A14D GIVING NOTICE OF HEARING ON SAID VACATION.
WIDLE,A8, there nart exists a parcel of land, known as Circle Park,
'dedicated by the Wesley Park Tract Map and a parcel of land, known as
Farquhar Plaza, dedicated to the City by a deed for park purposes; and
WHE1i.FAS, these two park sites are separated by a portion of Crest
Avenue; and
WHEREAS, the City Council, on February a, 1968, did approve a
water plan for the redesign of the Lake Park Complex, which indicated the
r _... .: uniting of the two park sites mentioned above; and
WHEREAS, the City Council of the: City of Huntington Beach desires
to vacate that portion of Crest Avenue hereinafter described,
NOW THEREFORE, the City Council of the City of Huntington Beach,
California, does resolve, determine, stipulate, and declare as follows:
Section 1. The City Council of the City of Huntington Beach does
hereby declare its intention to vacate that certain portion of Crest Avenue
described as follows:
Beginning at the center point of the Park, circular in shape, as
shown on the map of Wesley Park Section as recorded in Hook 4, Page 17, of
Miscellaneous Maps, R�,cordx of Orange County, California; said Park situated
of the intersection of Twelfth Street and Crest Avenues thence north 29'
23' 11" east, along a radial lire passing through said center point; 105.00
feet t;, i point lying in the property line of said circular par'A, said
point being the True Point of Beginning of this de.%criptlun; thence north-
easterly along a tangent curve., concave to the north, a radial line passing
through said last mentioned point beAr,a soijth 29' 23' 11" west, and said
curve having a radius of 75.00 feet, 102.27 fret through an angle of 76'
07' 37" to a point; thence northeasterly along a tangent curve, concave
to the south, a radial line passing through grid last mentioned point bears
north 48' 441 26' treat, and said curve having a radius of 264.00 fret,
16.60 feet through an a.tgle of 3' 351 52" to a point, said point lying in
the southerly property line of Twelfth Street as ahcrin on a map of Tract

and said curve haying a radius of 180.00 feet, 243.27 feet (along the

Section 2. That notice is herby given that the 3rd day of June,
1968, at the hour of 700 P.M. or as soon thereafter as possible, in the
Council Chambers of the City Hall, Huntington Beach, California, is the time
and place when rnd where a public hearing shall be held upon said Resolution
of Intention to vacate the above described easement, at which hearing all
persons interested in or objecting to the proposed vacation may be heard.
Settion 3. The City Clerk is hereby authorized and directed to
cause a copy of this Resolution of Intention to be published in the Hunting-
ton Beach News, c newspaper of general circulation, printed and published
in the City of Huntington Beach, by two insertions prior to the hearing as
set forth in Section 2 hereof.
Section 4. The City Council of the City of Huntington beach in
vacating the above easement does elect to proceed under the previsions of
the Street Vacation Act of 1941 , Division 1), Part 3, of the: Streets and
Highway Code of the State of California .
Sectiion �5. The Street Superfntcndcn: is hereby authorized and
directed to post the notice of tht eastment. vacation an required by lcv.

JAMES R. WHEELER, being duly sworn deposes and sayss
That he Is now and was during all the times mentioned the duly
appointed, qualified and acting Street Superintendent of the City of
Huntington Beach, in said County and State.
That on the,.6tb day of May, 1968, the City Council of said City f
passed its Resolution of Intention No. 2742, "A Resolution of Intention
of the City Council of the City of Huntington Beach, California to
Vacnte a Portion of Crest Avenue in said City, and giving notice-of
hearing on said vacation."
That after adoption of said Resolution he posted conspicuously
along the street and property described it said Resolution, notices,
of the adoption of said Resolution and headed "Notice of Hearing Street
Vacation" one of which notices, similar to the notice posted as afore-
saiid is annexed hereto and made a part hereofs
That he completed all the posting of said notices on the 22nd

to. vacate. Said portion of Crest . Avenue lies between a parcel of ►
land. known as Circle Park and a parcel of land known ass Farquhar
Plant.
#ox, therefore, . the vacation of this p.ortion of Creet`.A,venue will '+
eliminate. the area used for parking of oa:'rs b,T visitors .!to*,,the:--
park at the present tine, . and. will elitalnate the, graceful format
of the park and increase traffic on Eleventh Street and Twelfth
Street between Crest Avenue and fain Streit.
Whereas, the above nuitered , Resolution required that the Street
Superintendent post the property as required by lawn and ,give
notice . of the easement vacation.
Now whereas, none of the undersigned property owners within 350
feet of the proposed easement vacation have received a notice of
said vacation and none of us,,have seen any notice. posted on the
property, we are of the opinion that the proceedings regarding
this street vacation are illegal and we respectfully ask that,
you rescind your action.
Now whereas, if the City of Huntington Beach has money to spend
on park development, we feel that it would be more logical for
them to spend it in areas that have more density of population
and do not have parks at this time,
