Statement of Issue: The adoption of a new ordinance is required to amend the speed limits
on certain streets and to make other corrections as needed.
Funding Source: Funds are available in the Traffic Maintenance Program to change posted
speed limits as necessary.
Recommended Action: Motion to adopt Ordinance Number 3 amending Chapter 10.12
of the Huntington Beach Municipal Code.
Alternative Action(s):
1. Do not approve the ordinance.
2. Suggest alternative speed limits. This action will disallow the use of radar for speed
enforcement on the effected street segments.
3. Receive and file this document.
Analysis: Traffic and engineering surveys were performed on certain streets, as required by
the California Vehicle Code, and the results of those surveys are indicated in the attached
Legislative Draft. A legislative draft indicates additions to the ordinance by bold face type
two points larger and deletions to the ordinance by #. In some cases street
segments are shown as being removed from the ordinance. These street segments are
included in the preceding segment and have the same speed limit.

Traffic and engineering surveys must be completed every five years to allow the use of radar
for traffic speed enforcement. Failure to update the surveys invalidates radar-enforced
speeding citations and forces the police to pace the violator to enforce speed limits. Pacing is
considered an impractical enforcement method for logistical reasons.
The recommended action on Newland Street speed limit responds to the City Council's
request made at its July 19, 1999 meeting. The attached Public Works Commission report
provides information regarding the history of the Newland Street speed limit.
On Edwards Street, the recommended action applies a constant limit of 40 mph to the entire
length of the street. This action follows the City Council motion on September 7, 1999, that
established a temporary 40 mph limit. The Police and Public Works Departments agree on this
more permanent solution.
The limits on Orange Avenue were reduced as the result of a request for additional traffic
controls between 19' and 21st Streets. Traffic studies do not warrant control devices, but the
speed limit between 17th and Goldenwest Street is reduced from 40 mph to 30 mph.
Public Works Commission Review: The Commission reviewed and recommended
approval of the lowered speed limits on 9/15/99 by a 7-0 vote as follows:

engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council
determines and declares that a speed greater than the prima facie speed limit of twenty-five (25)
miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon said streets; that a prima facie speed limit of thirty(30) miles per hour
is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe;
and that the prima facie limit of speed on a portion of the said streets as listed in Section
10.12.080 shall be and is thirty(30) miles per hour.
10.12.030 Thirty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of
an engineering and traffic survey of the portions of the streets hereinafter set forth, the City
Council determines and declares that a speed greater than the prima facie speed limit of
twenty-five(25)miles per hour would facilitate the orderly movement of vehicular traffic and

miles per hour would facilitate the orderly movement of vehicular traffic and would be

the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and
that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080
shall be and is fifty(50) miles per hour.
10.12.065 Fifty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an
engineering and traffic survey of the portions of streets hereinafter set forth, the City Council
determines and declares that a speed greater than the prima facie speed limit of twenty-five (25)
miles per hour would facilitate the orderly movement of vehicular traffic and would be
reasonable and safe upon said streets; that a prima facie speed limit of fifty-five (55) miles per
hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and
safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section
10.12.080 shall be and is fifty-five (55) miles per hour.
10.12.070 Sneed limits on state highways. The State of California has established that orderly
movement of vehicular traffic requires that a reasonable and safe limit be placed upon said streets
and that the prima facie limit of speed on a portion of the following streets shall be and is as
listed in Section 10.12.080.
10.12.080 Speed limits enumerated. Streets are listed alphabetically and categorized up (North)
and to the right (East). An asterisk (*) denotes speed limit not set by survey.

AMENDING CHAPTER 10.12 OF THE HUNTINGTON BEACH MUNICIPAL
CODE PERTAINING TO SPEED LIMITS
The City Council of the City of Huntington Beach does hereby ordain as follows:
SECTION 1. Section 10.12.080 of the Huntington Beach Municipal Code is hereby
amended to read as follows:
10.12.080 Speed limits enumerated. Streets are listed alphabetically and categorized up
(North) and to the right (East). An asterisk (*) denotes speed limit not set by survey.

Street

Statement of Issue: Staff has identified the need to revise speed limits on Newland Street
to address inconsistencies in the posted speed limit between the Cities of Huntington
Beach and Fountain Valley and provide a more uniform speed limit posting between
Adams Avenue and Warner Avenue.
Funding Source: Funds are available in the Department's operating budget for these
modifications.
Recommended Action: Motion to concur with staff s recommendation to revise the
posted speed limits along Newland Street and recommend that the City Council take
appropriate actions to implement the speed limit changes. The recommended changes
include:
1) Consolidate six existing speed zone segments between Adams Avenue and Warner
Avenue into the following three segments:
o Adams Avenue to Garfield Avenue
o Garfield Avenue to Talbert Avenue
o Talbert Avenue to Warner Avenue
2) Revise the posted speed limit on Newland Street between Adams Avenue and
Garfield Avenue to 45 miles per hour (existing posted speed limit 45 mph-Adams
to Yorktown, 50 mph-Yorktown to Garfield)
3) Revise the posted speed limit on Newland Street between Garfield Avenue and
Talbert Avenue to 45 miles per hour (existing posted speed limit— 50 mph
southbound, 45 mph northbound)
4) Revise the posted speed limit on Newland Sreet between Talbert Avenue and
Warner Avenue to 45 miles per hour (existing posted speed limit 45 mph - Warner
to Slater southbound, 50 mph - Slater to Talbert southbound, 45 mph Warner to
Talbert northbound).

History: The following provides a history of the posted speed limits on Newland Street
in the area between Adams Avenue and Warner Avenue:

Analysis: City Staff has performed the three required elements used to establish posted
speed limits in accordance with procedures adopted by the State of California. The three
elements used to establish speed limits are:
1. Sample existing travel speeds at a representative location within the roadway
segment.
2. Review the street segment to identify roadway characteristics and conditions that
may not be readily apparent to motorists.
3. Review accident history.
The review of existing travel speeds is used to establish a baseline speed limit for a
roadway segment. Roadways which do not contain conditions which may not be readily
apparent to motorists and affect the safe operating speed for the street, and do not have an
accident history that may be indicative of these types of conditions, generally have a
posted speed limit based on the 85`h percentile speed or prevailing speed of traffic. When
conditions warrant, the State of California procedures for establishing posted speed limits
allow for posted speed limits to be reduced 5 miles per hour. Applying this reduction
requires engineering evaluation and documentation of conditions to demonstrate the need
for the lowered speed limit.
The following table summarizes the important information obtained for each segment.

Staff has identified several characteristics along each of the roadway segments which may
not be apparent to motorists and that would also make a speed limit posting near the 85`h
percentile speed undesirable under most conditions. The conclusions regarding these
conditions are supported by the calculated 3 year accident rate for the segment between
Warner Avenue and Talbert Avenue which is 3.15 accidents per million vehicle miles
traveled. Comparing this rate to statewide average rates for similar roadways of 2.48
accidents per million vehicle miles traveled reveals that this segment is substantially
higher than the statewide average.
The baseline speed limits for the segment between Adams Avenue and Garfield Avenue,
and Garfield Avenue and Talbert Avenue are 50 miles per hour (the next five mile per
hour increment at or below the 85`h percentile speed). The baseline speed limit for the
segment between Talbert Avenue and Warner Avenue is 45 miles per hour. A portion of
the roadway in both of these segments is in the City of Fountain Valley and is within their
jurisdiction. The northbound lanes (within the City of Fountain Valley) are currently
posted at 45 miles per hour.
Staff believes that the roadway conditions, combined with the need to maintain
consistency in speed limit posting with the City of Fountain Valley, provide sufficient
justification for reducing the posted speed limit an additional 5 miles per hour from the
baseline speed limit between Garfield Avenue and Talbert Avenue. The characteristics
noted for the segment between Adams Avenue and Garfield Avenue create a condition
where travelling at speeds near the 85`h percentile speed do not provide sufficient
opportunity for motorists to react to situations which could arise. Thus, the reduction of
the posted speed limit an additional 5 miles per hour from the baseline speed limit will
provide additional reaction time to motorists. Therefore, the recommended posted speed
limit for these three segments is 45 mile per hour.

and 3) instead, install a white pedestrian crosswalk across Delaware Street at
Frankfort Avenue. Motion approved 7-0.
d. Orange Avenue and 22nd Street—Traffic Control —Tom Brohard gave
presentation and explained that in November 1997, concerned residents requested
consideration of reduction of the posted speed limit on Orange Avenue between
17th Street and Goldenwest Street as well as the installation of stop signs on
Orange Avenue at 22nd Street. It was also requested to have additional
enforcement to deter speeding on Orange Avenue.
A motion by Commissioner Hartge and seconded by Commissioner Smith to 1)
deny the request to install a four-way stop at Orange Avenue and 22nd Street, one
block east of Goldenwest Street, 2) recommend that the City Council consider
reduction of the posted speed limit to 30 miles per hour on Orange Avenue from
17th Street to Goldenwest Street, and 3) to study other intersections along this
portion of Orange Avenue to determine if stop signs should be installed and report
back to the Commission. Motion approved 7-0.
e. Recommended Revisions to Posted Speed Limits on Newland Street—Tom
Brohard gave presentation. He explained that there is a need to revise speed limits
on Newland Street to address the inconsistencies in the posted speed limit
between the cities of Huntington Beach and Fountain Valley and provide a more
uniform speed limit of 45 miles per hour between Adams Avenue and Warner
Avenue.
A motion by Commissioner Smith and seconded by Vice-Chair Gartland to
recommend to the City Council to 1) consolidate six existing speed zone segments
between Adams Avenue and Warner Avenue into three segments: Adams Avenue
to Garfield Avenue, Garfield Avenue to Talbert Avenue, and Talbert Avenue to
Warner Avenue, 2) revise the posted speed limit on Newland Street between
Adams Avenue and Garfield Avenue to 45 miles per hour (existing posted speed
limit 45 mph —Adams to Yorktown, 50 mph —Yorktown to Garfield, 3) revise the
posted speed limit on Newland Street between Garfield Avenue and Talbert
