A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE VACATION OF
A . PORTION OF DELAWARE STREET NORTH OF DETROIT
AVENUE ;
WHEREAS, on June 11, 1984 the City Council of the City of
Huntington Beach duly adopted Resolution No. 5381 declaring
its intention to vacate a portion or Delaware Street north of
Detroit Avenue , and referring to maps or plaris on file In the
office of the City Clerk for partJculars as to the proposed va-
cation; and
Said resolution fixed the time and place of July 2 , 1984
at the hour of r : 30 p.m. , or as soon t .iefreafter as the
natter could be heard, in the Council Chambers in the Civic
Center, for hearing all persons interested in or objecting to

.9 the proposed vacation , which time was no' less than fifteen
(15 ) Ways from the passage of said resolution. Notices of the
proposed vacation were ported conspicuously along that portion
of Delaware Street proposed to be vacated, and such notices
were posted riot more than three hundred ( 300 ) feet apavt and at

The City Council of the City of Huntington Beach doer
hereby resolve as follows :
SECTION 1. A public meeting was held before the Planning
Commission on May 1, 1984 at which time it was determined, pur—
suant to 0over•nment Code section 65402 , that the prorosed vaca—
tion of a portion of Delaware Street north of Detroit Avenue
conformed to the city ' s general plan.
SECTION 2. Pursuant to Division 9, Part 3 , Chapter 2 of
the California Streets and Highways Code (sections 8320 et seq. ) ,
the City Council of the City of Huntington Beach hereby declares
its intention fo vacate a portion of Delaware Street north of
Detroit Avenue more particularly described as follows :

SECTION 6. The Director of Public Works is directed 'to post,
or cause to be posted, notices of vacation conspicuously along that
portion of Delaware Street proposed to be vacated at least two'-
weeks before t-hr, * ;late of the hearing. The notices shall be
posted not more than 300 feet apart , but at least three notices
shall be posted. The notices shall state the day, hour, and
place of hearing and shall refer to the adoption of this resolu-
tion of intention, and shall describe that portion of Delaware
Street; proposed to be vacated, or shall include a map or plan
showing the location of the proposed vacation.

On June 4 , 1984 , the City Council adopted Resolution No. 5381 declaring
the intention to vacate said easement and setting the required public
hearing for July 2, 1984 . Final Council approval, after the public
hearing, is required to complete the legal process .

STATEMENT.'OF ISSUE:
The EngineeriFig Division is requesting the vacaticn •of an ~mused portion
of street right-of-way on Delaware Street east of Detroit Avenue.
RECOMMENDATION:
Adopt the attached resolution of intent to vacate the right-of way and `
schedule the required public hearing for July 2, 1984 .
ANALYSIS:
A portion of street right--of-way eLcquired by the City for the widening
of Delaware Street was not needed? when the project was completed ' in
1983 . It should be vacated to th*e owners in fee. Thin would restore
the property to the tax rolls and relieve the City of maintenance
responsibility.
The Planning Commission, on May 1, 1984 , found the vacation of this
right-of-play to be in conformance with the City' s General Plan. A
Public Works staff revi0w has determined that the property is of no
further use to the City for street purposes.
FUNDING SOURCE:
None. No funds necessary.
ALTERNATIVE ACTION:
Deny the request and retain the right-of-way.

City :Council of the City of Huntington Beach of Intention to Vacate
a Portion of Delaware Street North of Detroit Avenue. "
That after the adoption of said Resolution, he posted conspicu-
ously along the street and property described in said Resolution
notices of the adoption of said Resolution and headed, . "Notice of
Street Vacation, " one of which notices, similar to the notice he
posted as aforesaid, is annexed hereto and made part hereof.
