REQUEST FOR COUNCIL ACTION MEETING DATE: January 20, 1998 DEPARTMENT ID NUMBER:PW 98-010 Analysis: At the City Council meeting of December 1, 1997 the City Council approved Ordinance No. 3380 amending Chapter 10.12 of the Huntington Beach Municipal Code by leaving the speed limits on Heil Avenue as is. At that same meeting they directed staff to investigate the possibility of lowering the speed limit on Heil Avenue to 35 miles per hour. Speed limits in California are set in accordance with the California Vehicle Code and the process is described in the California Department of Transportation, Traffic Manual. Any speed limit not set by the methods described in the above-mentioned references can not be enforced by the use of radar. The Public Works Department met with the Traffic Enforcement Bureau of the Huntington Beach Police Department. Both departments agree that any speed limit not set according to an Engineering and Traffic Survey can not be enforced with the use of radar. If Heil Avenue is set at 35 miles per hour, the use of radar for speed enforcement will not be allowed. Public Works submitted a Request For Legal Services (see attachment No. 1) requesting an opinion on the Heil Avenue speed limit issue. The City Attorney's opinion states that, if speed limits are not set according to an Engineering and Traffic Survey, they can not be enforced by the use of radar. Setting the speed limit on Heil Avenue at 35 miles per hour is not in conformance with the California Vehicle Code and the California Traffic Manual and therefore disallows the use of radar for speed enforcement. An Engineering and Traffic Survey was performed on Heil Avenue, as required by the California Vehicle Code, and the results of that surrey are indicated in the Legislative Draft (see attachment No. 4). An additional Legislative Draft is included showing a speed limit of 35 miles per hour. This additional Legislative Draft reflects the speed limit request by the residents who live in the vicinity of Heil Avenue. Engineering and Traffic Surveys must be completed every five years to allow the use of radar for traffic speed enforcement. Failure to update the surveys invalidates radar-enforced speeding citations and forces the Police to "pace" the violator to enforce speed limits. Pacing is not as productive an enforcement method as the use of radar. The recommended speed limit changes, indicated in attachment No. 4, have been reviewed and approved by the Public Works Commission, 5-0, at their August 20, 1997, meeting. A typographical error occurred in Ordinance No. 3380 and the corresponding Legislative Draft. This error set the speed limit on Newland Street between Adams Avenue and Indianapolis Avenue at 50 miles per hour. To correct this error the above-mentioned street segment is included in the attached Legislative Draft and Ordinance setting the speed limit to 45 miles per hour. An Ordinance is required to amend the speed limits on certain streets and to make other corrections as needed. In addition to the Ordinance, a Legislative Draft is also prepared by the City Attorney's Office. The staff, pursuant to California Vehicle Code section 22349, utilizes the procedures described in Chapter 8 of the California Department of Transportation Traffic Manual. ISSUE: Is the process outlined in chapter 8 of the California Department of Transportation Traffic Manual the only method available to the City to determine acceptable speed limits and enforce those speed limits using radar or electronic devices? ANSWER: Yes, the California Vehicle Code sets forth the precise mechanism for establishment and enforcement of speed limits. Pursuant to California Vehicle Code section 22349(a) "Except as provided in section 22356, no person shall drive a vehicle upon a highway at a speed greater than 65 miles per hour." Pursuant to California Vehicle Code section 22358, the City may reduce the speed limit by ordinance and declare a prima facie speed limit of 50, 45, 40, 35, 30, or 25 miles per hour, whichever: is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe, upon the basis of an engineering and traffic survey. The prima facie limit is effective when appropriate signs giving notice thereof are erected upon the streets. The prima facie speed limit is enforced by the Police Department; however, absent a valid engineering and traffic survey conducted within five years prior to the date of the allegedspeed violation, any evidence obtained via radar or other electronic device will not be admissible in court to establish the violation. California Vehicle Code sections 40802 and 40803. California Vehicle Code section 40802 defines a speed trap as "prima facie speed limit provided by this code or by local ordinance . . . . which speed limit is not justified by an engineering and traffic Page 2 Les Jones RLS 97-924 survey conducted within five years prior to the date of the alleged violation, and where enforcement involves the use of radar or other electronic devices which measure the speed of moving objects." Califomia Vehicle Code section 40803(a) provides "no evidence as to the speed of the vehicle upon a highway shall be admitted in any court upon the trial of any person in any prosecution under this code upon a charge involving the speed of the vehicle when the evidence is based upon or obtained from or by the maintenance or use of a speed trap." CONCLUSION: The California Department Transportation Traffic Manual, Chapter 8, is the only mechanism available to the City to determine acceptable speed limits and enforce said speed limits using radar or electronic devices. Absent a valid engineering and traffic survey, enforcement of any speed limit would be limited to the perceptions of the police officer. The State of California has established that orderly movement of vehicular traffic requires that a reasonable and safe limit be placed upon said streets and that the prima facie limit of speed on a portion of the following streets shall be and is as listed in Section 10.12.080. 10.12.080 Speed limits enumerated. There is ample evidence and historical data to justify the lowering of current speed limits on Heil Avenue between Saybrook Lane and Beach Boulevard. The number, frequency and magnitude of traffic fatalities and accidents along this corridor warrant this action. I move that the speed limit along Heil Avenue between Saybrook Lane and Beach Boulevard be posted and enforced at a "not to exceed 35 miles per hour," and that this Council action be reviewed in one year. As we have indicated to you in meetings since October, the 45MPH signage has invited speeders who are emboldened to sixty-seventy MPH past our homes and school yards. Last week, we experienced a 3-car crash at the corner of Heil and Springdale, very near to CarrPark. You ladies and gentlemen: on this council are our best hope to have the situation remedied . The agenda item proposal is for 35MPH on Heil . This is not good enough. Therefore, onetagain we ask that you consider the following wring your discussion later on this evening. 1 . That you seven act in our behalf as Governors of our Neighborhood Association, and 2. That you AMEND THE PROPOSAL BEFORE YOU TO "25MPH" as we have requested, and 3. That you direct Traffic and Public Works to post 25MPH signs, beginning at Saybrook and ending at Newland. 4. Having accomplished this task, you will have earned the GOOD GOVERNANCE- GOOD CITY MANAGEMENT AWARD for 1998--your FIRST this year. Our request is not without precedent. If one drives south on lain Street, just south of Yorktown, a driver is immediately faced with 25MPH signs--all the way down Main to PCH. On Olive street one finds STOP SIGNS at every other intersec- tion, and one also finds neighborhood traffic speeds totally controlled. This is the kind of environment we ask for Heil Street. Tonight if you act in our behalf, you will not have to re-visit this issue again next year. The signs will become a part of the Heil street scenery, and you can move on to other matters such a Springdale Street. I have asked before for this , and so I ask again: remove the TRUCK ROUTE signage from Springdale, and lower the speeds to 35MPH. The prevailing situation there with Carr Park, the Schools and Marina High School--extremely dense foot traffic, is a disaster hanging in the wings. I believe in PREVENTIVE MEDICINE, and I am sure you do as well . Your intercession in this matter is preventive medicine of a kind, therefore, I urge you to act on our request for 25MPH signage without further hesitation.
