Hwttington Beach duly adapted Resolution No . 4878 declaring
its intentior., to vacate the excess street right-of-way on the
west side of Newland Street, north of Yorktown Avenue..
and referring to maps or plans on f..le in the office of the
City Clerk for particulars as to the proposed vacation; and
Said resolution fixed the time and puce of Jrly 79 1980

at the hour of 7: 30 p .m . , or as 6oun thereafter as the matter
could be heard, in the Council Chambers in the Civic Center,
for- hearing all per,cn& interested in or objecting to the pro-
posed vacation, which time was not less than fifteen (15 ) days
from the passage of said resolution. Notic«is of the proposed
vacation were posted conspicuously along the excess street
right-of-way on the west side of Newland Street , north of
Yorktown Avenue , and :such notices were posted riot more than
tht•c � t:undred ( 300 ) feet apart anU at least three ( 3 ) were posted.

NOW, THEREFORE, the City Council of the City of Huntington
Beach, . pursuant . to Division 9 , Part 3, Chapter 2 of the California
Streets and Highwaya Code,, commencing wish Section 8320, does
resolve that the excess streeb righz--o£--way on the west side of
Newland Street, north of Yorktown Avenue , is not nec,easary for
present or prospective public street purposes , and is not suit-
able for use or development as bicycle paths or router , and it

EXCESS- STREET RIGHT-OF-WAY ON WEST SIDE OF
NEWLAND STREET, NORTH OF YORKTOWN AVMUE

The City Council of the City of Huntington Beach does
hereby resolve as follows:
SECTION 1 . A public meeting was held before the Planning
Commission on July 17 , 1979 at which time it was determined,
pursuant to Government Code Section 65402 , that the proposed va-
cation of the excess street right-of-way on the west side of
Newland Street, north of Yorktown Avenue , conformed to the
city' s general plan.
SECTION 2. Pursuant to Division 9 , Part 3, Chapter 2 of
the California Streets and Highways Code (Sections 8320 et seq. ).
the City Council of the City of Huntington Beach hereby declares
Its intention to vacate the excess street right-of-way on the
west, side of Newland Street , north of Yorktown Avei,ue , more
particularly described as follows :
That portion of Section 1 , 'Township 6 South ,

way on the west side of Newland Street , north of Yorktown Avenue,
and reference is hereby made to said maps or plans for said par-
ticulars as to said proposed vacation.
SECTION 4 . 'rhe City Council does hereby fix July 8 , 1980
at the hour of 7: 30 p .m . , or as soon thereafter as the matter
may be heard in Council Chambers in the Civic Center, as she time
and place for hearing all. persons interested in or objecting to
the proposed vacation , which time is not less than fifteen (15)
days from the passage of this resolution. I
SECTION 5. The City Clerk is directed to cause a copy of
this resolution to be published in the Huntington Beach
Independent , a newspaper of general circulation within fifteen
( 15 ) days of the passage of this resolution .
SECTION 5 . The Street Superintendence is directed to post,
or cause to be posted , notices of vacatlon conspicuously along
the excess street right-of-Hay on the west side of Newland Street ,
north of Yorktown Avenue , proposed to be vacated at least ten ( 30)
days bel'ure the data of' the bearing. ;uch notlecu shall be
porit.ed not more than three hundred ( 300 ) apart. , but at

Dear Council Members:
z�te .residents on the west side . of Newland Street between Yorktown i
Avenue andi,Bridgeport Drive are-complaining about the noise, dust, 'and
general intp:�:ferenc:e to their homes='.,sused by the increase. of traffic
or,, Newland'`,:✓'=;:t �t ' They have petitioned the City to., vacate'-:a portion
of the existing right of way which waa acquired by Tract 3908 . They ,
also request the construction of a concrete wall and sidewalk. The
petition and map are attached for your review. our . preliminary investi-
gation into the request has revealed that both Southern California';Edition
and Genera].✓ Telepi=e rave facilities located in the area which would
require colisidera)�1e. 'expense to relocate. Also, it is normally required
that the property1owner (s) construct any necessary walls . The following
alternatives are %.offered for your consideration.
1. 1 Retain the right of way. Landscape...and install meandering, sidewalk
in the 23 ' strip at a cost of approximately $18 , 000 ($8 ,000 for
sidewalk and $10#000 for landscaping) . The sidewalk is eligible
for City Gas Tax funding. Landscaping must be budgeted out of
Ge..neral funds.

2. 'lacate ,'the surplus right of way which is 15 ' wide, but. retain an, :
easement for utilities. This. would require installation of. sidewalks
at a. cost of $8, 000 which could be provided from City Gag Tax. funds.
The vacated strip would come' under the ownership of the adjacent
property owner and probably would not be landscaped and/or maintained
properly.
3. Vacate the surplus right of way, and not retain a utility easement.
The City would then construct the aforementioned sidewalks at a cost
of $8 0 000. 00. It would '.,o-ost the adjacent property owners approxi-
mately $25, 000 to relocate the utilities.

At this time it would only seem fair and just for ,Uhe

iri a geditchthat never came to be. Presently the open
s nuisance to weeds , trash and you name it. Since
this land was;,'and still not used for the original intended
purpose, we as property owners were not able 'to do a., good
job of landscaping. We are petitioning_ the city to rein-
state our property and install a wall and sidewalk. Any

tenance by both city and property owners.

Paul E. Cook, being duly sworn, deposes and says:
That he is now and was during all the times mentioned the duly
appointed, qualified and acting Street Superintendent of the City
of Huntington Beach, in said County and State.
That :on the 2nd day of Junin, 1980, the City Council of said
City passed its Resolution of Intention No. 4878 , "A- Reeolution of
Intention of the City Council of the City of Huntington. Beach, "
declaring its intention to vacate a portion of Newland Street.
That after adoption of said .,_Resolution, he poste d"'Conspicuously
along the street and )property .described,, in said Resolution notices '
of the adoption of said Resolution and headed, "Notice of Hearing
Street Vacation, " one of which notices, similar to the notice posted
as aforesaid, is annexed hereto and made a part hereof.
That he completed all the posting of said notices on the loth
day of June, 1980, and thereafter he made this affidavit and filed
it wS,'!,h the City Clerk of the City of Huntington Beach.

Statement of Issue:
The residents of Tract 3908 contiguous to the subject easement . have ,
Petitioned the City to vacate the easement and construct a block Wall
and sidewalk in order to eliminate existing aesthetic, noise and dust
problems.
Recommended diction:
Adopt the attached resolution ordering vacation of subject easement. r'
Analysis:
Some, years •ago the City anticipated .the construction of ,a storm. drain
channel along the west side of Newland St. between. Yorktown Avenue 4nd
Bridgeport Lane. Additional right-of-way was provided by the developers
of Tract 3908 for this facility. Ultimately the storm drain was con-
structed within Newland Street eliminating the necessity for this add�-
tional right-of-way.
The: block wall and sidewalk requested by the petitioners was granted- by
the City Council on October 1, 1979 and construction of the improvement
has been completed. The excess right-of--way can now be vacated in
accordance with the petitioners ' request.
The resolution of intent to vacate the subject easement was adopted by
the City Council at their June 16th ,meeting.
