Ordinance No. 3495 modifies speed limits on several streets, including Heil Avenue east of Beach Boulevard. In response to a citizen request regarding the speed limit on Heil Avenue near Springdale, the City Council voted on May 7, 2001 to reconsider Ordinance No. 3495. Should Council now reaffirm Ordinance No. 3495? Funding Source: Not Applicable. Recommended Action: Motion to: 1. Reaffirm Ordinance No. 3495 which was previously requested for reconsideration, with an effective date to be May 30, 2001, and 2. Direct the Public Works Commission to reconsider the speed limit on Heil Avenue from Saybrook to Beach, and present its recommendation to the City Council. Alternative Action(s): 1. Suggest alternative speed limits. This action will disallow the use of radar for speed enforcement on the affected street segments. 2. Receive and file this document. These surveys must be conducted every seven years and the speed limits posted in accordance with these surveys. The Vehicle Code specifies that engineering and traffic surveys include: 1) Measurement of existing travel speeds at a representative location within the segment. 2) Identification of roadway characteristics and conditions that may not be readily apparent to motorists. 3) Review of the accident history. Ordinance No. 2878 adopted on November 3, 1986 established a speed limit of 40 miles per hour on Heil Avenue from Saybrook to Beach. Ordinance No. 3230 adopted on March 21, 1994 retained a 40 miles per hour speed limit on Heil Avenue from Saybrook to Bolsa Chica and between Gothard and Beach. This ordinance also raised the speed limit on Heil Avenue between Bolsa Chica and Gothard to 45 miles per hour. Ordinance No. 3383 adopted on February 2, 1998 arbitrarily lowered the speed limit on Heil Avenue between Bolsa Chica and Newland to 35 miles per hour. This action prohibited radar enforcement of the speed limit on the segment between Bolsa Chica and Newland. During a review of posted speed limits last summer, staff noted that several streets did not have a valid engineering and traffic survey. In some cases, including Heil Avenue, the posted speed limit had been set unjustifiably below the speed zoning standards. In other cases, some speed limits such as on Palm Avenue were arbitrarily set too high. Additionally, some of the engineering and traffic surveys had expired and other streets had been recently widened, triggering the need for a new survey. On September 20, 2000, the Public Works Commission reviewed speed limits on a number of city streets and supported the staff recommendations to decrease speed limits on eleven street segments and to increase speed limits on seven street segments. An increase in the posted speed limit from 35 to 40 miles per hour on Heil Avenue between Bolsa Chica and Beach was included in the recommendations. Ordinance No. 3479 became effective on December 6, 2000. Except for Heil Avenue in the area of the Orange County Sanitation District construction project, the revised speed limit signing on all other streets was posted by December 11, 2000. Signing on Heil Avenue between Springdale and Golden West Streets was changed from 35 to 40 miles per hour on April 26, 2001. On February 21, 2001, the Public Works Commission reviewed a second group of speed limit changes recommended by staff. On April 2 and 16, the City Council approved the changes contained in Ordinance No. 3495, with these changes to become effective on May 16, 2001. Included in this Ordinance is a revision to the posted speed limit on Heil Avenue east of Beach Boulevard from 35 to 40 miles per hour. At the May 7 City Council meeting, a concerned resident requested that the City Council lower the speed limit to 35 miles per hour on Heil Avenue near Springdale Street. Staff believes that the City Council intended to reconsider the speed limit on Heil near Springdale in response to the concerns expressed, rather than the speed limit adjustment contained in Ordinance 3495 on Heil Avenue east of Beach Boulevard. To this end it would be appropriate to reaffirm Ordinance No. 3495, direct the City's Public Works Commission to reevaluate the speed limit on Heil Avenue from Saybrook to Beach, and report these findings back to the City Council. Should the City Council decide to arbitrarily reduce the speed limit on Heil Avenue, then radar cannot be used for speed enforcement on that street segment. Environmental Status: Not applicable. Chapter 10.12 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.12.010 Twenty-five m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council determines and declares that the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets and that the prima facie limit of speed on a portion of the following streets as listed in Section 10.12.080 shall be and is twenty-five(25) miles per hour. 10.12.020 Thirty m.p.h. prima facie speed limit. Unless stated otherwise, upon the basis of an engineering and traffic survey of the portions of the streets hereinafter set forth, the City Council determines and declares that a speed greater than the prima facie speed limit of twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon said streets; that a prima facie speed limit of thirty(30) miles per hour is the most appropriate to facilitate the orderly movement of traffic and is reasonable and safe; and that the prima facie limit of speed on a portion of the said streets as listed in Section 10.12.080 shall be and is thirty(30) miles per hour. 10.12.030 Thirty-five m.p.h.prima facie speed limit. The State of California has established that orderly movement of vehicular traffic requires that a reasonable and safe limit be placed upon said streets and that the prima facie limit of speed on a portion of the following streets shall be and is as listed in Section 10.12.080. 10.12.080 Speed limits enumerated. Should the City Council adopt an ordinance to make the proposed speed limit revisions on various street segments? Recommended Action: Adopt Ordinance No. -3 amending Chapter 10.12 of the Huntington Beach Municipal Code relating to speed limits. Alternative Action(s): 1 . Do not approve the Ordinance relating to speed limits. 2. Suggest alternative speed limits. This action could disallow the use of radar for speed enforcement on the affected street segments. 3. Receive and file this document. f I 01-039 April 2 Brohard (Speed Limit Ordinance) -2- 03/23/01 10:49 AM . _QUEST FOR COUNCIL ACON MEETING DATE: April 2, 2001 DEPARTMENT ID NUMBER: 01-039 Analysis: City staff has performed the three required elements used to establish posted speed limits in accordance with procedures adopted by the State of California: 1) Sample existing travel speeds at a representative location within the roadway segment; 2) Review the street segment to identify roadway characteristics and conditions that may not be readily apparent to motorists; and 3) Review accident history. The review of travel speeds is used to establish a baseline speed limit for a roadway segment. Roadways that do not contain conditions not readily apparent to motorists, that affect the safe operating speed for the street, and/or that do not have an accident history that may be indicative of these types of conditions, generally have a posted speed limit based on the 85th percentile speed or prevailing speed of traffic. When conditions warrant, the State of California procedures for establishing posted speed limits allow for posted speed limits to be reduced within certain limits. Applying this reduction requires engineering evaluation and documentation of conditions to demonstrate the need for the lowered speed limit. Staff has identified several characteristics along each of the roadway segments which ma not be apparent to motorists and that would also make a speed limit posting near the 85t percentile speed undesirable under most conditions. The conclusions regarding these conditions are supported by the calculated 3-year accident rate for various street segments. The recommended changes include decreased speed limits on the following streets: 1•) 17th Street from Huntington Street to Florida Street, from 35 to 25. 2) Algonquin Street from Warner Avenue to Heil Avenue, from 40 to 35.
