I moved into my house on April 1st , 1997 and within . a Month my family and I witnessed a terrible accident right next to our house . A young man driving a brand new pick- up plowed into the house next door to oars . It is a miracle that no one was badly injured . However , the property damage was huge . Also my wife and children had been rollerblading right at the spot where the truck ran up onto the sidewalk at a high rate of speed . They could easily have been killed. Now we hear that the speed limit has gone up to 45 mph . This was a terrible decision . The city is risking the life of it ' s residents so that others can speed to and fro . This is not good policy. I am a law enforcement officer and can tell when a vehicle is speeding . Mr . XMMY Mayor they speed around here all of the time ! ! ! Please consider lowering the speed limit . As a matter of fact , do not just consider it , do it . This is what we want , the residents that live on this avenue . In the hours of 3p to 7p we have very heavy traffic . We can live with the traffic , but not- when many of the drivers are violet ing the law . Your Traffic Bureau has records on the many accidents that occur in this area . Not only on the intersections but along the main stretches of road , and the amount of parked cars that have been hit . What you don ' t know about is all of the close calls that we witness by 3 living here . fY I have seen vehicles traveling at 60 and 70 and possibly faster along our stretch of Heil . Ralph Bauer and City Council Members City of Huntington Beach —'- 2000 Main Street 7i c-:—+rn �cn Huntington Beach, Ca . 92648 r.= ; W Dear Sirs , Lao As a registered voter and property owner , I wish to add my voice to the growing chorus calling for more realistic traffic controls on Heil Avenue . The situation that presently exists is nothing short of scandalous . The present 45 MPH speed limit is much to high. Not only is it routinely ignored and only randomly enforced, but , vehicles thundering along at speeds in excess of 60 MPH, through school zones and other sensitive public areas are commonplace , especially during rush hours . According to official records , this street has been the site of several deaths and numerous accidents with serious injuries . How much more blood must be shed before common sense prevails and steps are taken to reduce the risk to both residents and the gen- eral public . Enough of endless study groups and conferences . Take action now to reduce the speed limit to 35 MPH. And then enforce it before further needless tragedy occurs . The Council approved the introduction of this ordinance with an amendment to remove Heil Avenue. Staff believes the intent of the Council was to leave Heil Avenue in the ordinance with the current speed limits in place, to proceed with the adoption of Ordinance No. 3380, and to return to Council at a later date after further investigation of the Heil Avenue speed limit issue. Funding Source: NA Recommended Action: Adopt Ordinance No. 3380 while leaving the existing speed limits on Heil Avenue in place until further investigation. Alternative Action(s): 1. Suggest alternative speed limits. This action will disallow the use of radar for speed enforcement on the effected street segments. 2. Receive and file this document. REQUEST FOR COUNCIL ACTION MEETING DATE: December 1, 1997 DEPARTMENT ID NUMBER:PW 97-080 Analysis: At the November 17, 1997, Council meeting, the City Wide Speed Limit Ordinance (No., 3380) was presented to the Council. The Council approved the introduction of this ordinance with an amendment to remove Heil Avenue. Staff believes the intent of the Council was to leave Heil Avenue in the ordinance with the current speed limits in place, to proceed with the adoption of Ordinance No. 3380, and to return to Council at a later date after further investigation of the Heil Avenue speed limit issue. If the Heil Avenue segment is removed from this ordinance, California Vehicle Code (CVC) §22358 and §22350 would take precedence. Section 22358 would set the speed limit on Heil Avenue at 65 miles per hour. Section 22350 would allow the Police Department to enforce a speed which is reasonable and prudent but would not allow the use of radar for speed enforcement. Public Works will be meeting with the Traffic Enforcement Division of the Police Department to determine if it is feasible to lower the speed limit to 35 miles per hour while keeping the ability to use radar to enforce the speed limit. We anticipate returning to Council with the Heil Avenue speed limit issue in January 1998. Before I conclude , I ask that you consider the following points : a Speeders could be easily monitored , and cited , by a computerized camera system , such as the one being used in Pasadena . a There is a psychological connection in speed sign numbers : the 35, 40, 45 and up numbers tend to empower and allure the heavy pedal crowd ; on the other hand , 25MPH calms , encourages caution and restraint . REQUEST FOR COUNCIL ACTION MEETING DATE: November 17, 1997 DEPARTMENT ID NUMBER:PW 97-080 Analysis: A traffic and engineering survey was performed on certain streets, as required by the California Vehicle Code, and the results of those surveys are indicated in the attached Legislative Draft. Traffic and engineering surveys must be completed every five years to allow the use of radar for traffic speed enforcement. Failure to update the surveys invalidates radar-enforced speeding citations and forces the Police to "pace" the violator to enforce speed limits. Pacing is considered an impractical enforcement method for logistical reasons. The City Council desires to establish new prima facie speed limits on certain public streets within the city; NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. That Chapter 10.12 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.12.010 Twenty-five m.p.h. prima facie speed limit. There are several reasons for this request; We have several accidents each month, especially at the comer of Heil & Del Mar. We no longer attempt to turn left onto Del Mar from Heil because of so many near rear end collisions. Vehicles have even been known to park in an occasional bathroom at this corner! Most evenings we can hear people launching on their brakes attempting to stop for the stop sign on Heil & Graham. This occurs in the early Am.'s as well. Parking our vehicles on Heil in front of our home is treacherous as well. We have regular close calls by cars traveling too fast and too far inside the bike lane. Crossing at Heil and Graham is a hazard too, nearly impossible, especially for the children. Motorist need restraint, speed limits need to be enforced! During that period I have witnessed the result of many accidents at this intersection. In one instance a girl was riding a moped and turning left onto Del Mar. Unfortunately for her the car behind her was going too fast and was unable to stop in time before hitting her. One of the things that sticks in my mind about this collision is her leg being bent 90' in the wrong direction. Another more recent accident involved a 16 yr old male missed the left turn onto Del Mar and collided with the corner house. He was going fast enough to completely destroy the front bathroom. If there was someone in that bath- room they would be dead. The reason for this letter is to bring some attention to this intersection and the lack of speed enforcement along this stretch of Heil Ave. Every day from about 4pm until 8pm there is a constant flow of traffic going far above the posted speed limit. I think that more enforcement and a stop sign (or flashing yellow light) would greatly reduce the number of accidents and "near misses" that occur. My wife and I are expecting our first baby. Perhaps it would be a good idea to consider a "Center Turn Lane" on Heil, particularly between Springdale and Bolsa Chica.
