A RESOLUTION OF THE CITY COUNCIL GF'-THE CITY
OF HUNTINGTON BEACH OF INTENTION TO VACATE , x
PORTIONS OF ALABAMA.;AND OREGON AVENUES, AND
STATE STREET, YORKTOWN AVENUE AND SEVENTEENTH
STREET LOCATED IN TRAC"," 110. 77 '.
The City Council of the City of Huntington Beach does
hereby resolve as follows :
SECTION 1.. A public meeting was held before the Planning �
Commission on April 19 , 1983 at which time it was determined,
pursuant to Government Code section 65402 , that the proposed }
vacation of portions of Alabama and Oregon Avenues, and State
Street , Yorktown Avenue and Seventeenth Street in Tract No. 77
A
conformed to the city ' s general plan.
SECTION 2 . Pursuant to Division 9 , Part 3, Chapter 2 of
tho: California Streets and Highways Code ' sections 8320 et seq. ) ,

SECTION 3. The City Clerk is directed to maintain on file ;
in the office of the •City Clerk maps or plans showing the particu•
lars of the proposed vacation of portions of Alabama and Oregon
Avenues , and State Street , Yorktown Avenue and Seventeenth Street
in Tract No. 77 , and referenda is hereby made to said maps or
plans for said particulars as to said proposed vacation.
SECTI011 4 . The City Council does hereby fix June 69 1983

be heard in Council Chambers in the Civic Center, as the tine and
place for hearing all persons Interested in or ot;,lecting to the
proposed vacation, which tirr:� is not less than fifteen (15) says
from the passage of this resolution.
SECTION 5. ':he City Clerk is directed to cause a copy of
this resolution to be published in a weekly newspaper, published
and circulated in Huntington Beach for at Ivast two successive

STATE STREET, YORKTOWN AVENUE AND SEVENTEENTH
STREET LOCATED IN TRACT NO. 77

WHEREAS, on May 160 1983 the City Council of the City of
Huntington Beach duly adopted Resolution No. 5,262 declaring
its intention to vacate portions of Alabama and Oregon Avenues ,
aria State Street, Yorktown Avenue and Seventeenth Street, lo-
cated in Tract No. ?7, and referring; to maps or plans on Pile
In the office of the City Clerk for particulars as to the pro-
posed vacation; and
Said resolution fixed the time and place of June 6, 1983
at the hour of 7: 30 p .m. , or as soon thereafter as the
matter could be heard , in the Council Chambers in the Civic
Center, for hearing all persons interested in or objecting to
the proposed vacation, which time was not less than fifteen
(15 ) days from the passage of said resolution. Notices of the
proposed vacation were posted conspicuously along the portions
of Alabama and Oregon Avenues , and State Street , Yorktown Avenue
and Seventeenth Street In Tract No . 77 , and such notices were
pasted riot. more than three hundred ( 300 ) feet apart and at least
three ( 3 ) were poote.'d ; and

NOW, THEREFORE, the City Council of the City of Huntington
Beach, pursuant to Division 9, Part 3, Chapter 2 of the California
Streets and Highways Code, commencing with Section 83202 does
resolve that certain portions of Alabama and Oregon Avenues, and {
State S;;reet , Yorktown Avenue and Seventeenth Street In Tract
No. 77 are not necessary for present or prospective public street
purpostz , and are not suitable for use or development as bicycle
paths or routes , and it is hereby
ORDERED that portions of Alabama and Oregon Avenues , and
State Street , Yorktown Avenue and Seventeenth Street be and the
same are hereby vacated ; and said portions of such streets in
Tract No. 77 so vacated are more particuldri;; described as fol—
lows :

Oregon Avenue, State Street and portions

The City Council of ,the City of Flintington Beach does
hereby resolve as follows :
SECTION 1, A public meeting was held before the Planning _
Commission on April 19, 1983 'at which time it was determined,
pursuant to Government Code section 65402, that ,the proposed
vacation of , portionn of Alabama and Oregon Avenues,` and State
Street, Yorktown Avenue and Seventeenth Street in Tract No, 77
conformed to the city's general plan.
SECTION 2. Pursuant to Division 9 , Part 3, Chapter 2 of
the California Streets and ,Highways Code (sections 8320 et seq. ) ,
the City Council of the City of Huntington Beach hereby declare$
its intention to vacate portions of Alabama and Oregon Avenuea,
and State Street , Yorktown Avenue and Seventeenth Street in
Tract No. 77 more particularly described- as follows : r I

place for hearing all persons interested in or objecting to the
proposed vacation, which time is not less than fifteen (15) days
from the passage of this resolution.

SE&ION 5. The City Clerk is directed to cause a copy of {

this resolution: to be published, in a weekly newspaper, published
and circulated in Huntington Beach for at least two s';�::cessive
weeks prior to the time set herein for the public hearing. ..
SECTION 6. The Director of Public works is directed to post,
or cause to be posted, notices of vacation conspicuously along that
portion of Alabama and Oregon Avenues , and- State Street , Yorktown
Avenue and Seventeenth Street in Tract No. 77 proposed to be va—
cated at least two weeks before the date of the hearing. The
notices shall be posted not more than 300 feet apart, but at least
three notices shall be posted. The notices shall state the day,
hour, and place of hearing and shall refer to the adoption of this
resolution of intention, and shall describe those portions of
Alabama and Oregon Avenues , and State •Street, Yorktown Avenue and
Seventeenth Street proposed to be vacated, or shall include a map
or plan showing the location of the proposed vacation.

and utility easements in Tract 77 .
RECOMMENDATION:
Adopt the attached resolution ordering vacation of the easements.
ANALYSIS :
The 1 y� has agreed with the Huntington Beach Company .'to vacate unneedod
street and ut?.lity easements in Tract 77. The easements in question are
in undeveloped "paper streets" planned in 1523, but newer constructed.
At the meeting of May 5, 1M3, the City Council approved Resolution
No. 5262 announcing the intention to vacate said easements. Final
approval, after the required public hearing, is: now needed.
FUNDING SOURCE:
No f'unc inecessary.

appointed, qualified and acting Street Superintendent of the City
of Huntington Beach, in said County and State.
That on; the 16th day of May, 19834, the City Council. ofl'iaid
City passed its Resolution of Intention No. +262, "A Resolution of=
the; City Council of the City of Huntington 'Beach of Intention to
Vacate Portions of Alabama and Oregon Avenues, and State Street,
Yorktown Avenue an es d Seventeenth Street Located in Tract. No. 77.
That after the adoption of said Resolution, he posted conspicu-
ously along the street and property described in said Resolution
notices of the adoption of said Resolution and headed, "Notice, of
Street Vacation, " one of which . notices, similar to the notice he
posted as aforesaid , is annexed hereto and made part hereof,.
That he completed all the posting of said notices on the 17th
day of May, 1983 , and thereafter he made this affidavit and filed
it with the City Clerk of the City of Huntington Beach.

The City has agreed with the Huntington Beach Cartpwyj to vacate unneeded street and
utility easements in Tract 77. The easements in question are in doped "paper
streets" laid out in 19230 but never constructed.
At the meetixr3 of April 19, 1983, the Planning Co mission found the proposed Vacations to
5e in omfonTence with the City's Cameral Plan. A Public Works staff review has de-
termined that the its are of no future use to the City.
