[xj Yes [ ] New Policy or Exception Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: Statement of TRR77P_ Chapter 721 of the Harbors and Navigation Code precludes the Department of Boating and Waterways from'Making loans to cities for the construction of boating facilities unless the city has held a public hearing on the feasibility of a private concessionaire or lessee constructing and operating the proposed project under a,contract with the applicable public agency. Recommendation: Conduct the required public hearing as described above. Analysis For some time, the city has been pursuing a loan from the Department -of Boating and Waterways for the construction of the proposed Seabridge Marina complex. The application process cannot be completed unless a public hearing such as that described above is first conducted. The continuation of the application process will require the Council to determine private construction of the project infeasible. Funding Source: None. Determination only. Under existing law, the Department of Boating and Waterways is authorized, under prescribed conditions, to make loans to cities, - - _ counties, and districts having the power to acquire, construct; and operate small craft harbors, for the planning, acquisition, construction, improvement, maintenance, or operation'of small craft harbors and facilities in connection therewith. Thus bill would direct the department to encourage cities, counties, - -- and districts that propose to apply for initial loan funding for new small craft harbor development projects to. communicate and to work with private enterprise in order to determine .if private business could construct and operate - the project's revenue producing facilities under fair and reasonable terms. - - - The bill would prohibit the making of a loan to a local public entity for the initial phase of a new small craft harbor project. for those - _._.._____. project facilities that produce revenues,em��i4t� _......._. _._._ The people of the State of California do enact as follows: SECTION 1. Section 71.5 is Aded to the Harbors and Navigation Code, to read: - - - 71.5. (a) The department shall encourage cities, counties, and --_ - --- districts that propose to apply for initial loan funding for new small craft harbor development projects pursuant to Section 71A to communicate and to work with private enterprise in order to etermine if private business could construct and operate the projects' revenue producing facilities under fair and reasonable --- terms. (b) No loan shall be made for the initial phase of new small craft harbor projects pursuant to Section 71.4 for those project facilities that produce revenues, unless the city, county, or district applying for the loan has held a public hearing on the feasibility of a private 1 -�— cessionaire or essee constructing and operating th cone proposed - - project under a contract with the� applicable -public agency.
