HOPKINS, PE, DIRECTOR O PU1LIC WORKS SUBJECT: AMEND MUNICIPAL CODE SECTION 10.12 - SPEED LIMITS Statement of issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: In August 2008, the City Council completed a revision to the Municipal Code Section 10.12 adopting new speed limits on several streets. Following that action, it was discovered that the revised ordinance did not include one of the speed limit changes identified in the report. This action corrects the ordinance, consistent with the previous review by the City Council. Funding Source: Funds are available in the General Fund Public Works Transportation Division Signs and Markings operating budget to revise speed limit postings as necessary. Recommended Action: Motion to: Approve and adopt Ordinance 3816 An Ordinance of the City of Huntington Beach amending Chapter 10.12 of the Municipal Code relating to speed limits. Alternative Action(s): Adopt posted speed limits different from those recommended and forgo enforcement using speed-measuring devices on amended segments. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 10/20/2008 DEPARTMENT ID NUMBER: PW 08-72 Analysis: Chapter 10.12 of the Municipal Code was amended in August 2008 based on the results of speed limit analyses for 66 street segments within the City. The original July 21, 2008 Request for City Council Action presented a detailed review of the results of the analysis and a summary of each of the recommended speed limits. At the time, four segments were recommended for 5 mile per hour speed limit increases and eight segments were recommended for 5 mile per hour speed limit decreases. One of the eight segments recommended for speed limit reduction was Saybrook — between Humboldt and Edinger. In preparing the legislative draft and final copy of the revised Ordinance, the Saybrook speed limit change was inadvertently omitted. Staff is returning a revised copy of the ordinance including this change to correct this action. A second minor change is the consistent spelling of Goldenwest to one word. Public Works Commission Action: The Public Works Commission reviewed the item at their June 18, 2008 meeting and approved the proposed Update of Speeds Surveys and Speed Limits by a vote of 6-0-1 (Spencer absent) including the revision included in the recommended action. Strategic Plan Goal: C-1 Improve transportation through a variety of means including improving traffic flow, synchronizing traffic signals, traffic calming, and alternative transportation methods such as bike and walking paths. Environmental Status: This action is not subject to environmental review requirements. The recommended action includes reaffirming current speed limits on 44 of the 66 surveyed street segments, increasing the limit by five miles per hour on four segments, and decreasing the speed limit by five miles per hour on eight segments. The Police Department concurs with the update and recommended changes. Funding Source: Funds are available in the General Fund Public Works Transportation Division Signs and Markings operating budget to revise speed limit postings as necessary. Alternative Action(s): Adopt posted speed limits different from those recommended and forgo enforcement using speed-measuring devices on amended segments. REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 7/21/2008 DEPARTMENT ID NUMBER: 08-42 Analysis: The requirements to establish posted speed limits in accordance with procedures adopted by the_.State of California were performed by city staff. The three elements used to establish speed limits are: 1) Sample existing travel speeds at a representative location within the roadway segment. 2) Review the street segment to identify roadway characteristics and conditions that may not be readily apparent to motorists. 3) Review accident history. The review of travel speeds is used to establish a baseline speed limit for a roadway segment. Roadways where all conditions are readily apparent to motorists, do not affect the safe operating speed for the street, and have no accident history that may be indicative of these types of conditions, generally have a posted speed limit based on the 85t" percentile speed or the prevailing speed of traffic. When conditions warrant, the State of California procedures for establishing posted speed limits allow for posted speed limits to be reduced a maximum of five miles per hour. Applying this reduction requires an engineering evaluation and documentation of conditions to demonstrate the need for the lowered speed limit. Case law has shown that the courts will not support speed limit postings that appear to be arbitrary and without demonstrated sound technical support. Attachment 2 presents the Legislative Draft of the recommended ordinance adopting the new speed limits. Other changes into the Legislative Draft of the ordinance address the consolidation of several street segments in conformance with State recommendations. References to posted speed limits on Beach Boulevard and Pacific Coast Highway are deleted. The recommendation to eliminate references to State highway limits removes the implication that the City has control and establishes speed limits. Establishing speed limits on these segments is solely the jurisdiction of the State of California Department of Transportation. This change reduces potential conflicts or unnecessary ordinance changes to reflect future speed limit changes on the State routes. Several characteristics within the roadway segments may not be apparent to motorists and would make a speed limit posting nearest the 85th percentile speed undesirable under most conditions. In some cases, the conclusions regarding these conditions are supported by the calculated 3-year accident rate for various street segments as shown on the traffic engineering speed survey sheets. (Attachment 5) The resulting recommendation is speed limits be retained on 44 of the 66 segments. The limits on four segments are recommended to increase by five miles per hour, and eight segments are recommended to have speed limits reduced from the current speed limit. Please let my admiration for your hard work in our community be noted. Thank you for considering a decrease in speed on Bushard Street from Brookhurst street to Hamilton Avenue. May I also suggest considering a decrease in speed on Banning Avenue? Eader Elementary school is on Banning Avenue. The vice president of the PTA, Robert Spetner has a home that backs Bushard near Banning street. He started a petition collecting over 400 signatures hoping to get a signal put in where the Banning and Bushard stop signs are located. People seem to disregard the stop signs. A signal would be a great addition for the safety of our neighborhood, especially for children. Some believe it is difficult to balance speed and safety. While this may be true, an extra 5 minutes could help save someone's life. The budgeting of our time is the real issue. We all want to arrive at our destinations in a timely manner. When I was 10, I was hit by someone who was hurrying home from work. After being hit and thown 30 feet, my body was smashed onto the pavement. My head hit the cement a 1/16th of an inch from my temple. The doctor treating me at St. Jude hospital said it was a true miracle I wasn't killed instantly. Can you imagine how that man might have felt if I hadn't survived? A street light at Bushard and Banning deserves consideration. It's the last street before Pacific Coast Highway so many tourists take this route to save time. Time they must save as they speed many miles over the limit during the summer months. The other nine months during the school year, people must think Banning isn't monitored by police. This may be partially true because police can only be so many places at one time. A signal could slow people down throughout the year. Drivers need to be reminded that there are often children present. Drivers 7/21/2008 Page 2 of 2 also need to be reminded they are driving through a residential area. Speed bumps, flashing lights, stop signs, and warning signs can help. Even a big dip in the pavement could be a reminder that if you don't slow down, you will have to pay for car damage. How about that idea? My main emphasis is protection of our community, specifically our children. Though there are crossing guards during the school year, this just isn't enough to slow people down. When those crossing guards are gone, the cars speed by. Mornings, evenings, and weekends are the most worrisome crossing times. This is when radar needs to be used.
