visual image of the City of Huntington Beach. " The alley has been littered with trash and debris in the past. Vacation of the alley would allow the adjacent property owners to capture the alley and block it off. This would make it more difficult to litter the alley as access would be blocked off and any incidents would be considered trespassing. By cleaning up the alley and preventing future damage and deterioration, the visual image of the City can be improved. Public Facilities and Services PF Goal 1 "Protect the community from criminal activity, reduce the incident of crime and provide other necessary services within the City." The property owners have indicated that the alley is used heavily during the school year by students.. These students damage their property, litter the alley, and generally disrupt their peace as they walk through the alley. Vacation of the property would allow the property owners to block off access to the alley and as a result, they would be protected from future incidents resulting from the alley being open to just anyone. Circulation CE Goal 1 "Provide a circulation system which supports existing, approved, and planned land uses throughout the City while maintaining a desired level of service on all streets and at all intersections. The alley is situated between two residences which have frontage on Park Street and only two property owners take direct access from the alley to their garages. There are no other garages off this alley besides these two residences. The alley does extend from Park Street to a north-south alley that connects to Adams Avenue and Loma Avenue. There are residences that have garages accessing the north-south alley. These residences will no longer have access to Park Street. The alley vacation will not have an adverse impact to these residences because they will still have two points of ingress and egress (Adams Avenue and Loma Avenue). This is consistent with other residential blocks of this size in Huntington Beach. Pedestrians currently use this segment of the alley. The alley is in close proximity to Huntington Beach High SchooN6he property owners indicate that the students have been damaging their property along with the alley and that in general, are disrupting their peace and quality of life Vacation of the alley would preclude pedestrian and vehicular access from Park Street to the north-south alley. This alley runs perpendicular from Park Street (in an East to West direction)to another alley but does not access Main Street. I, Frank Kurisu purchased, 1215 Park Street in the latter part of 1988. The Esters purchased, 1209 Park Street in mid 1997. Together we have petitioned the City of Huntington Beach to vacate the alley. Not being a resident of the neighborhood you may or may not know that this alley is very unique. It is the ONLY alley that runs adjacent to ONLY two properties. It is also one of very few alleys that does not start and end at a named street. During the September 20, 1999, City Council meeting our Resolution of Intent was denied by Council 6 to 1 (Shirley Dettloff voting against). The Item Number was E-20 and the vote took place at approximately 1:15 AM, after a long drawn out session including issues with Wal-Mart and Eminent Domain. . This Item is now up for reconsideration at the October 4, 1999 Council meeting. We are writing this letter to show you the support that we have gathered for this alley vacation and to inform you with our reasons for asking the city for this vacation. Accompanying this letter is a petition which has been signed by our neighbors in support of the City vacating this alley. The petition is 5 pages long with a total of 29 names. Some of our reasons for the alley vacation are: 1. The alley runs parallel to ONLY our properties. Alley serves to access our garages. r� Page 2 of 2 2. One home's'bedrooms and bathroom are next to the alley. This wall is 4.5 feet from the alley edge. Vacation of the alley will create a safe zone for the home. 3. Eliminate the (speeding)traffic, noise, and dust. 4. During the school year kids use the alley as a path to go to and from school. Some of the kids have been mischievous and have been verbally abusive. 5. We would like to create a more beautiful neighborhood image by landscaping part of the alley. Other reasons for vacating the alley: * We will take the responsibility of maintenance for the alley away from the City. * As you can read in the planning department report ALL City departments have signed off the alley as not being of use to them. This includes the Garbage collection, and the FIRE DEPARTMENT. * There are no utilities in the alley. * Meets the Planning Commission's General Plan requirements. Letter to you from Mr. Don MacAllister (Past Mayor) stating his reversal of position regarding the Alley Vacation. After reviewing the facts, Mr. MacAllister agrees that the Alley Vacation is"the right thing to do". 2. Letter from Planning Commissioner Mr. Ed Laird. Mr. Laird has supported this Alley Vacation from the time it was introduced to the Planning Commission by Staff. 3. Letter to Wayne Melquist, offering an easement, to allow him the use of the alley in order to turn his motor home. This would be a legal document duly notarized and filed with the proper agencies once the Alley Vacation is approved. 4. Letter from Mr. Bill Nicely. Mr. Nicely lives at 422 Loma located on the subject block. Mr. Nicely has met with us to discuss our plans for the alley. Upon realizing that we plan to landscape the alley (approximately 60%-701/o) and to renovate,the other portion, he has thrown full support to our efforts. 5. Signed petitions with 44 neighbors, all supporting the Alley Vacation. 39 of the neighbors are property owners, and 43 are of voting age. When we first presented this petition to Council on October 4, 1999, the petition contained 29 names, and was instrumental in getting Council to allow us a Public Hearing. I hope that you have received a call from Ms. Connie Mandic, Planning Commissioner, regarding this Alley Vacation. Ms. Mandic was the only opposition in a 6 to 1 vote to approve the Request for Alley Vacation. There are no other garages off this alley besides these two residences. The alley does extend from Park Street to a north-south alley that connects to Adams Avenue and Loma Avenue. There are residences that have garages accessing the north-south alley. These residences will no longer have access to Park Street. The alley vacation will not have an adverse impact to these residences because they will still have two points of ingress and egress (Adams Avenue and Loma Avenue). This is consistent with other residential blocks of this size in Huntington Beach. Pedestrians currently use this segment of the alley. The alley is in close proximity to Huntington Beach High School, fhe property owners indicate that the students have been damaging their property along with the alley and that in general, are disrupting their peace and quality of life Vacation of the alley would preclude pedestrian and vehicular access from Park Street to the north-south alley. This would not create a negative impact to pedestrian access in the area. We are very aware of your concerns to have access to part of the alley which is located across from your driveway,to provide you with the turning radius necessary for your motor home. This access is needed for you to maneuver your motor home in and out of your private parking place located on your property. Since approximately early 1989 when Lynn and Jeanine Carlson and I,Frank Kurisu first mentioned our intention to you to ask the City to vacate this alley you have offered your concern regarding the ability to maneuver your motor home. In light of your situation we would like to offer this proposal as a means to alleviate your concerns regarding your ability to maneuver your motor home in and out of your private parking area. As you are aware we must have access to our garages which do not front the alley that runs parallel to Main Street. Our garages face the alley which we are asking the city to vacate. The portion of the alley that will be maintained also is the portion that you need to maneuver your motor home. This information should be of interest to you as it addresses your concerns regarding our asking the City to vacate the alley. In order to insure that you have the access to the turning area we are willing to issue you an easement to the alley in the event that the City Council,passes our Alley Vacation. Dan has referred me to you saying that your Department would be the first step in having the City vacate this alley. The alley comes off of Park Street, runs between my property and :ny neighbor' s property and terminates at another alley which runs parallel to Main Street. The alley is not vse by the refuse collection or any other City Services as far as we know. It is used for access to parking garages for both myself and my neiahbcr. Lately we have experience an increase in cars and people cruising the allevs . Besides the increase in dust and noise, we have had graffiti put on our walls and garage doors, found items that lead us to believe that soneone is using shrubbery next to the alley for a habitat, and the use of illicit drugs . Also because the bedrooms in my home are next to the alley we have had people trying 'Co look into bedroom windows . My neighbors, Lynn and Jeanine Carlson, and I are interested in taking ever the alley. We would remove the access from Park Street and install landscaping. The ac;:ess from the alley parallel to 'Main Street would remain. allowing us to access our garages . Later we would consider installing a gate to prevent unauthorized access to our garages . would appreciate your efforts to start the ball rolling to have the City vacate this alley.
