A RESOLUTION OF THE CITY COUNCIL OF THE •01.`rY
OF HUNTINGTON BEACH ORDERING THE VACATION OF
A PORTION OF KNOXVILLE AVENUE

WHEREAS , on July B . 1980 the City Council of the City of
Huntington Benoh duly adopted Resolution No . 4901 declaring
i -s intention to vacate a portion of Knoxville Avenue ,
and referring to maps or plans on file in the office of the
City Clerk for particulars as to the proposed vacation; and
Said rec;olution fixed the time and plate of August 4. 1980
a t the hour of 7: 30 p .ni . , or as soon thereafte r as the
matter could be heard , in the Council Chambers in the Civic
Center , for hearing all persona interested in or objecting to
the proposed vacation, which time was not less than fifteen
( 15 ) days frog the paasaEt~ ::i' said retrolution. Notices of the
proposed vacation Were posited cont3picuously along that portion

present or prospective public street purposes , and is not suitable
Tor use or developman t as bicycle paths or routes, fnd It is hereby
ORDERED that a portion of Knoxville Avenue be and the same is,
i hereby vacated; and said portion of Knoxville Avenue so vacated is
more particularly described as follows:
Beginning at the southeast corner of Block 908
of Huntington Beach, Wesley Park Section, as shown
on a map recorded in Book 4 , page 17, Miscellaneous i
Maps, Records of Oranre County; thence south 60. 00
feet, along the westerly right-of-way line or the
Southern Pacific Rallvoad as shorn on said map to a
point, said point being the Northeast corner of

A 'RESOLUTION GF THE CITY COUNCIL OFF THE CITY
OF HUNTINGxTON BEACH OF !NTENTION TO VACATE A
PORTION OF KNOXVILLE AVENUE
The City Council of the City off' Huntington Beach does
hereby resolve ace follows:
SECTION 1 . A public meeting was held before the Planning
Commission on June 5, 1979 at which time it Has determined,
pursuant to Goverruneat Code Section 65402, that the proposed
vacation of a portion of Knoxville Avenue conformed to the city ' s
general plan .
SECTION 2 . Pursuant to Division 9 , Part 3 , Chapter 2 of
the Califurljaa oLreeta and Hibhwsayb Code (Sections 8320 et seq .) ,
the City Council of the city of Huntington Beach hereby declares
its intention to vacate a portion of Knoxville Avenue more par-
ticularly described an follows: '

SECTION 4 . The City Council does hereby fix August 4 , 1980 '
at the hour of 7: 30 p.m. , or as soon thereafter as the matter
may be heard in Council Chambers in the Civic Center, as the
time and place for hearing all persons interested in or objecting
to the proposed vacation , which time is not less than fifteen

SECTION 5 . The City Clerk is directed to cause a copy of
this resolution to be published in the Huntington Beach
Independent, a newspaper of general circulation, within fifteen
(15) days of the passage of thi 3 resolution. j
SECTION 6 . The Street Superintendent is directed to post ,
or cause to be posted, notices of vacation conspicuously along
that portion of Knoxville Avenue proposed to be vacated at least
ten (10 ) days before the date of the hearing. Such notices shall
be posted riot more than three hundred ( 300 ) feet apart , but at
l eac t three (3 ) shall be posted . Such notices bhall state the
passage of this resolution of intention and the time and place
j of hearing.

PWLIC HEARING - VACATION - PORTION OF YNOXVILLE AVE - APPROVED - RES NO 4909 - ADOPTED
The Mayor announced that this was the day and hour set for a public hearing pursuant
to Resolution of Intent 4901, to vacAte a portion of Knoxville Avenue as a condition
of approval for Tract 10719.
The Clerk presented the Affidavit of Posting Notices of heed Abatement ::barges as
svorn to by Paul Cook, Street Superintendent.
The City Clerk stated that all legal requirements for n,)tification, publication and j
posting had been met, and that she had received a comaunication from the Southern
California Gas Company requesting an easement be reserved.
Hayor Bailey declared the hearing open.
There belng no or, present to speak on the clatter and there being no protests filed,,
either oral or written, the hearing was closed by the Mayor.
The City Clerk presented Resolution No. 4909 for Council Is considcration "A RESCLUTIO4

Statement of Issue:
The Planning Commission imposed the subject street vacation as a condition
of, approval for Tract 10719.
Recommended Action:
Approve the attached resolution to vacate a portion of Knoxville Avenue.
Analysis :
The .Planning Commission a ;roe►ems' Tentative Tract 10719 on June 5 , 1979
and imposed a condition that a portion of Knoxville Avenue be vacated .
The City Council approved the Map of 'Tract 10719 on February 4 , 1980 ,
further necessitating Ow v►-wati-on. Construction ha:; coitln tenced on the
site and the strcot vacation should now be completed .

Statement of Issue
The Planning Commission imposed the subject street vacation as a condition
of approval for Tract 10719 .
Recommended Action:
Approve the attached resolution of intent to vacate a portion of Knoxville
Avenue and schedule the required public hearing.
Analysis:
The Planning Commission approved Tentative Tract 107119 on June 5 , 1979 and
imposed a condition that a portion of Knoxville Ave . be vacated . The City
Council approved the Map of Tract 10719 on February 4 , 1980 , further neces-
sitating the vacation. Construction has commenced on the site and the
street vacation should now be completed .

OF:HUNTINQTON BEACH OF .INTENTION TO VACATE A
PORTION OF KNC XVILLE AVENUE ;
The City Council of the City of Huntington Beach does
hereby resolve as follows:
SECTION 1 . A public meeting was held before, the Plan?jig
Commission on Juhe 5 , , 1979 at which time it was determined,
i pursuant to 06vernment Code Section 65402, that the proposed
vacation of a portion of Knoxville Avenue conformed to the city' s

general plan .
SECTION 2 ., Pursuant to Division 9 , Part 3 , ' Chapter 2 of
!, the California Streets and `Highways Code (Sections 8320 et seq .) ,
't the City Council of the City of ;Huntington Beach hereby, declares
its intention to vacate a portion of Knoxville Avenue more par--
ticularly described as follows:
Beginning at the southeast corner of Block 908
` of Huntington Beach , Wesley Park Section, as shown

on a map recorded in Book 4 , page 17 , Miscellaneous
Maps , Records of Orange County; thence south 60 .00
feet along the westerly right--of--way line of the.
Southern Pacific Railroad as shown on said map to a
point, said point being the northeast corner of
Block 804 of said map; thence west 132 . 10 feet
along the north line of said Block 804 to the- north-
west corner of said Block 804 ; thence north 60 .00
feet along the prolongation of the westerly line of
said Block 804 to a point, said point being the
southwest corner of said Block 908 ; thence east
132. 10 feet along the southerly line of said
Block 908 to the point of beginning.
SECTION 3 . The City Clerk is directed to maintain on file t j

Subject: Resolution No.4901
Thank you for notifying us in regard to the proposed vacation of a portion
of Knoxville Avenue east of Lake Street.
According to our records, we have plans to install a 2 inch gas main itt the
alley as shown on recorded tract map 10809, and have obtained an easement
to that effect from the owners. At the time we obtained that easement,
Knoxville Avenue was still a dedicated street, and we did not obtain an
easement over that portion of the street.
However, when the proposed vacation is finalized, we would like an easement
reserved over the easterly 20 feet of Knoxville: Avenue at the East boundary
line of Tract 10809 as indicated on the attached prints. He would also i
like to receive a copy of the recorded resolution.
