C 2 tree at charge. } RESOLUTION NO., 5567 A RESOLUTION`OF THL"CI'TY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF PORTIONS OF LOS PAl'OS DRIVE BETWEEN SIMS AND LYNN STREETS WHEREAS, on August 19, 1985 the City Council of the City of Huntington Beach duly adopted Resolution No. SS50 declaring its intention to vacate portions of Los Patos Drive between Sims and Lynn Streets, for public purposes, and referring to maps or plans on file in the office of the City Clerk for par- ticulars as to the proposed var.ation; . and Said resolution fixed the time and place of September 3, 1985 at the hour of 7: 30 p.m. , or as soon thereafter as the matter could be heard, in the Council. Chambers in the Civic Center, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen ( 15 ) days from the passage of said resolution. 1,otfces of va- cation were posted conspicuously along the portions of Los Patos Drive proposed to be vacated, and such notices were pasted not more than three hundred ( 300 ) feet apart and at least throe ( 3 ) were posted. rn September 3, 1985 at the hour of 7: 30 p.m. , in the Council Chambers in the Civic Centex , the City Council of the Ci'-y of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of portions of Los Patoo drive between Silas and Lynn Streets, at which time no objection was made to said vacation, and evi- dence was presented showing that such portions c'r nail street are not necessary for present or prospective public use and are not cuita'ile for use or development as bicycle paths or routes . n��t ��or+ -:u o tYs 1 OF OnArirE COUNT. A public meeting was held before the Planning Commission on July 16, 1985 at which time it was determined, pursuant to Government Code section 65402, that the proposed vacation of portions of Los Patos Drive between Sins and Lynn Streets, conformed to the city' s general plan. SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the California Streets and Higoways Code, commencing with sec- tion 6320, the City Council of the City of Huntington Beach hereby declares its intention to vacate portions of Los Patos Drive between Sims and Lynn Streets, more particularly de- scribed as follows : That real property in the city of Huntington Beach, county of Orange, state of California described in parcels as follows : PARCEL 1 : The youth 30. 00 feet of the west half o!the aoutheact quarter of the south- east quarter of the south half of Lot 3, Block 18 of Tract 86, as per map recorded in Book 10, pages 35 and 36 of Miscellaneous Maps in the office of the Recorder of said county . RD C N: Adopt the attached resolution of intent to vacate the easements and schedule the required public hearing for September 3, 1985. ANALYSIS: In 1977, the Engineering staff obtained easements from the property owners. north of Log Patos Drive for the widening of the street. However, when the easements were recorded, same of them contained incorrect legal descripti ms which identified the wrong parcels.
