[X] Yes [ ] New Policy or Exception Statement of Issue, Recommended Council Action, Analysis, Funding Source, Alternative Actions, A n� STATEMENT OF ISSUE: At the City Council meeting of July 19, 1993, Public Works was requested to monitor the overall effectiveness of the newly approved traffic controls (all-way STOP signs and speed limit posted at 45 miles per hour) on Palm Avenue between Golden West Street and Sea Point Avenue. RECOMMENDED COUNCIL ACTION: 1. Confirm that the all-way STOP signs installed on Palm Avenue at Ofelia Lane and Cherryhill Lane should be left in place. 2. Confirm that the 45 mile per hour speed limit posted on Palm Avenue between Golden West Street and Sea Point Avenue should be left in place. ANALYSIS: From August 1, 1993 to October 15, 1993 the following data has been collected. The Police Department, Traffic Division, has issued 46 various traffic citations, mostly for drivers not stopping at the STOP signs. No traffic accidents have been recorded on Palm Avenue between Golden West Street and Sea Point Avenue. Unfortunately, we had previously ADMINISTRATION scheduled a Board Study Session for this evening and will not be able to attend. However, I have asked Mr. Ian Collins, Principal of Sowers Middle School, to address Duane A.Dishno,Ed.D. the City Council this on my behalf. Superintendent Certainly, we have a very high degree of interest in any consideration the members of Alan Rasmussen,Ed.D. the Council may give to modifying speed limits on Brookhurst and Bushard Streets. Assistant Superintendent Parents in the school community, as well as Trustees and school administrators, have Personnel/Educational Services voiced concerns about the relationship of speed limits on these two streets and student Jerry Buchanan safety,almost from the first day of my tenure with the District. Assistant Superintendent Business Services Large numbers of students use these two streets (especially Bushard)on a daily basis as they commute to and from school. Three of our schools (Eader and Hawes Elementary and Sowers Middle School),are located in very close proximity to Bushard (see map). Of particular concern is the safety of Sowers Middle School students, three of whom have been injured in bicycle/automobile incidents in the past 18 months. Of the more than 1,100 students on that campus, 800+ bicycle between home and school on a daily basis. [XX] Yes [ ] New Policy or Exception CA,, 2/,P 7 Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions, Attachments: Q� STATEMENT OF ISSUE: On August 19, 1992, Ordinance 3133 was enacted, which raised speed limits on certain sections of Brookhurst Street and Bushard Street to 50 mph or 55 mph, depending upon the section of roadway involved. Residents adjacent to these streets have requested that the speed limits be lowered.below the revised speed limits. On September 9, 1992, the City Council directed staff to resurvey Brookhurst Street and Bushard Street and present a report on the resurveyed streets at the November 16, 1992, City. Council meeting. On October 19, 1992, the City Council directed staff to post 45 mph speed limits on Brookhurst Street and Bushard Street. This was accomplished on October 21, 1992. RECOMMENDED COUNCIL ACTION: Direct staff to post speed limits on Brookhurst Street and Bushard Street as contained in Ordinance 3133, which are based upon radar speed surveys and allow the enforcement of speed limits via the use of electronic means (radar or LIDAR). ANALYSIS: Traffic Engineering staff resurveyed Brookhurst Street in late September and early October, 1992. Please see Table 1 and Table 2 below for the results of these surveys. The procedures to establish a speed limit (for which radar may be utilized to enforce) are mandated by the California Vehicle Code (CVC) Section 627 and the Caltrans Traffic Manual,•Chapter 8. As discussed in the related previous Requests for Council Action, radar-enforceable posted speed limits must be determined utilizing a speed survey and taking into consideration "other conditions not apparent to a motorist." Page 2 Brookhurst and Bushard Speed Limits January 19, 1993 In brief, speed limits are primarily based upon the speed at which 85% of the traffic is traveling at or slower. This speed is referred to as the "85th% speed" or critical speed. Actual posted speeds are the nearest 5 mph increment lower than the 85th% speed (for example, a section of roadway with an 85th% speed of 48.3 mph would be posted at 45 mph). Radar speed surveys usually use a 100 car sample, taken during non-peak traffic .hours. The Traffic Manual specifically states that "The intent of the speed measurements are to determine the actual speed of the unimpeded traffic. The speed of the traffic should not be altered by concentrated law enforcement, or other means, just prior to, or while taking the speed measurements." The majority of arterial streets in Huntington Beach are laid out in a one-half mile square grid, with restricted access points to the arterial. Further, these arterial streets are walled, have sidewalks, and usually bicycle lanes. Huntington Beach is primarily flat, thus, arterials do not have vertical crests and sags, which would effect safe stopping sight distance. The end result is a grid roadway system with straight, flat, generally smooth pavement, and few side street entry. points. Brookhurst Street is classified as a major arterial street and is a six-lane divided street between Garfield Avenue and Bushard Street, and is a six-lane undivided street between Bushard Street and Pacific Coast Highway (PCH). Brookhurst Street has bicycle lanes between PCH and Bushard Street. Brookhurst is typically 104-feet wide, curb to curb, with a 14-foot wide raised median. Brookhurst Street has sidewalks on both sides from end to end. Subsequent to the reposting of Bushard.at 45 mph, staff per-formed a radar speed survey between Indianapolis and Atlanta, which resulted in an 85th% speed of 51 mph (surveyed on November 12, 1992). The existing methodology used to set speed limits allows for engineering judgement in setting speed limits. Section 8-03.3(B)2a of the Traffic Manual states "Other factors that need to be considered are the most recent two year accident record, roadway design speed, safe stopping sight distance, superelevation, shoulder conditions, profile conditions, intersection spacing and offsets, commercial driveway characteristics, pedestrian traffic in the roadway without sidewalks, etc." Staff has compiled tables of existing traffic accident rates on Brookhurst Street and Bushard Street, which were calculated using a 15 month time period, ending in June, 1992 (which is the time period for which staff had available accident records in a useable form). The resulting accident rate per million vehicle miles traveled is shown in Tables 3 & 4. These tables also compare the calculated accident rates to published statistics compiled by Caltrans (please see attached Orange County Accident Rate Summary Sheet). The accident summary listing is for Caltrans District 12, which is exclusively Orange County, thus the accident statistics apply to Orange County roadways. Accident rates on Brookhurst Street and Bushard Street are less than the county-wide average for comparable streets, and in most cases are significantly less than one-half the average accident rate for comparable streets. With accident rates of this magnitude, it can be concluded that traffic is traveling safely at prevailing speeds Page 4 Brookhurst and Bushard Speed Limits January 19, 1993 on Brookhurst Street and Bushard Street. After reviewing the factors available for consideration of reduction of speed limits below the 85th% speed (as determined by radar speed surveys), it is apparent that the factors listed are not a valid consideration and that the 85th% speed is the appropriate speed limit for Brookhurst Street and Bushard Street. ALTERNATIVE ACTIONS: Introduce the attached alternate ordinances which establish 45 mph prima facia speed limits for Brookhurst Street and Bushard Street. Adoption of these alternate ordinances will not allow the enforcement of these prima fascia speed limits with radar or LIDAR, per CVC Section 40802. Residents adjacent to these streets have requested that the speed limits be lowered below the existing posted limits. RECOMMENDED COUNCIL ACTION: 1. Direct Traffic Engineering staff to conduct additional radar speed surveys on those street segments that have been posted at 50 mph or 55 mph. Authorize the Police Department to purchase two radar speed display trailers to help enforce speeds on arterial streets. Direct the Police Department's C.A.S.E. Team to conduct bicycle rodeos and school-age pedestrian education programs at the elementary and middle schools in the immediate area. Page 2 Brookhurst and Bushard Speed Limits September 8, 1992 ANALYSIS: Speed limits on arterial streets are set in accordance with California Vehicle Code §§40802 and 627. These sections relate to speed traps and the requirement to post speed limits based upon a traffic and engineering survey (referred to hereafter as a radar speed survey). In brief, Traffic Engineering staff conducts a radar speed survey during non-rush hours on arterial streets, cataloging the speeds of 100 or 200 vehicles. The speed at which 85% of the vehicles travel is speed limit that should be posted, barring some other factor that would make the speed limit unsafe. These other factors are curves, hills, numerous driveways or side streets, or a high . accident rate. Absent these other factors, the speed limit must be posted at the next lowest 5 mph increment below the 85th % speed (for example, if the 85th% speed was 52 mph, the posted speed would be 50 mph). This process and the factors considered are specifically detailed by the State of California Department of Transportation and follow the procedures dictated by the Federal Highway Administration. Radar speed surveys performed by Traffic Engineering have followed these procedures. If posted speed limits do not conform with the results of the radar speed survey, radar cannot be used to enforce the speed limits (see CVC §40802). Enforcement must be done by pacing, where the police officer must follow the speeding vehicle and measure the speed using his vehicle's (usually a motorcycle) speedometer. A further complication of the issue is the fact that a radar speed survey exists and shows an 85th% speed that would be higher than the posted speed limit, thus pointing out that the posted speed limit is not reasonable. The reasonableness of a posted speed limit is the cornerstone of the defensibility of the speed limit. Unreasonable speed limit citations are typically dismissed if contested. In practical terms, a posted speed limit that does not agree with radar speed survey is not enforceable. Another area that can come into play is enforcement of the basic speed law (see CVC §22350). This section allows for enforcement of speeds other than the posted speed, but the officer must be prepared to testify that the instantaneous conditions made the violator's speed unsafe (such as fog, presence of unusual amounts of pedestrians, debris on the road, etc). If a posted speed based upon a radar speed survey is in place, this section may be applied in areas where conditions make enforcement of a lower speed limit advisable, such as a high number of school- age bicyclists crossing the street to go to school. The unsafe conditions must be able to be testified to by the enforcing officer if the citation is challenged. Page 3 Brookhurst and Bushard Speed Limits September 8, 1992 A number of cities in Orange County have deployed radar speed trailers to make the motoring public aware of their actual speed as they drive. These radar speed trailers show the posted speed limit as well as the speed of the approaching vehicle (the vehicle's speed is displayed with large digital numbers). These trailers are very effective in reducing speeds to the posted limits, especially if a.police officer is issuing citations immediately following the speed trailer. These trailers cost approximately$12,500 each. To be effective in a city the size of Huntington Beach, two trailers are recommended. Installation of flashing beacons at crossing guard locations will help alert motorists that school children are present. These beacons would cost approximately $3,000 each, installed. The beacons would not designate school zones, rather they would designate school crossings. School zones are enforced at 25 mph, when the school is immediately adjacent to street. Streets cannot be posted as school zones if the school is not immediately adjacent to the street, thus school zone speeds cannot be enforced if the school isn't adjacent to the street. No schools are immediately adjacent to Brookhurst Street or Bushard Street. FUNDING SOURCE: Appropriate funds from the General Fund for the purchase of the radar speed trailers and flashing beacon installations. ALTERNATIVE ACTIONS: 1. Install additional flashing beacons on sections of the arterials where school crossing guards are present. 2. Artificially reduce the posted speed limits below the radar speed survey recommended limits and generate traffic citations based upon enforcement of the Basic Speed Law (CVC §22350). 3. Leave the existing posted speed limits in place and direct additional enforcement effort in those areas posted 50 mph and 55 mph. Speed limits will increase on approximately 30 percent of the streets surveyed. RECOMMENDATION• It is recommended that the City Council adopt Ordinance Number 3)33 amending Chapter 10.12 of the Huntington Beach Municipal Code. The ordinance reflects a format change in Chapter 10.12 and changes the Prima Facie speed limit on certain streets that have recently been surveyed. Prima Facie speed limits are best described as the most obvious or readily apparent speed limits. ANALYSIS: A traffic and engineering survey was performed on certain streets, as required by the California Vehicle Code, §627 and §40802(b) and the results of those surveys are indicated in the attached Legislative Draft. The format change has been made so that Chapter 10.12 will be organized on a segment by segment basis, for any individual street. Traffic and engineering surveys must be completed every five years to allow the use of radar for traffic speed enforcement. Failure to update the surveys invalidates radar-enforced speeding citations and forces the Police to "pace" the violator to enforce speed limits. Pacing is considered an impractical enforcement method for logistical reasons. FUNDING SOURCE: Funds are available in Account Number E-AA-PW-416-3-04-00 to change posted speed limits as appropriate. G, ALTERNATIVE ACTIONS: Take no action and retain the existing ordinance. This action will disallow the use of radar for speed enforcement on the effected street segments. [ ] Yes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,Attachments: STATEMENT OF THE ISSUE The increased use of the beach path by roller skaters , skateboard riders, pedestrians and bicyclists has resulted in an increase in accidents , injuries and citizen complaints . Many of these accidents involve speeding bicyclists . Safe speed limits now exist as defined in City Ordinance 13 . 08 . 290 . Radar is now being used as an enforcement tool which will result in the issuance of citations to violators . The ordinance is currently classified as a misdemeanor offense punishable "by a fine of not more than $500 . 00 or be imprisoned for a period not to exceed three months or by both such fine and imprisonment. " RECOMMENDATION: Approval of the proposed revised ordinance which would reclassify the offense as an infraction and designate more reasonable bail amounts comparable to those for California vehicle code speed violations . ANALYSIS: The present misdemeanor classification requires a mandatory court appearance by the violator. It is anticipated that if it remains classified as a misdemeanor, violators will contest the charge, due to the stigma of having a misdemeanor conviction on their record. There would be more jury trials and a public defender and prosecutor would have to be. appointed. The punishment of "a fine of not more than $500 . 00, or imprisonment not to exceed 3 months or both, is excessive and not equitable when compared to fines for vehicle code speed violations . FUNDING SOURCE: No negative fiscal impact . ALTERNATIVES: Do not adopt proposed revised ordinance. ATTACHMENTS: 1 .
