RFLATP,19 TO THE VACATION OF HUNTINGTON PLACE
WHEREAS, on Decembet, 1 , 1980 the City Council of the City
of Huntington Beach adopted Resolutron No. 4940 entitled, "A
Resolution of the City Council of the City of Huntington Beach
Ordering the Vacation of Huntington Place , Czean Place and
Winters Place in the Warner/Qoldenwest Redevelopment Project; " and
Such resolution was recorded In the Official h ci Records of the
County of Orange in Book 13875 , page 17'33 on December 16 , 1980; an6
The adjacent property north of Huntington -Place is owned in
fee by the Orange County Flood Control District and has been
physically improved as a drainage channel and has adequate access
from a parallel service road , located within its boundary; and
Additional access to Huntington Place would not be required
or be desirable; and
The adjacent property to the south in owned in fee by the
Redevelopment Agency or the City of Huntington Beach for a pub.
lic purpose , to wkt : redevelopment ,
HOW , THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach that the underlying fee of Huntington
i'lace, as shown on a map of Tract 392 , recorded in Book 16 ,
page 5 of Misnel laneoun Mapa , records, of Orange County, California ,
a copy of which in attached hereto and by this reference made a
part hereof , #%hould be incorporated entirely within the boundary
Of the tiarner/Ooldenweit Redevelopment Project , the adjacent
property south of the vacated Huntington Place .

WHEREAS, on November 3, 1980 the) City Council or the City of
Huntington Beach duly adopted Resolution No. 4931 declaring
its intention to vacate Huntington Place, 0^.asn Place , and
Winters Place in Tract 392, and referring to maps or plane on
file in the office of the City Clerk for particulars as to the
proposed vacation; and
Said resolution fixed the time and place or December 1, 1980
at the hour of 7: 30 p .m. , or as soon thereafter an the matter could
r be heard , in the Council Chambers in the Civic Center, for hear-
ing all persona interested in or objecting to the propteed va-
cation, which timR was not lees than fifteen ( 15) days from the
passage or said resolution. Notices or the proposed vacation
were posted conspicuously alone Huntington Placc , Ocean Place ,
and Winters Place in TracL 392, and such notices were posted not
more than three hundred (300) feet apart and at least three ( 3)
were posted.
On December 1 , 1980 at the hour of 7: 30 p .m. , in the
Council Chambers in the Civic Center, the City Council of the
City of 'Huntington beach did convene for the purpose o: hearing
all persona interested in or objecting to the proposed vacation
of Huntlr gton Place, Ocean Place, and Winte ra Place in Tract 392,
at which time no objection was made to said vacation, and evi-
dence was presented showing that Huntington Place, Ocean Place,
and Winters Place, proposed to be vacated , are not necessary

are not necessary for present or prospective public street pur—
poses, and are not suitable for use or development as biaycle
paths or routes, and it is hereby
ORDERED that Huntington Place, Ocean Place, and winters Place
be and the same are hereby vacated; and said streets so vacated
are more particularly described as follows:

OF HUNTINOWN BEACH OF INTENTION TO VACATE
HUNTIWITON PLACE, OCEAN PLACE, AND M 1FIrSRS
PLACE IN THE WARNER/GOLDERWEST REDEVtWPMENT
PROJECT
The City Council of the City of Huntington Beech does
hereby revolve as follows:
SECTION 1. A public meeting was held before the Planning
Commission on October 21, 1980 at which fuser :Lt "a detec"ined,
pursuant to Government Code section 65402 , fast the proposed va-
cation of Huntington Place , Jcean Place and VLnters Place in
Tract 392 conformed to the city 's general plars.
SECTION 2. Pursuant to Divislon 9, Part 3, Chapter 2 of
the California Streets and Highways Code (secGlons 8320 et seq. ) ,
the City Council of the City of Huntington Beach hereby declares
its intel.tion to vacate Huntington Place , Ocean Place and Winters
Place in Tract 392 more particularly described as follows:

SECTION 5. The City Clerk is directed to cause a copy of
this :esolution to be published in the Huntington Beach
Independent, a newspaper of general circulation within fifteen �
( 15 ) days of the passage of this resolution.
SECTIOU 6. The Street Superintendent is directed to post,
or cause to be posted, notices of vacation conspicuously along
Huntington Place, Ocean Place and Winters Place proposed to be
vacated at least ten (10) days before the date of the hearing.
Such notices shall be poated not more than three hundred (300 )
feet apart, but at least three (3 ) shall be posted. Such no—
tices shall state the passage or this resolution of intention
and the time and puce of hearing.

Huntington Beach at a regular meeting thereof held on the 3rd
day of November , 1980.

Statement of Issue:
The City needs to vacate the paper streets located within the subject area
to enable the redeveloper to proceed with necessary subdivision maps.
Recommended Action:
Approve the attached resolution and schedule the required public hearing .
Analysis? :
The participation agreement between the City and L. C. Small (the re--
developer) necessitates vacation of the paper street easements within the
project area to enable the redeveloper to file necessary subdivision naps.
The vacation procedure requires adoption of they attached resolution of
intent and a public hearing prior to adoption of the final resolution
ordering the street vacations .
Attached is a map showing the street areas to be vacated.

duly appointed, qualified and acting. Street Superintendent of
Huntington Beach, in said County and State.
That ,on the 3.7th da of Nov 1980 C unc ' 1 ' said
y 1980, 'the City Co i nf .
City passed its Resolution of Intention No. 9931 , A :Resolution
of Intention of the City Council of the ,City of Huntington Beach, "
declaring its intention to vacate Huntington Place, Ocean Place,
and Winters Place in the Warner/Go"Idenwest Redevelopment Project.
That after adoption of said Resolution, he posted conspicuously
along the street and property described in said Resolution notices
of the adoption of said Resolution and headed, "Notice of Hearing
Street Vacation, " one of which notices, similar to the notice posted
as aforesaid, is annexed hereto and made a part hereof.
That he completed all the posting of said notices on the 19th
day of Nov. 1980, and thereafter he made thin affidavit and fileu
it with the City Clerk of the City of Huntington Beach.
