Recommended Action: Motion to:
Retain the existing posted speed limits on Heil Avenue of 35 mph from Saybrook Lane to
Bolsa Chica Street and 40 mph from Bolsa Chica Street to Newland Street as established
in Ordinance No. 3479 and Ordinance No. 3495.
Alternative Action(s): Direct staff to prepare an ordinance with alternative speed limits on
portions of Heil Avenue, recognizing, that by doing so, this will disallow the use of radar for
speed enforcement on the affected street segments. This action will also make Heil Avenue
unique as the only street in the City where radar enforcement may not be used.
Analysis: At the May 7, 2001, City Council meeting, a resident requested that the City
Council lower the speed limit from 40 to 35 mph (mph) on Heil Avenue near Springdale
Street. At the City Council meeting on May 215t, the same resident requested a 35 mph
speed limit from Saybrook Lane to Newland Street and additional signing indicating
"School, Speed Limit 25, When Children Are Present" signs on Heil Avenue. The City
Council then directed the Public Works Commission to consider the request and provide
recommendations.

As part of Ordinance No. 3479 effective December 6, 2000, the posted speed limit on Heil
Avenue from Bolsa Chica Street to Beach Boulevard was raised from 35 to 40 mph. Speed
limit signing was changed on April 26, 2001, on Heil Avenue from Springdale Street to
Goldenwest Street from 35 to 40 mph after completion of the Orange County Sanitation
District's construction project.
As part of Ordinance No. 3495, the speed limit on Heil Avenue east of Beach Boulevard
was raised from 35 to 40 mph effective May 16, 2001. For this segment, it was necessary
to match the surveyed posted speed limit previously established by Westminster on this
shared roadway. The outside eastbound lane and the parking area on the south side are in
Huntington Beach, with the majority of the street in Westminster.
The California Vehicle Code requires engineering and traffic surveys every seven years if
the local agency utilizes radar for speed enforcement. The speed limits must then be
posted according to these surveys that are required to include:
1. Measurement of existing travel speeds at a representative location within the segment.
2. Identification of roadway characteristics and conditions that may not be readily apparent
to motorists; and
3. Review of the accident history.
New engineering and traffic surveys have been conducted in accordance with the
California Vehicle Code provisions along Heil Avenue. The previous surveys, as well as
those made in the last two months, are attached with the speed measurements and
accident rates summarized in the following charts:

In 1998, the speed limit on Heil Avenue was lowered to 35 mph. This action prohibited
radar enforcement from Bolsa Chica Street to Newland Street, as the lower speed limit was
not supported by an engineering and traffic survey. The inability to use radar resulted in
reduced speed enforcement on Heil Avenue.
The May 2001 surveys indicate a recent decrease in travel speeds along Heil Avenue from
Bolsa Chica Street to Golden West Street. This decrease occurred even after the speed
limit increased 5 mph from 35 to 40. The decreased travel speeds may be attributable to
the use of radar enforcement of the 40 mph limit. The May 2001 engineering and traffic
surveys confirm that the existing posted speed limits along Heil Avenue are appropriate,
reasonable and enforceable with radar.
The California Vehicle Code establishes a speed limit of 25 mph adjacent to and up to 500'
from any school grounds or buildings that are not separated from the street by a fence,
gate or other physical barrier. If posted speed limits are higher than 25 mph without any
fencing, then the "School, Speed Limit 25, When Children Are Present" signs are
appropriate.
The school zone signing along Heil Avenue was also reviewed. The schools near Heil
Avenue between Springdale Street and Edwards Avenue are separated from the roadway
by continuous fencing or are not adjacent to the roadway. As a result, the existing "School,
Speed Limit 25, When Children Are Present" signs do not meet the California Vehicle Code
requirements and should be removed. The existing signing in advance of the adult crossing
guard locations on Heil Avenue at both Bradbury Lane and Trudy Lane should be upgraded
to the new florescent yellow green color. These signing changes do not require City
Council action and will be accomplished in the next few weeks.
Public Works Commission Review: The Public Works Commission recommended
approval of this action at its July 18, 2001 meeting by a vote of 6-1.

1 ) The Heil Street Community is requesting Council ' s assistance to
remedy the street signage errors by CITY STAFF PROMOTION to
increase signage from 35MPH. to 40MPH..
2 ) From our review of staff paperwork , we discovered their reasons for
including HEIL STREET ON AN INCREASE SPEEDS LIST pertains to their
opinion that the lower speeds are unjustified , and further , that
this Council ' s unanimous vote to do so was: an ARBITRARY ACTION .
3 ) We reject staff ' s presumptions to know what i's best for our community ' s
QUALITY OF LIFE . Increasing speeds. on residentially connected streets
NEVER IMPROVED THE ENVIRONMENT OR NEIGHBORHOOD TRANQUILLITY .
4) WE ASK. THIS COUNCIL TO INTERCEDE I:N THIS MISGUIDED STAFF EXERCLSE ,
TODAY .
5 ) We ask that you rescind the two ordnances mentioned in E- 13 , or at
least find an Administrative-Executive procedure which will REMOVE
HEIL STREET from th.eir effects .
6 ) We ask that you _RESTORE ORDNANCE #3383 wh.ich insured Heil Street
with 35MPH from Saybrook to. Newland .
7 ) We regard 35MPH signage as a DETERRENT FACTOR to speeders . Our
excellent police patrols cannot cover Heil 365/24 . . . the signs never
leave . Further our police patrols can use Radar controls on all
of the main north/south streets which . INTERSECT HEIL . I suggest
Springdale and Edwards , and Bolsa Chica Road.. Have your pads ready .
8) I suggest a perusual of our City ' s Organization Chart :

BACK IN11OCTOBER 1997 through January 1998 , our Heil Street Corridor
community petitioned th:e Huntington Beach City. Council to decrease the
speed limits from 45MPH to 25M.PH . We were given 35MPH , with a unanimous
council;livote . We believed that we would not ever have to revisit this
issue with City Hall , but we were in for a City H.all surprise when we
noticedi' 40MPH signs east of Bolsa Chica Road . We asked Mayor Houchen and
council
lhow this happened , and why , and. were finally told that .over Christmas
2000 , Traffic suggested the higher speeds, and this council with 2 new
members ; went alo.ng with their decision/recommendation . (.2 council absent )
We. havela number of objections and observations to make :
1 ) Why,lis Heil Street such a TARGET for higher speeds ?
2 ) Heil, is a RESIDENTIAL ACCESS STREET , period . ( non-debateable issue,
3 ) Hei;l, is geographically .vit.al. to our NEIGHBORHOOD ' s 3 , 000 school -age
children . Heil has a village-type character deserving protection .
4 ) Heil street impacts : Harbour , Bonaventure , . Springview, Sunview and
Weslimont , .plus Meadowlark Private .
5 ) Thelselectivity of 35MPH for Harbour (.W . B.olsa Chica ) is no.ted ; we
object to 40MPH for Westmont ,. on the east side . for OBVIOUS reasons .
6 ) Whyithe preferential treatment?
7 ) Why',�, is Springdale to Edwards not recognized as a SEGMENT of Heil
that requires special attention? (TWO SCHOOLS , PLUS CHRIS CARR PARK)
8) Those of us whose observations are based on a 365/24 life exposure to
Hei;li Streets object to city staff attitudes connected with our residents '
JUS:;fIFIABLE and REASONABLE requests for a SAFER , SENSIBLE SPEED LIMIT
for'itraffic coming into our neighborhood .
9 ) We object to city staff and -city government oractices which have allowed
some faceless , nameless employees to NULLIFY , TO CANCEL OUT the work
of our neighborhood, as well as our City Council ' s unanimous approval
of 35MPH for ALL OF HEIL STREET .
Your recommendations to our City Council must CORRECT the current 40MPH .
Your recommendations should acknowledge the egregious mistake perpetrated
on the Huntington Beach City Council because of bad , and. incomplete
information from Traffic . I am of the opinion that our City CouncW' s
actions'iin our neighborhood ' s behalf back in January 1998 , which in essence
rejected Traffic ' s evaluations of Heil Street speed limits , is a kind of
cheap salve-face exercise . This is a stupid , ridiculous waste of taxpayer ' s
monies ' pa wasteful use of city staff time , and most certainly a gross waste
of volunteer commissioners like yourselves , and of course , a direct slap at
City Council actions which benefit a Heil Street neighborhood like ours .
We hope`;for , and expect your positiv.e , and correct , response to our request
for 35MP'H on Heil except for 30MPH between Springdale and Edwards for the
reasons '!cited above .
