STATEMENT OF ISSUE•
An Ordinance is required to amend the speed limits on certain streets and to make other
corrections as needed.
RECOMMENDED COUNCIL ACTION:
1. Adopt Ordinance Number 3,2, 30 amending Chapter 10.12 of the Huntington Beach
Municipal Code.
ANALYSIS
A traffic and engineering survey was performed on certain streets, as required by the California
Vehicle Code, and the results of those surveys are indicated in the attached Legislative Draft.
Traffic and engineering surveys must be completed every five years to allow the use of radar
for traffic speed enforcement. Failure to update the surveys invalidates radar-enforced speeding
citations and forces the Police to "pace" the violator to enforce speed limits. Pacing is
i considered an impractical enforcement method for logistical reasons. These recommended speed
limit changes have been reviewed and approved by the Transportation Commission at their
November 9, 1993 meeting.

Seventeen street segments will increase from 40 miles per hour to 45 miles per hour. These
segments are Edinger from Bolsa Chica to Graham, Edinger from Graham to Springdale,
Edinger from Springdale to Edwards, Edinger from Edwards to Goldenwest, Edwards from
Edinger to McFadden, Edwards from McFadden to Bolsa, Goldenwest from Heil to Edinger,
Goldenwest from Edinger to McFadden, Goldenwest from McFadden to Bolsa, Graham from
Heil to Edinger, Heil from Bolsa Chica to Graham, Heil from Graham to Springdale, Heil from
Springdale to Edwards, Heil from Edwards to Goldenwest, Heil from Goldenwest to Gothard,
McFadden from Goldenwest to Gothard, and Talbert from Beach to Newland.
Two street segments will increase from 40 miles per hour to 50 miles per hour. These segments
are Edinger from West City Limit to Saybrook, and Edinger from Saybrook to Bolsa Chica.
One street segment will increase from 45 miles per hour to 50 miles per hour. This segment is
Bolsa from Springdale to Edwards.
Two street segments will be reduced from.55 miles per hour to 50 miles per hour. These
segments are Bolsa Chica from Edinger to McFadden, and Bolsa Chica from McFadden to
Bolsa.
Nine street segments will be reduced from 50 miles per hour to 45 miles per hour. These
segments are Garfield from Newland to Magnolia, Garfield from Bushard to Brookhurst,
Garfield from Brookhurst to Ward, Goldenwest from Palm to Yorktown, Goldenwest from Slater
to Warner, Palm from Goldenwest to Ofelia, Palm from Ofelia to Cherry Hill, Palm from
Cherry Hill to Sea Point, and Yorktown from Newland to Magnolia.
One street segment will be reduced from 45 miles per hour to 40 miles per hour. This segment
is Edwards from Varsity to Slater.
Three street segments will be reduced from 40 miles per hour to 30 miles per hour. These
segments are Center from Gothard to Huntington Village Lane, Center from Huntington Village
Lane to One Pacific Plaza, and Center from One Pacific Plaza to the I-405 offramp.
FUNDING SOURCE:
Funds are available in Account Number E-AA-PW-416-3-04-00 to change posted speed limits
as appropriate.

ALTERNATIVE ACTIONS:
1. Take no action or set arbitrary speed limits. This action will disallow the use of radar
for speed enforcement on the effected street segments.

engineering and traffic survey of the portions of the streets hereinafter set forth, the city
council determines and declares that the prima facie speed limit of twenty-five (25) miles per
hour would facilitate the orderly movement of vehicular traffic and would be reasonable and
safe upon said streets and that the prima facie limit of speed on a portion of the following
streets as listed in section 10.12.080 shall be and is twenty-five (25) miles per hour.

and declares that a speed greater than the prima facie speed limit of twenty-five (25) miles per
hour would facilitate the orderly movement of vehicular traffic and would be reasonable and
safe upon said streets; that a prima facie limit of thirty (30) miles per hour is the most
appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that
the prima facie limit of speed on a portion of the said streets as listed in section 10.12.080
shall be and is thirty (30) miles per hour.

hour would facilitate the orderly movement of vehicular traffic and would be reasonable and
safe upon said streets; that a prima facie limit of fifty (50) miles per hour is the most
appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that
the prima facie limit of speed on a portion of the said streets as listed in section 10.12.080
shall be and is fifty (50) miles per hour.
10.12.065 Fifty-Five m.p.h. prima facie speed limit. Upon the basis of an
engineering and traffic survey of the portions of the streets hereinafter set forth, the city
council determines and declares that a speed greater than the prima facie speed limit of
twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and
would be reasonable and safe upon said streets; that a prima facie limit of fifty-five (55) miles
per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable
and safe; and that the prima facie limit of speed on a portion of the said streets as listed in
section 10.12.080 shall be and is fifty-five (55) miles per hour.
10.12.070 Speed limits on state highways. The State of California has established that
orderly movement of vehicular traffic and would be reasonable and safe upon said streets and
that the prima facie limit of speed on a portion of the following streets as listed in section
10.12.080 shall be and is as listed in section 10.12.080.
10.12.080 Speed limits enumerated. Streets are listed alphabetically and
categorized up (North) and to the right (East).

One street segment will increase from 45 miles per hour to 50 miles per hour. This segment is
Bolsa from Springdale to Edwards.
One street segment will be reduced from 55 miles per hour to 50 miles per hour. This segment
is Bolsa Chica from Edinger to McFadden.
Eleven street segments will be reduced from 50 miles per hour to 45 miles per hour. These
segments are Garfield from Newland to Magnolia, Garfield from Bushard to Brookhurst,
Garfield from Brookhurst to Ward, Goldenwest from Palm to Yorktown, Goldenwest from Slater
to Warner, Magnolia from Indianapolis to Atlanta, Magnolia from Yorktown to Adams, Palm
from Goldenwest to Ofelia, Palm from Ofelia to Cherry Hill, Palm from Cherry Hill to Sea
Point, and Yorktown from Newland to Magnolia.
Three street segments will be reduced from 40 miles per hour to 30 miles per hour. These
segments are Center from Gothard to Huntington Village Lane, Center from Huntington Village
Lane to One Pacific Plaza, and Center from One Pacific Plaza to the I-405 offramp.

AMENDING CHAPTER 10.12 OF THE HUNTINGTON BEACH
ORDINANCE CODE PERTAINING TO SPEED LIMITS ON CITY STREETS.
The City Council desires to establish new prima facie speed limits on certain public
streets within the city;
NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as
follows:
SECTION 1. That Chapter 10.12 of the Huntington Beach Municipal Code is hereby
amended to read as follows:

10.12.065 Fifty-Five m.p.h. prima facie speed limit. Upon the basis of an engineering

and declares that a speed greater than the prima facie speed limit of twenty-five (25) miles per
hour would facilitate the orderly movement of vehicular traffic and would be reasonable and
safe upon said streets; that a prima facie limit of fifty-five (55) miles per hour is the most
appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the
prima facie limit of speed on a portion of the said streets as listed in section 10.12.080 shall be
and is fifty-five (55) miles per hour.
10.12.070 Speed limits on state highways. The State of California has established that
orderly movement of vehicular traffic and would be reasonable and safe upon said streets and
that the prima facie limit of speed on a portion of the following streets as listed in section
10.12.080 shall be and is as listed in section 10.12.080.

This memorandum is to inform Council that the Public Works Department has
made the following changes in the "ANALYSIS" portion of the "City Wide Speed
Limit Ordinance" since its introduction on February 28, 1994. The changes are
reflected in the Legislative Draft by the crossing out (strikeout) of old data and
bold larger type for the new data,

and declares that a speed greater than the prima facie speed limit of twenty-five (25) miles per

safe upon said streets; that a prima facie limit of forty (40) miles per hour is the most
appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that

hour would facilitate the orderly movement of vehicular traffic and would be reasonable and
safe upon said streets; that a prima facie limit of fifty (50) miles per hour is the most
appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that
the prima facie limit of speed on a portion of the said streets as listed in section 10.12.080
shall be and is fifty (50) miles per hour.
10.12.065 Fifty-Five m.p.h. prima facie speed limit. Upon the basis of an
engineering and traffic survey of the portions of the streets hereinafter set forth, the city
council determines and declares that a speed greater than the prima facie speed limit of
twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and
would be reasonable and safe upon said streets; that a prima facie limit of fifty-five (55) miles
per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable
and safe; and that the prima facie limit of speed on a portion of the said streets as listed in
section 10.12.080 shall be and is fifty-five (55) miles per hour.
10.12.070 Speed limits on state highways. The State of California has established that
orderly movement of vehicular traffic and would be reasonable and safe upon said streets and
that the prima facie limit of speed on a portion of the following streets as listed in section
10.12.080 shall be and is as listed in section 10.12.080.

In an effort to maintain a safe environment in our city,the Police Department, in conjunction
with the City Attorney's Office, has prepared an ordinance prohibiting vehicular cruising.
RECOMMENDATION:
Respectfully request the City Council approve the Huntington Beach Municipal Code Chapter
10.22.
ANALYSIS:
Much time and law enforcement resources are expended on alleviating traffic congestion in areas
affected by cruising. The occurrence is seasonal and mainly impacts the Downtown Area but
could affect other areas at anytime. Although penal and vehicle codes could be employed to
control vehicular cruising, this is insufficient to directly address the problem. Also, the actual
costs incurred in connection with these services could be recovered with its adoption.
Other cities with vehicular cruising problems have also found that their incidents of crime have
decreased dramatically with the use of a similar ordinance.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH ADDING
CHAPTER-10.22 TO THE HUNTINGTON BEACH MUNICIPAL
CODE PERTAINING TO CRUISING
The City Council of the City of Huntington Beach does ordain as follows:
SECTION 1. That Chapter 10.22 is hereby added to the Huntington Beach Municipal
Code, said Chapter to read as follows:

CONTROL OF VEHICULAR CRUISING

10.22.010 Cruising Prohibited. The ranking peace officers on duty within any area
affected by traffic congestion may, having determined that such area is so affected, establish
one or more traffic control points on or near such area to regulate cruising.
10.22.020 Cruising Defined. "Cruising" is defined to mean the driving of a motor vehicle
three or more times within a four hour period past a traffic control point so established on a
portion of any street identified as subject to cruising controls by signs posted at the beginning
and end of the controlled roadway, that briefly and clearly state.the appropriate provisions of
this Chapter and Section 21100(k) of the Vehicle Code, and after the operator of the vehicle
has been given the notice specified in this chapter.
10.22.030 Elements of the Offense. No person, having driven a motor vehicle past a
traffic control point established pursuant to this chapter twice within any four-hour period, and
having received written notice that further driving past the traffic control point will constitute a
violation of this chapter, shall drive past that control point within the time period in which
cruising controls are in effect. Each successive trip past the traffic control point shall constitute
a separate violation of this chapter, and no additional notice shall be required prior to issuance
of a second or subsequent citation.
10.22.040 Exemptions. The provisions of this chapter shall not apply to:
(a) Any authorized vehicle as defined in Section 165 of the Califomia Vehicle Code.
(b) Any publicly owned vehicle of any city, county, district, state or federal agency;

(c) Any vehicle licensed for public transportation or vehicles which are normally
used for business purposes and are engaged in such business use.
10.22.050 Designated Streets. The provisions of this chapter shall apply to the following
locations at which there exist signs which clearly identify the beginning and end of the portion
of the street subject to cruising controls and state the appropriate provisions of the Califomia
Vehicle Code and this ordinance.
10.22.060 Penalty. It shall be an infraction for any person to violate this chapter, and
upon conviction thereof shall be subject to the payment of penalties as provided in Section
42001 of the Vehicle code and as that section may be amended.
SECTION 2. This ordinance shall take effect 30 days after its adoption.

having received written notice that further driving past the traffic control point will constitute a

cruising controls are in effect. Each successive trip past the traffic control point shall constitute
a separate violation of this chapter, and no additional notice shall be required prior to issuance
of a second or subsequent citation.
10.22.040 Exemptions. The provisions of this chapter shall not apply to:
(a) Any authorized vehicle as defined in Section 165 of the California Vehicle Code.
(b) Any publicly owned vehicle of any city, county, district, state or federal agency;

In an effort to maintain a safe environment in our city,the Police Department, in conjunction
with the City Attorney's Office, has prepared an ordinance prohibiting vehicular cruising.
RECOMMENDATION•
Respectfully request the City Council approve the Huntington Beach Municipal Code Chapter
10.22.
ANALYSIS:
Much time and law enforcement resources are expended on alleviating traffic congestion in areas
affected by cruising. The occurrence is seasonal and mainly impacts the Downtown Area but
could affect other areas at anytime. Although penal and vehicle codes could be employed to
control vehicular cruising,this is insufficient to directly address the problem. Also,the actual
costs incurred in connection with these services could be recovered with its adoption.
Other cities with vehicular cruising problems have also found that their incidents of crime have
decreased dramatically with the use of a similar ordinance.

Not applicable.
ALTERNATIVE ACTIONS:
Do not approve the proposed ordinance.

STATEMENT OF ISSUE:
An Ordinance is required to amend the speed limits on certain streets and to make other
corrections as needed.
RECOMMENDED COUNCIL ACTION:
Adopt Ordinance Number amending Chapter 10.12 of the Huntington Beach
Municipal Code.
ANALYSIS:
A traffic and engineering survey was performed on certain streets, as required by the
California Vehicle Code, and the results of those surveys are indicated in the attached
Legislative Draft. Traffic and engineering surveys must be completed every five years to
allow the use of radar for traffic speed enforcement. Failure to update the surveys
invalidates radar-enforced speeding citations and forces the Police to "pace" the violator to
enforce speed limits. Pacing is considered an impractical enforcement method for logistical
reasons. These recommended speed limit changes have been reviewed and approved by
the Transportation Commission at their October 19, 1994, meeting.

The City Council desires to establish new prima facie speed limits on certain public
streets within the city;
NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as
follows:
SECTION 1. That Section 10.12.08 of Chapter 10.12 of the Huntington Beach
Municipal Code is hereby amended to read as follows:

traffic survey of the portions of the streets hereinafter set forth, the City Council determines and
declares that the prima facie speed limit of twenty-five(25) miles per hour would facilitate the
orderly movement of vehicular traffic and would be reasonable and safe upon said streets and that
the prima facie limit of speed on a portion of the following streets as listed in Section 10.12.080

10.12.020 Thirty m.p.h. prima facie speed limit. Upon the basis of an engineering and traffic
survey of the portions of the streets hereinafter set forth, the City Council determines and declares
that a speed greater than the prima facie speed limit of twenty-five(25) miles per hour would
facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said
streets; that a prima facie speed limit of thirty(30) miles per hour is the most appropriate to
facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit
of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is thirty(30)
miles per hour (1935-11/74, 1947-12/74, 1997-9/75, 2066-7/76, 2388-9179, 2432-6/80, 2527-2/82, 3133-8/92,
3230-4/94)

facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said
streets; that a prima facie speed limit of fifty-five(55) miles per hour is the most appropriate to
facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit
of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is fifty-five(55)

10.12.070 Speed limits on state highways. The State of California has established that orderly
movement of vehicular traffic requires that a reasonable and safe limit be placed upon said streets
and that the prima facie limit of speed on a portion of the following streets shall be and is as listed
