A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING ,THE VACATION OF
A PORTION OF DELAWARE STREET NORTH OF DETROIT
AVENUE
WHEREAS, on .iune 4 , 1984 the City Council of the City of
Huntington Beach duly adopted Resolution No. 5381 declaring
its inter ion to vacate a portion of Delaware Street north of
Detroit Avenue , tend referring to maps or plans on file in the
o."fice of the City Clerk for particulars as to the proposed va—
cation; and
Said resolution fixed the time and place of July 2, 1984
at the hour of 7 : 30 p.m. , or as soon trpreafter as the
matter could be heard , in the Council Cbarabers in the Civic
Center, for hearing all persons interested in or objecting to
the proposed vacation, which time was not less than fifteen
III (15) days fron the passage of said resolution. Notices of the
proposed vacat-on were posted conspicuously along that portion
of Delaware Street proposed to be vacated , and such notices
were posted not more than three hundred ( 300 ) fe•t apart and at
least three (3 ) were posted .
On July 2 , 1984 at the hour of 7 : 30 p .m. , in the Council
chambers in the Civic Center , the City Council of the City of
Muntington Beach did convene foil the purpose of hearing all
persons interested in or objecting to the proposed vacation of
a portion of Delaware Street , at which time no obtcction was
made to said vacation , and evidence was presented showing that
that portion of Delaware Street proposed to be vacated is not
necessary for present and prospective public street purposes and
is not suitable for use or development as a bicycle path or
route .

. NOW, THEREFORE, the City Council of the City of Huntington
Beach, pursuant to Division 9, Part 3, Chapter 2 of the ' Calif ornia
Streets and Highways Code, commencing with section 8320, 'doels

resolve that a portion of Delaware Street north Detroit " Avenue
is not necessary for present or prospective public street pur-
poses, and is not suitable for use or development as a bicycle-
path or route, and it is hereby
ORDERED that a portion of Delaware Street be and the same
is hereby vacated; and said portion of Delaware Street north of
Detroit Avenue so vacated is more particularly described as

That portion of Block 404 of "Vista del Mar
Tract" in the City of Huntington Beach,
County of Orange , State of'California as
shown on a map recorded in Book 4 , page 5
of Miscellaneous Maps in the office of *.he

tation or. distribution of electric energy , petroleum and its
products, ammonia, water, and incidental purposes , including
access and the right to keep the property free from inflammable
materials , and wood growth, and otherwise protect the same from

A RESOLUTION OF. THE CITY COUNCIL OF THE `CITY
'CIF HtJNTINGTON BEACH OF INTENTION TO VACATE A
PORTION OF DELAWARE STREET WORTH OF DETROIT
AVENUE
The City Council of the City of Huntington Beach does
hereby resolve as Follows :
SECTION 1. A public meeting was held before t~e Planning
Commission on May 1, 1984 at which time it was determined, pur-
suant to Government Code section 65402 , that the proposed vaca-
tion of a portion of Delaware Street north of Detroit Avenue
conformed to the city' s general plan.
SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of
the California Streets and Highways Code (sections 8320 et seq. ) ,
the City Council of the City of Huntington, Beach hereby declares
its intention to vacate a portion of Delaware Street north of
Detroit Avenue more particularly described as follows :
That portion of Block 404 of "Vista del Mar
Tract" in the City of Huntington Beach,
County of Orange , State of California as
shown on a map recorded in Book 4 , page 5
of Miscellaneous Maps in the office of the
County Recorder of said county described
as follows :

' and otherwise protect the same from all hazards in, upon and over
such street or part thereof proposed to be vacated.
The City Clerk is directed to maintain on file

In the office of the City Clerk maps or plans showing the par-
ticulars of the proposed vacation of a portion of Delaware Street
north of Detroit Avenue , and refe:•ence is hereby made to said
maps or plans for said particulars as to saki proposed vacation.
SECTION 4 . The City Council does hereby fix July 2, 1984
at the hour of 7 : 30 p.m. , or as soon thereafter as the matter
may be heard in Council Chambers in the Civic. Center, as the ki
time and place for hearing all persons interested in or ob-
jecting to the proposed vacation, which timo is not less than
fifteen ( 15) days from the passage of this r,:solution.
SECTION 5 . The City Clerk is directed to cause a copy of
this revolution to be published in a weekly newspaper, published
and circulated in Huntington Beach for at least twc successive

SECTION 6. The Director of Public Works Is directed to post,
or cause to be posted, notices; of vacation conspicuously along that
portion of Delaware Street proposed to be vacated at least two

shall be posted. The notices shall state the day, hour, and
place of hearing and shall refer to the adoption of this resolu—
tion of intention, and shall describe that portion of Delaware
Street proposed to be vacated or shall Include a ma or plan

Statement of Issue:
Council action is required in order to complete vacation proceedings
for a portion of street right--of-way on Delaware -;street, east of
Detroit Avenue.
Recommendation:
Adopt the attached resolution ordering vacation of said right--of-way.
Analysis :
on June 4 , 19R41 the City Council adopted Resolution No. 5381 declaring
the intention to vacate said easement and setting the required public
hearing for July 2, 1984 . Final Council approval, after the public
hearing, is required to complete the legal process.
Funding Source:
None; no funds required .

Deny the vacation and retain the easement.

RECOMMENDATION:

A portion of street right-of-way acquired by the City for, ihe ,widening
of Delaware Street was not needed when the project was completed in
1983 . 1t should be vacated to the owners in fee. This would '�restore
the property to the tax rolls and relieve the City of maintenance
responsibility.
The Planning Commission, on May 1, 1984 , found the vacation of this
right-of--way to be in conformance with the. City' s General Plan. A
Public Works staff review has determined that the property is of no
further use to the City for street purposes .
FUNDING SOURCE: ;
None. No funds necessary.
ALTERNATIVE ACTION:
Deny the request and retain the right-of-way.
