Dale Bush City Attorney City of Huntington Beach' 312 Walnut Huntington Beach, California Re: Proposed vacation of Algonquin St. (old) near intersection of Warner Avenue and Algonquin St. , Huntington Beach, California a Dear Mr. Bush: Reference should be made to prior correspondence in ' connection with the referenced matter. You will recall that this office represents Mr. Lee Martin, the owner of real property contiguous to Algonquin Street (old) which property is immediately West of the intersection of Warner and Algonquin (new). We under- stand that your,office prepared a resolution of intention to vacate Algonquin Street (old), which street is physically existing and lies between our client's property and the property owned by Huntington Harbour Corporation. We think that said proposed resolution is entirely proper and urge that your City Council pass the same since this street is unnecessary for present or prospective public street purposes. We are concerned with the written request of Huntington Harbour Corporation contained in their letter to Doyle Miller, dated November 14, 1966, objecting to the proposed vacation and requesting that tree vacation be shoved East 20 feet, Since this matter was continued from January 3 meeting to this evening's meeting, we would like you to have our views of this matter and hope that you agree with the same. As you know, the subject matter of that which may be vacated must be basically a "public street. " Section 8304 Streets and Highways Code. Obviously, no portion of our client's property is a public street. In fact, a prior condemnation action ostensibly for public street purposes was abandoned and dismissed by the City, which action sought to condemn our client's property for street purposes. (City of Huntington Beach vs. Freeman, et al. , Orange Cty. Sup. Ct. No. 1241 3 . -2- It would seem to me that the sole question as to whether the resolution you presented. is proper would be whether or not the actual street is unnecessary for present or prospective public street purposes. under Section 8323 of the Streets and Highways Code. We think that it is. Certainly vacation proceedings must be for the public convenience and necessity and not for the sole use and benefit of private individuals or corporations. People vs. City of Los Angeles, 62 Cal. App. 781, 218 Pacific 63. See also Bowles vs. Antonatti, 50 Cal. Rptr. 370, 241 A. C.A. 336. In People v. City of Los Angeles,—supra, the Court declared the ordinance of the City Council vacating a street void because their action was unreasonable and arbitrary and incidentally, contrary to the advice of the City Engineer. We think beyond question that the City Council's action would be arbitrary and unreasonable and therefore void if it were to comply with the request made by Huntington Harbour. Huntington Harbour Corporation would be opposed to this vacation unless the proposed street serving our Tract 5633 could be shifted easterly twenty feet to utilize this vacated area.
