SYNOPSIS
Ordinance No. 3320 amends the Huntington Beach Municipal Code by amending Chapter 12.12 by
adding Sections 12.12.030 and 12.12.035 to read as follows:
12.12.030 Setting Time Restrictions. A reasonable time for construction shall be established by the
Director of Public Works, prior to issuance of a permit to close any roadway. Upon written request from
the permittee,the established time period may be extended by the Director of Public Works to account
for working days lost due to circumstances beyond the control of the permittee.
12.12.035 Penalty for Exceeding Time Restrictions. A penalty shall be imposed upon any private
party permittee who does not complete the work requiring road or lane closures within the established
time frame. The fee shall be in an amount set by resolution of the City Council and shall be based upon
estimated costs to the traveling public due to delays and additional travel distance around roadway
closures.
This Ordinance shall take effect thirty days after its passage.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH AMENDING RESOLUTION NO. 5159
ENTITLED, "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ESTABLISHING A CITY FEE SCHEDULE"
AS TO PENALTY FOR CLOSURE OF ROADWAYS
(SUPPLEMENTAL FEE RESOLUTION NO. 58
WHEREAS, on October 4, 1982, the City Council adopted Resolution No. 5159
establishing a fee schedule for the city; and
The City Council desires to establish new fees and change existing fees charged to
the public for city services, facilities and activities, and inconveniences caused to the public;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach that Resolution No. 5159 is hereby amended to incorporate the changes set forth in
Exhibit"A" attached hereto and by this reference made a part hereof; and
BE IT FURTHER RESOLVED that the fee additions and amendments set out in this
Supplemental Fee Resolution No. 58 shall be effective March 6,
19 96 , and continue during the fiscal year 1995/1996 and thereafter; and
BE IT FURTHER RESOLVED that except as amended herein, the fees contained in
Resolution No. 5159, as amended, shall remain in full force and effect.

"Roadway Closure Penalty"
1. Applicable to complete or partial closure of roadways.
2. Fee basis = $800.00 per lane per calendar day, for the period beyond the
established time period described below. The penalty basis shall be
proportioned for fractional day closures.
3. A reasonable time for construction shall be established by the Director of
Public Works, prior to issuance of a permit to close any roadway, and no
penalty shall be assessed for that established time period.
4. Upon written request from the permittee, the established time period may
be extended by the Director of Public Works to account for working days
lost due to circumstances beyond the control of the permittee, as
determined appropriate by the Director of Public Works in accordance with
Subsection 6-6 "Delays And Extensions Of Time" of the Standard
Specifications For Public Works Construction, current edition, and no

Statement of Issue: The Transportation Commission has requested that a penalty be
imposed upon permitees for roadway closures which exceed predetermined, reasonable
time allowances for street construction work. A penalty of $800 per lane, per day was
recommended.

Analysis:
Background - The Transportation Commission has recommended that a penalty be imposed
on private party permitees who do not complete work requiring road or lane closures within
the agreed or permitted time frame. The purpose of the proposed penalty would be to
provide an incentive to complete construction work in a timely manner, and to minimize
inconvenience to the traveling public. The specific recommendations of the Transportation
Commission were as follows:
1. Permitees should not be penalized for delays caused by circumstances beyond their
control.
2. The penalty should be based upon estimated costs to the traveling public due to delays
and additional travel distance around closures.
3. Reasonable time should be allowed for construction work, before imposition of a
penalty.
Construction contracts administered by the Public Works Department typically include
'liquidated damages" for unjustified construction delays. The methodology used for
calculating the proposed penalty amount is the same as that used for determining 'liquidated
damages'; and is outlined below. The Transportation Commission recommended that the
calculated penalty amount of $1,625 per day per lane be reduced to $800 per day per lane.
Staff supports the Transportation Commission recommendation.
Penalty Calculation
Assumptions and Definitions:
1. Signing and delineation is adequate to avoid increased risk of accidents, and to
allow efficient detouring.
2. Based on traffic volume data in the City of Huntington Beach, Traffic Engineering
feels that the minimum average number of vehicles (two-way traffic) on any
arterial street segment is 5000 vehicles per day. With balanced travel demand
an average roadway volume of 2,500 vehicles per day in one direction can be
expected. With two lanes present in each direction of travel, the detoured
volume = 1,250 vehicles per day per lane.
3. Detour distance is that extra distance traveled to get from the point of origin to
the point of destination. On the average, points of origin and destination will be
somewhere between the half mile arterial links. The detour distance, then, will
vary from 1/2 mile to 1-1/2 miles. For this analysis, it is assumed that the average
detour distance = 1 mile.

4. Travel cost is $30.00 per hour (value of time per ITE Mobility Facts, 1992), plus a
vehicle cost of $0.30 per mile. With an assumed, average travel time of 0.033
hours per mile (30 mph avg travel speed), the travel cost is (0.033 hr per mi x
$30.00 per hr) + $0.30 per mi = $1.30 per mi.
Closure Cost:
1,250 vehicles per day per lane x 1 mile per vehicle x $1.30 per mile = $1,625.00 per
lane per day. The cost of a complete closure of a four lane arterial would then be
$6,500.00 per day. The Transportation Commission recommended that the penalty be
reduced to 50% of the calculated amount, in which case the closure penalty would be
$800 per lane per day. For a four lane roadway the penalty would then be $3,200 per
day.
Environmental Status: The recommended action is not a project"as defined by State
CEQA Guidelines, Cal. Admin Code, §15378, nor as defined by the California Environmental
Quality Act, Cal. Pub Res Code, § 21065. Therefore, the recommended action is not subject
to provisions of CEQA.

Statement of Issue: The State Government Code requires cities to announce, at a
regular public meeting, plans to hold a public hearing for the purpose of receiving input on
proposed assessments. This action is not a public hearing; it is an announcement of
plans to hold a public hearing. A public hearing is scheduled for Tuesday,
"/January 16th 1996, to receive public input on the proposed Street Closure Penalty.
Funding Source: Not applicable.
Recommended Action: Approve the following announcement of the plan to establish a
Street Closure Penalty.
Notice is hereby given that a public hearing will be held by the City Council of the City of
Huntington Beach, in the Council Chambers of the Civic Center, Huntington Beach, at the
hour of 6:30 PM, or as soon thereafter as possible on Tuesday,1 the .16thof January, 1996, '
for the purpose of establishing a Street Closure Penalty.
The City is proposing the following: A penalty of $800 per lane, per day, for lane closures

ADDING SECTIONS 12.12.030 AND 12.12.035 PERTAINING TO STREET CLOSURE
'The City Council of the City of Huntington Beach does ordain as follows:
SECTION 1. That Chapter 12.12 of the Huntington Beach Municipal Code is hereby
amended by adding Sections 12.12-.030 and 12.12.035, said Sections to read as follows:
12.12.030 Setting Time Restrictions. A reasonable time for construction shall be
established by the Director of Public Works, prior to issuance of a permit to close any roadway.
Upon written request from the permittee, the established time period may be extended by the
Director of Public Works to account for working days lost due to circumstances beyond the
control of the permittee.
12._12.035 Penalty for Exceeding Time Restrictions. A penalty shall be imposed
upon any private party permittee who does not complete the work requiring road or lane
closures within the established time frame. The fee shall be in an amount set by resolution of
the City Council and shall be based upon estimated costs to the traveling public due to delays
and additional travel distance around roadway closures.
SECTION 2. This ordinance shall take effect 30 days after its adoption.

12.12.010 Erecting utility structures--Authority. It is unlawful for any person,without a franchise
or other authority from the council,to erect any telegraph,telephone, electric light or transmission
poles on any walls, street, alley or public place in this city, or to stretch any wires along or across
said streets; or to lay any gas, oil or water pipes, or other pipelines along.or across any streets in
the city. (19-7/09, 292-1/27)
12.12.020 Obstructing public wav—Permit required. It is unlawful for any person to obstruct any
street,alley, sidewalk or public place within this city by placing thereon or therein any building,
stand, counter, lunch wagon, wagon stand,bandstand, structure,building material,gravel, dirt,
excavation or obstruction of any kind whatsoever,without a permit having first been issued
therefor as hereinafter provided. (19-7/09)
12.12.030 Setting Time Restrictions. A reasonable time for construction

12.12.050 Construction work--Permit required. Any person, firm or corporation desiring to
engage in any trade or business or to move or construct a building,make repairs or to perform any
other work by which it may become necessary to place any such building, stand, counter, lunch
wagon,wagon stand, bandstand, structure,building material,gravel, dirt, excavation or other
construction upon or in the streets, alleys, sidewalks or public places within this city, must first
obtain a permit from the Director of Public Works to place any obstruction as hereinabove
mentioned upon or in said streets, alleys, sidewalks or public places. (19-7/09, 577-2/52,

12.12.060 Construction work—Permit--Fees. The Director of Public Works may issue such
permit upon payment of a fee, set by resolution of the City Council,to the city therefor. (12-7/09,
577-2/52, 2308-10/78, 2442-8/80).
12.12.070 Permit--Franchise holder. In the event the person, firm or corporation making such
application is the owner or holder of a franchise or reservation of interest in said street, alley,
sidewalk or public place to keep or maintain any pipeline,telephone line, or pole system in or upon
any of the public streets, alleys, sidewalks or public places if said excavation is for the purpose of
connecting with sewer, water or gas pipeline by such person,then and in that event,the application
and permit may be granted without charge. (19-7/09, 5-77-2/52)
12.12.080 Violation--Nuisance. Any person, firm or corporation who violates any of the
provisions of this chapter is guilty of a MISDEMEANOR,and the obstruction so maintained shall
be deemed to be a public nuisance and be treated as such. (19-7/09)
12.12.090 Construction work--Licensed contractor required. No work of any kind shall be done
or performed upon any street, sidewalk, alley, curb, sewer or gutter in the city unless done
according to state of California department of transportation specifications and city standard plans
and by a contractor licensed by the state of California to perform that class of work. (745-2/60,

12.12.100 Construction work--Contractor obtains permit. Before any work mentioned in section
12.12.090 may be commenced,the contractor doing such work must obtain a pen-nit to do such
work. (745-2/60)
12.12.110 Permit issuance. The Director of Public Works may issue such permit upon payment
of a fee set by resolution of the City Council, or a sum calculated upon a schedule set by resolution
of the City Council. (19-7/09, 577-2/52, 2022-1/76, 2308-10/78, 2442-8/80)
12.12.120 Construction work--Supervision and inspection. The work shall be done then under the
inspection and supervision of the Director of Public Works of the city, and he shall have and is
granted authority to prevent the performance or doing of any of said work mentioned in section
12.12.090 unless the work is done in accordance with the provisions of this chapter. (745-2/60,

12.12.130 Construction work--Permit denial--Appeal. In the event the Director of Public Works
refuses for any reason to issue a permit,the applicant may petition the City Council, in writing, for
a hearing to consider said request. (745-2/60, 2308-10/78)
12.12.140 Traffic delineation. Any person, firm, or corporation that causes a change in street
access, physical characteristics or a change to or obliteration of existing traffic delineation devices,
due to private development shall be required to install new traffic delineation devices to include

painted stripes or lines, raised pavement markings or legends as required. This work shall be
accomplished in the following manner:
(a) General Requirements:
(1) All work shall be done in accordance with City of Huntington Beach requirements and
State of California Department of Transportation standards for location and dimensions.
(2) Paint shall be one base coat and one finish coat with reflective beads of the material
specifications approved by the Department of Public Works.
(3) Work shall conform to the plans approved by the Department of Public Works.
(4) All conflicting, existing markings shall be removed by sandblasting and the street shall be
swept.
(5) All required traffic barricades and cones shall be provided and maintained until the
delineations are complete.
(b) Work by city. If the project involves less than one thousand(1000) linear feet of delineation
work,the responsible agency may either perform the work or pay the Department of Public
Works to have this work done by city personnel. Barricading and coning shall be the
developer's responsibility until the city's public works paint section personnel complete the new
traffic delineations. If the city is to perform the work,the cost of this work shall be paid in
advance and be based on the unit costs established-by resolution of the City Council, copies of
which shall be available in the Department of Public Works. (2042-4/76)
12,12.150 Public liability insurance. The applicant shall furnish to-the city andf maintain during
the period for which the permit is issued, a public liability insurance policy in which the City, City
Council,elective and appointive officers, employees,boards and commissions of the city shall be
named as additional insureds when acting within the scope of their official duties, against all claims
arising.out of or in connection with the activities for which the permit was obtained. Such public
liability,insurance policy shall indemnify, defend and hold harmless said-additional insureds. The
policy shall provide for not less the following amounts:
Combined single limit bodily in ua and/or property damage including products liability:
$300,000 combined single limit per occurrence. (2121-12176)
