Small, Chief of Police SUBJECT: Adopt Resolution No. 2011-76 for enforcement of California Vehicle Code Provisions on Brightwater Drive; and, approve introduction of Ordinance No. 3921 amending Municipal Code Chapter 10.12 relating to speed limits adding Brightwater Drive Statement of Issue: The recommended action on the Resolution authorizes the City's Police Department to enforce provisions of the California Vehicle Code on Brightwater Drive, a private street in the Brightwater community. The Ordinance amends Chapter 10.12 of the Huntington Beach Municipal Code to include Brightwater Drive with an enforceable speed limit of 30 miles per hour. Financial Impact: Enforcement of traffic laws on Brightwater Drive will require minimal police staff resources and can be accomplished with the current department budget. Recommended Action: Motion to: A) Adopt Resolution No. 2011-76, "A Resolution of the City Council of the City of Huntington Beach Authorizing the Huntington Beach Police Department to Enforce California Vehicle Code Provisions on Private Streets in the Brightwater Residential Community;" and, B) Approve for Introduction Ordinance 3921, "An Ordinance of the City of Huntington Beach Amending Chapter 10.12 of the Municipal Code Relating to Speed Limits." Alternative Action(s): Deny adoption of the Resolution that enables the City's Police Department to enforce provisions of the California Vehicle Code on Brightwater Drive. HB -419- Item 13. - I REQUEST FOR COUNCIL ACTION MEETING DATE: 9/19/2011 DEPARTMENT IDNUMBER: PW 11-056 Analysis: In July 2011, Hearthside Homes/Brightwater Maintenance Corporation transmitted a Board of Director's passed resolution (Attachment 4), and an Engineering and Traffic Survey (Attachment 5) requesting City enforcement of California Vehicle Code provisions on Brightwater Drive. Brightwater Drive is a private street located between Warner Avenue and Bolsa Chica Street and serves as the collector street for the Brightwater residential development. Enforcement is requested on Brightwater Drive only, not all the private streets in the development. California Vehicle Code Section 21107.5 authorizes a city to apply the Code's provisions to privately owned and maintained streets within the city if certain conditions exist. If privately owned and maintained streets are generally held open for public use for vehicular travel, and connects with public roadways in such a way that the public cannot determine the roads are not public, the Code allows a city to enact an ordinance or resolution to apply the Code's provisions on those streets. The city must establish the findings and declare that the private road is indistinguishable from other public streets in the city. The California Vehicle Code requires written notice of the proposed enforcement to the owners of the privately maintained and owned streets. The Engineering and Traffic Survey establishing a posted 30 mile-per-hour speed limit on Brightwater Drive was reviewed and accepted by Public Works staff. The Brightwater Maintenance Corporation will install and maintain all speed limit signs, entrance signs, and markings. Adoption of the Resolution (Attachment 1) makes the determination that Brightwater Drive essentially functions like a public street and in the interests of the residents and motoring public will best be served by application of the California Vehicle Code to that street. Adoption of the Ordinance (Attachment 2) establishes the enforceable speed limit of 30 miles-per-hour on Brightwater Drive. Public Works Commission Action: Not required. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of streets hereinafter set forth,the City Council determines and declares that a speed greater than the prima facie speed limit of twenty-five(25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of fifty-five (55)miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is fifty-five (55) miles per hour. Brightwater Drive is the main collector street through the Brightwater community connecting two major arterial roads—Warner Avenue and Bolsa Chica Street. Although Brightwater Drive is a private street, it is open to the general public and is indistinguishable from other public streets in the city. As such,it is in the interest of public safety that the city police department be authorized to enforce all sections of the California Vehicle Code on Brightwater Drive. Originally planned and developed in the unincorporated County, Brightwater was annexed into the city in 2008. Brightwater Drive was designed to public street standards, but was designated as a private street.by the County to allow the Brightwater Maintenance Corporation(BMC)—the homeowner's association—to maintain the street. Since the street was opened to the public in 2007, no speed limit has been adopted,posted or enforced. Hearthside Homes has worked with the Brightwater Maintenance Corporation to take the necessary steps to request that the city begin enforcement actions on Brightwater Drive. California Vehicle Code Section 21107.7 requires a formal request from the board of directors of a common interest development requesting the city's assistance in enforcing the vehicle code. Attached to this letter is a resolution adopted by the BMC dated July 5, 2011 making such a request for.Brightwater Drive. The intent of the BMC at this time is to limit enforcement to Brightwater Drive. In addition to the BMC resolution, attached is a traffic speed limit study conducted by Urban Crossroads, a licensed traffic engineering consulting firm, recommending a 30 mile per hour speed limit for Brightwater Drive. The project location is shown on Exhibit A. A recommendation regarding the appropriate speed limit is also presented in this letter report. The California Vehicle Code (CVC) sets certain regulations regarding the posting and enforcement of speed zones (i.e. posted speed limits) which generally reflect the viewpoint that speed zoning should be based on traffic conditions and natural driver behavior rather than an arbitrary response to a specific traffic event or occurrence or pressure from special interest groups resulting in what is typically known as "Political Speed Limits." These requirements are: • Basic Speed Law(CVC 22360) All fifty states base their speed regulations on the Basic Speed Law. In California, CVC 22350 defines the basic speed law as: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of the highway, and in no event at a speed which endangers the safety of persons or property." This law recognizes that driving conditions vary widely from time-to-time and place-to-place, and therefore, no set or fixed driving rules will adequately address all conditions. The Basic Speed Law is founded on the belief that a majority of motorists are able to modify their driving behavior properly, as long as they are aware of the conditions around them. Various organizations, including the California Department of Transportation (Caltrans), the Automobile Club of Southern California, and the traffic engineering community in general, recognize that setting realistic speed limits in a rational and defensible manner is necessary to maintain public confidence. Conversely, setting speed limits on an arbitrary basis lacks public support, encourages wholesale violations, and usually fails to bring about change in driver.behavior (speed). Published research indicates that no significant change in traffic speeds occur following the posting of new or revised speed limits, nor is there any direct correlation between posted speed limits and accident frequency. Most speeds limits are established at or near the 85`h percentile speed, which is defined as that speed at or below which 85th percent of the traffic is moving. Speed limits established below the 85th percentile do not ordinarily facilitate the orderly movement of traffic and require constant enforcement to maintain compliance. An engineering and traffic survey is required when establishing the speed limit for most streets. Exceptions include Prima Facie speed limits, business and residential district speed limits, and local street speed limits and are described hereafter. Prima Facie Speed Limits (CVC 22352) All other speed limits are prima facie meaning "on the face of it or self-evident," in the drivers' determination of what is reasonable and prudent under normal conditions. A driver may exceed any prima facie limit if it is safe to do so under prevailing conditions. However, when a police officer cites a driver for exceeding a prima facie speed limit, it is up to the driver to prove, if he can, that he was driving in a reasonable and prudent manner under the existing conditions and did not commit a violation of the basic speed law. The opportunity given to the driver to exceed a prima facie speed limit, when it is safe to do so, recognizes the fact that any posted speed limit cannot adequately reflect the many different conditions of traffic, weather, visibility, etc., that may be found on the same highway at different times. 07554-05 Letter Report doc Item 13. - 26 HB -444- Mr. Ed Mountford HEARTHSIDE HOMES June 7, 2011 Page 3 Certain prima facie speed limits are automatically established by law (CVC 22352), including a 15 mph limit in alleys, blind intersections, blind railroad crossings, and a 25 mph limit in business and residential districts. There is also a part time 25 mph limit in school zones when children are present in route to or from school. Business and residence districts are defined in the Vehicle Code as specific areas meeting a specified minimum density of roadside development. CVC Sections 235 and 515 define these regulations. The basic criteria is either 13 or more residences or businesses fronting one side of a roadway within a distance of a quarter of a mile, or 16 or more residences or businesses fronting both sides of a roadway within a distance of a quarter of a mile. A count of houses or active businesses fronting on a highway must be made to determine whether or not a valid business or residence district exists. The law does not require posting these prima facie limits when they are readily apparent. The adjacent residential properties do not front on (face) Brightwater Drive. Therefore, the speed limit cannot be determined using the residential district criteria. Local: Street Exemptions (CVC 40802) Many streets are designated as "Local" streets per CVC 40802. These streets, as described, are exempt from the E&TS requirements. A local street or road primarily provides access to abutting residential property and shall meet the following three conditions: 1. Roadway width of not more than 40 feet. 2. Not more than one half mile of uninterrupted length. 3. Not more than one traffic lane in each direction. Brightwater Drive does not provide direct access to the abutting residential development. Therefore,the speed limit cannot be determined on the basis of the residential district criteria. Engineering and Traffic Survey Reguirements and Results The CVC requires that an engineering and traffic survey (E & TS) be prepared whenever a speed zone is being established. Accident records. • Highway, traffic and roadside conditions not readily apparent to the driver. Until July 1, 2009, speed limits were established at or below the closest 5-mile per hour increment to the 85th Percentile speed as determined by the E&TS. In their action of July 2009 (Policy Directive 09-04), the California Department of Transportation (Caltrans) revised this standard to state, in essence, that when a speed limit is to be posted, it shall be established at the nearest 10 km/h (5 mph) increment of the 65m percentile speed of free flowing traffic except that: The posted speed limit may be reduced by 10 km/h (5 mph) from the nearest 10 km/h (5 mph) increment of the 85th percentile speed (in compliance with CVC Sections 627 and 22356.5). If the speed limit to be posted has had the 10 km/h (5 mph) reduction applied, then an (E&TS) shall document in writing the conditions and justifications for the lower speed limit and be approved by a registered Civil or Traffic Engineer. The reports for the lower speed limit shall be in compliance with CVC Sections 627 and 22358.5. Justification for a 10 km/h (5 mph) reduction from the 85th percentile speed are conditions not readily apparent to drivers, such as a significantly higher accident rate on the subject street, design speed of the study street or vision restriction on the cross streets any and all of which, if used to justify a reduction, must comply with CVC Sections 627 and 22358.5. An example of how the revised standard affects a posted speed limit is: • Previous —The 85th percentile speed is 38 mph. The speed limit could be established at 35 mph or with justification be reduced to 30 mph. ® Currently — The 85th percentile speed is 38 mph. The speed limit must be established at 40 mph, or with justification, be reduced to 35mph. 07554-05 Letter Report.doc Item 13. - 28 xB -446- Mr. Ed Mountford HEARTHSIDE HOMES June 7, 2011 Page 5 Speed Zone Survey As required as part of an E&TS, the prevailing speeds are determined by a speed zone survey. The speed zone survey is conducted at midweek, during off-peak traffic conditions at a location on the study street where traffic is free-flowing. A sample of 100 vehicles in each direction is taken on typical arterial streets. On streets with a low traffic volume, samples are taken until a representative bell curve distribution is attained. As Brightwater Drive is a low volume collector street, a total sample of 100 vehicles was obtained over a time period in excess of two hours. The sample data was reviewed and it was confirmed that a reasonable distribution of speed data was collected. Attachment "A" contains the speed survey data and results, while Attachment "B" includes the certification of the accuracy of the radar gun and technician training certification. The technician or engineer conducting the survey observes each study street segment to determine, and document, as necessary, the various street conditions and characteristics such as improvements, traffic composition, pedestrian and bicycle activities, alignment, development and access characteristics and traffic control that might influence the determination of an appropriate speed limit. The three major statistical factors developed from the field data are: © Critical 85t�'Percentile Speed The speed, at or below, which 85 percent of the traffic is traveling. One of the most reliable and universally defensible factors in determining an appropriate speed limit. The observed 851' percentile speed on Brightwater Drive was 37 miles per hour(mph). ® Pace Speed The continuous 10 mph incremental range of speeds in which the largest number of surveyed vehicles are traveling. Accepted practice is to establish the recommended posted speed limit within the 10 mph pace speed.The 10 mph pace speed on Brightwater Drive is 29 to 38 mph. 07554-05 Letter Report.doc BB -447- Item 13. - 29 Mr. Ed Mountford HEARTHSIDE HOMES June 7, 2011 Page 6 • Median Speed/50th Percentile Primarily a measurement of speed distribution, but in practice, the 50'" percentile is the lowest speed that should be recommended and only under extreme conditions. 50 percent of vehicles in the survey are traveling faster than the median speed. The median speed on Brightwater Drive is 32 mph. Accident History The City of Huntington Beach was contacted regarding the accident history over the past 2 years for Brightwater Drive. City staff indicated that only one accident has occurred on Brightwater Drive during this time frame. The accident occurred on December 20, 2009, at 2 PM in the afternoon. The accident report did not indicate that excessive speed was a contributing factor to the incident. The accident history does not appear to provide any basis for a reduction in the recommended speed limit. Hiahway, traffic and roadside conditions not readily apparent to the driver The engineer in responsible charge of the E & TS visited the subject roadway to determine if highway, traffic, or roadside conditions not readily apparent to the driver were present that would provide a basis for recommending a reduced speed limit. Exhibit B depicts the project area. Brightwater Drive is generally a two lane undivided roadway with a 40 foot curb to curb width and fully improved curb and gutter and sidewalks on both sides of the street. The west end of the subject segment (from Warner Avenue east) is characterized by a vertical gradient culminating in a vertical crest between Chatham and Camden. The remainder of Brightwater Drive is relatively flat. There are also 5 horizontal curves along the subject segment of Brightwater Drive. Sight distances for the various side streets were observed and appear adequate. There are several neighborhood "pocket" parks located along Brightwater Drive which are served by crosswalks without any advance warning signage. Several of these crosswalks are located in the immediate vicinity of curves on the roadway which render advance visibility difficult. 07554-05 Letter Report.doc Item 13. - 30 HB -448- Mr. Ed Mountford HEARTHSIDE HOMES January 31, 2011 Page 7 There are also raised medians, including planter areas, that obstruct vision at various points along Brightwater Drive. Based on the field visit by the engineer, there are several roadside conditions (crosswalks near curves and median obstructions) that are not readily apparent to the driver present that would justify a reduction in the recommended speed limit of 5 mph to 30 mph.
