Statement of Issue: An Ordinance is required to amend the speed limits on certain streets
and to make other corrections as needed. This ordinance revises speed limits on Seapoint
Avenue and Summit Drive as recommended by the City Council subcommittee at the
August 3, 2000 meeting with the adjacent homeowner's associations.
Funding Source: General Fund Traffic Maintenance Materials Account
E-AA-PW-416-3-04-00 with an approximate cost of$300.00.
Recommended Action: Motion to adopt Emergency Ordinance Number amending
Chapter 10.12 of the Huntington Beach Municipal Code.
Alternative Action(s):
1. Do not approve Emergency Ordinance Number J3�71—
2. Suggest alternative speed limits. This action will disallow the use of radar-for speed
enforcement on the affected street segments.

Analysis: The adoption of the emergency speed limit ordinance is being requested to
provide Summit Drive and Seapoint Avenue with radar-enforceable speed limits before the
beginning of the school year. New homes, as well as a school and a park, have been built in
this area. The roadway striping was recently changed to take into account the effect of the
new construction on the roadway system. The proposed emergency speed limit ordinance
will reflect anticipated vehicular, bicycle, and pedestrian traffic.
A traffic and engineering survey was performed on certain streets, as required by the California
Vehicle Code, and the results of those surveys are indicated in the attached Legislative Draft.
In addition to the Ordinance, a Legislative Draft is also prepared by the City Attorney's Office.
A legislative draft indicates additions to the ordinance by bold face type two points
larger and deletions to the ordinance by strikethro gh. In some cases street segments are
shown as being removed from the ordinance. These street segments are included in the
preceding segment and have the same speed limit.
Traffic and engineering surveys must be completed every five years to allow the use of radar
for traffic speed enforcement. Failure to update the surveys invalidates radar-enforced
speeding citations and forces the Police to "pace" the violator to enforce speed limits. Pacing is
considered an impractical enforcement method for logistical reasons.
Public Works Commission Review: This data was presented to the Public Works
Commission as an informational item at its meeting of August 16, 2000

Council determines and declares that the prima facie speed limit of twenty-five (25) miles per
hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe
upon said streets and that the prima facie limit of speed on a portion of the following streets as
listed in Section 10.12.080 shall be and is twenty-five (25) miles per hour.

engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council
determines and declares that a speed greater than the prima facie speed limit of twenty-five (25)
miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon said streets; that a prima facie speed limit of thirty(30) miles per hour
is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe;
and that the prima facie limit of speed on a portion of the said streets as listed in Section
10.12.080 shall be and is thirty(30) miles per hour.
10.12.030 Thirty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of
an engineering and traffic survey of the portions of the streets hereinafter set forth, the City
Council determines and declares that a speed greater than the prima facie speed limit of
twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and
would be reasonable and safe upon said streets; that a prima facie speed limit of thirty-five (35)
miles per hour is the most appropriate to facilitate the orderly movement of traffic and is
reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as
listed in Section 10.12.080 shall be and is thirty-five (35) miles per hour.
10.12.040 Forty m.p.h.prima facie speed limit. Unless stated otherwise, upon the basis of an
engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council
determines and declares that a speed greater than the prima facie speed limit of twenty-five (25)
miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon said streets; that a prima facie speed limit of forty(40) miles per hour is
the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and
that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080
shall be and is forty(40) miles per hour.
10.12.050 Forty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of
an engineering and traffic survey of the portions of streets hereinafter set forth, the City Council
determines and declares that a speed greater that the prima facie speed limit of twenty-five (25)

10.12.060 Fifty m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an
engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council
determines and declares that a speed greater that the prima facie speed limit of twenty-five (25)
miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon said streets; that a prima facie speed limit of fifty(50) miles per hour is
the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and
that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080
shall be and is fifty(50) miles per hour.
10.12.065 Fifty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an
engineering and traffic survey of the portions of streets hereinafter set forth, the City Council
determines and declares that a speed greater than the prima facie speed limit of twenty-five (25)
miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon said streets; that a prima facie speed limit of fifty-five (55) miles per
hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and
safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section
10.12.080 shall be and is fifty-five (55) miles per hour.
10.12.070 Speed limits on state highways. The State of California has established that orderly
movement of vehicular traffic requires that a reasonable and safe limit be placed upon said streets
and that the prima facie limit of speed on a portion of the following streets shall be and is as
listed in Section 10.12.080.
10.12.080 Speed limits enumerated. Streets are listed alphabetically and categorized up (North)
and to the right (East). An asterisk (*) denotes speed limit not set by survey.

AN EMERGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING CHAPTER 10.12 OF THE HUNTINGTON BEACH MUNICIPAL
CODE PERTAINING TO SPEED LIMITS
The City Council of the City of Huntington Beach does hereby ordain as follows:
SECTION 1. Section 10.12.080 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
10.12.080 Speed limits enumerated. Streets are listed alphabetically and categorized up
(North) and to the right (East). An asterisk (*) denotes speed limit not set by survey.

G-1. Utility Trench Cut Fee Ordinance - Should the City of Huntington
Beach enact a utility trenchcut ordinance and associated fee
resolution? Representatives from utility companies will be in
attendance.
Recommended Action: Receive staff report and allow opportunity for
public comment, including the potentially affected utilities. Provide
additional input to staff for consideration, and direct that staff
continue discussions with utilities and return to the Commission on
October 18, 2000 with recommended action item for City Council
study session on November 6, 2000.

Introductory Comments
The meeting was convened at 4:04 p.m. Introductions were led by Mayor
Garofalo. Mr. Beardsley thanked everyone for attending and stated that a two-
part presentation would be made of a strategic plan to be implemented in the
next two weeks. He indicated that a speed study would be conducted,
followed by meetings to gather additional input from the public.
(Councilwoman Julien arrived at 4:08 p.m.)
Summit Drive
Mr. Brohard referenced a visual display that indicated the striping now in place,
and together with Sgt. Bill Martin explained that speed limits on Summit can be
enforced only by "pacing" because the City does not have a valid engineering
and traffic survey for Summit Drive, which is required by the Vehicle Code prior
to radar enforcement.

Mr. Brohard explained the procedures for conducting an engineering and traffic
survey and indicated that this is the way speed limits are set by State law.
Mayor Garofalo commented that staff is trying to get speeds down before
doing the survey.
In response to a citizen inquiry, Mr. Brohard indicated that traffic counts have
been done at Beacon Hill and Covington Lane, and that he has spent
considerable time personally watching people and traffic and evaluating the
information. He recommended that the following be considered:
l. 3-way stop and marked crosswalks at Beacon Hill
2. 4-way stop and marked crosswalks at Covington
3. Discourage pedestrians from crossing Summit between Covington
and Beacon Hill
4. Post Signs encouraging pedestrians to use crosswalks at Covington
and Beacon Hill
He stated that these installations would be followed by the engineering and
traffic survey and that, once approved, the Police Department would be able
to use radar for enforcement.
In response to a suggestion to have two southbound left turn lanes on Edwards
at Garfield, Mr. Brohard indicated that this will be considered and will take
several months to evaluate.
Councilman Harman stated that he believed such an approach made sense
since it would allow for more left turns.
Mrs. Hazard expressed appreciation for the bike lanes and narrowing of traffic
lanes, but stated that, when people park on Summit Drive, bicyclists go out of
the bike lane into the traffic lanes. She inquired what could be done about
parking on Summit.
Discussion ensued about the legality of parking in bicycle lanes. Mr. Beardsley
suggested that possible time of day parking prohibitions could be evaluated to
keep the lanes clear during school commute hours. The matter was referred to
staff for further study and recommendation.
Mayor Garofalo expressed concern that staff needs to work with school officials
regarding possible alternative student pick up and drop off locations for school
buses.

Daryl Smith cautioned that red curbs might cause some future park visitors to
park in the residential areas south of Summit.
Mayor Garofalo summarized that there was agreement to:
1. Put a 3-way stop and crosswalks at Beacon Hill
2. Put a 4-way stop and crosswalks at Covington
3. Authorized Mr. Beardsley to discuss with school district possible
relocating loading and unloading of school buses.
4. Place signs between Covington and Beacon Hill to "Use Crosswalk."
One of the residents commented that, at their last Peninsula meeting there was
lots of discussion about the people in their tract who are exceeding the speed
limits. Sgt. Martin responded that, over the last year and one half, the Police
Department has received a variety of complaints, so they have placed officers
on Summit using radar to monitor speeds. He indicated that two motor officers
recently monitored speeds on Summit for twenty minutes and they observed no
speeding violations. Sgt. Martin stated that the 85t" percentile (prevailing
speed) is at 40 miles per hour and that there is not a serious speed problem
considering the volume; it is a very good situation compared to other areas of
the City. He said that he believes that things will continue to improve and that
these action items will help even more.
Seapoint Avenue
Mr. Brohard stated that traffic counts, pedestrian counts, bicycle counts, speed
measurements and reported accidents have been reviewed for Seapoint. He
stated that 7 of 9 accidents occurring there were of vehicles leaving the
roadway. Mr. Brohard proposed a plan that would slow the traffic on Seapoint.
He indicated that though Seapoint at Cherry Hill and at Doral are now being
added to the list for traffic signals, it would be a number of years before the City
would install signals there, due to the signal priority list that exists. He indicated
that Public Works will be narrowing the lanes to 2, 10' wide lanes in each
direction from PCH to Garfield and would use white non-reflective markers to
delineate the bike lanes.
Mayor Garofalo inquired whether these areas are safer with or without
crosswalks. Mr. Brohard responded that they are safer without marked
crosswalks because pedestrians tend to perceive a false sense of security and
are not as cautious.

It was stated that the volume needs to be approximately equal on both Doral
and Seapoint in order to safely place stop signs there.
One of the residents suggested a median at PCH and Seapoint for pedestrian
stopping when crossing at that corner.
Mr. Brohard intends to implement striping within the next two weeks, then
evaluate the traffic speeds to set the speed limit. Then, the City Council can
take an emergency action to set the speed limit.
Councilwoman Julien noted that Doral needed to be addressed because it is
the only way in and out of the adjacent tract.
Mr. Gotsch commented on the speed limit being too high on Seapoint and
suggested straightening out the road before land is developed on both sides.
Tom Brohard stated that the restriping plan should reduce speeds.
(Councilman Harman left the meeting at 5:00 p.m.)
Mr. Beardsley stated that an engineering and traffic survey would be
conducted after the painting. A recommendation for an appropriate and
enforceable speed limit would be included in an ordinance for City Council,
and speed limit signs would be placed immediately after approval of the
ordinance at the September 5 Council meeting.
Sgt. Martin expressed concern about limited police resources, but stated that
additional resources would be available in September.
Councilwoman Julien inquired whether an emergency reduction of the speed
limit could be implemented immediately.
Mr. Beardsley suggested that Police presence be increased during the next 30
days in order to give staff time to get the painting and subsequent speed survey
done, and at that time it would be known what speed limit to present to the City
Council.
Mayor Garofalo requested that minutes of this meeting be provided for all those
in attendance.
Mr. Hazard inquired whether there is a plan for a crossing guard at the paseo at
Garfield and Saddleback. Sgt. Martin offered to check into it.

Discussion ensued about the wearing of helmets by bicycle riders and Sgt.
Martin indicated that during the school year, three traffic officers talk with
students at all elementary schools about this and other traffic safety subjects.
Mrs. Hazard expressed appreciation for everyone taking the time to meet and
for the opportunity to speak.

pertaining to speed limits. Emergency Ordinance No. 3476 establishes a speed limit of 40 miles per
hour on Seapoint Avenue between Pacific Coast Highway and Garfield Avenue. Emergency
Ordinance No. 3476 also establishes a speed limit of 35 miles per hour on Summit Drive between
Seapoint Avenue and Goldenwest Street.
