The "owner" who must file for record a notice of completion of a building or other work of improvement means the owner (or his successor in -interest at the date the notice is filed) on whose behalf the work was done, though his ownership is less than the fee title. For example, if A is the owner in fee, and B, lessee under a lease, causes a building to be constructed, then B, or whoever has succeeded to his interest at the date the notice is filed, must file the notice. On May 1, 1989, the City Council directed staff to schedule this item for a public hearing for the purpose of hearing objections and public protests to the abatement of the abandoned open water well. RECOMMENDATION: It is recommended that the City Council adopt Resolution No. 6024- declaring the abandoned water well located at 8072 Valencia Drive as a public nuisance. ANALYSIS: The California Code of Civil Procedures and the California Government Code makes provision for local governments to declare a public nuisance and said nuisance be abated by an authorized public officer. If the owner of the property does not abate the nuisance within a prescribed time, the City Council can direct the Director of Community Development to cause the nuisance to be abated by City forces or private contract. If the costs are not paid within a specified period set by the Council, they can be collected in the same manner as County taxes. The history of attempts by the Orange County Health Care Agency and the City of Huntington Beach Water Department to have the property owners seal and cap this water well go back nine years. Based on research by the City Attorney of Huntington Beach it has been determined that this parcel and well is owned by an out of business, nonprofit suspended corporation. The corporate directors are deceased. The property does not show up on the tax assessor's roles. The City Attorney previously suggested in 1980 that the Public Works Department abate this nuisance by self help. The City Water Department and the Orange County Water District identifies the open water well as a potential source of pollution to the underground water basin. Pollutants could include toxic or hazardous materials dumped into the well. Open water wells also encourage the growth of harmful bacteria through organic material deposited by birds and animals. The Water Division has requested the disposal of an abandoned well site which has been determined to be of no further use to the City. RECOMMENDATION:. Adopt the attached resolution declaring the property surplus and.ordering its..sale in accordance with section 3.06.010 of the Huntington Beach Municipal Code. 190 ANALYSIS: Subject property, the.former Holtz well site, has been out -of service for some time. The well is now capped and cemented over, with all facilities having been removed so'as to leave the parcel vacant. A -staff investiga- tion has`.also established that the property.has public street access and no encumbrances which would preclude its sale. At their October 20, 1981-meeting, the Huntington Beach Planning Commission found the proposed sale.of this property to.be.in conformance.with the General plan. Upon adoption of the attached resolution, the property will be appraised and sold at public auction in accordance with City ordinance. FUNDING SOURCE: None.. No funds required. Appraisal fees will be recaptured upon sale of the land. Income derived from the sale will be deposited in the City Water Fund. ALTERNATIVES: 1. Retain the land for future City use. 2. Recommendation: Accept the proposal .from S & T Western, Inc. for a fee not to exceed $19,850.00, and authorize the City Attorney, ,to `prepare an agreement::, Analvsis: At the Nov. 19, 1979 City Council meeting authorization was given to solicit proposals from consulting engineers to design pumping plant, buildings and appurtenances for Water Well No. 8. Proposals were received by the City's Purchasing Officer from the following firms:, S & T Western, Inc. 519,850.00 Hartge Engineering &.Construction Co. $21,520.00 Alderman, Swift & Lewis Consulting Engineers $23,000.00 Lowry & Associates $25,500.00 Cash & Jenkin Engineers $26,000.00 Woodside, Kubota & Associates, Inc. $28,500.00 Brown & Caldwell Consulting Engineers $71,060.00 Based on a review of the proposals, it is recommended that S & T Western, Inc. be awarded the design project. Alternatives: Delay the design of the project until the plans and specifications can be prepared by the City's staff. This would be a delay for at least a year. ANALYSIS This project consists of the construction of a concrete block building to house mechanical equipment and water treatment equip- ment and supplies for Water Well No. 4 at Peck reservoir, located at Springdale and Glenwood Streets. Additionally, the building will reduce the operating noise level of the facility for the surrounding residences. This project was given approval No. DR78-1 by the Design Review Board on January 12, 1978. Negative Declaration No. 78-6 was granted for the project by the Environmental Review Committee on February 1, 1978. Belsito City Administrator Subject: Repair of Water Dear -Council Members: APPRO MAY 2 ; 1977 CITY OF HUNTINGTON BEACH . CITY CLERK Water Well No." 6 located adjacent to the Murdy Fire Station on Gothard Street is in urgent need of foundation repair. Recently, this water system production well has experienced differential settlement due to unstable soil conditions. In order to compensate for this settlement the well is periodically taken out of service and adjustements made to realign the engine, pump and plumbing. The re -alignment of the equipment is accomplished by City personnel and takes approximately two weeks during which time this source of domestic water is unavailable. The Water Dept. is scheduled to once again perform this work during the month of June. The permanent solution to this settlement problem is to award a contract to "compaction grout" the site, at an estimated cost of $20,000.00. Under this contract, a sand -cement grout would be injected into the ground around the pump station. This process will result in the densification of the existing poorly compacted soils and at the same time elevate the pump engine to its original position. Upon completion of the grouting operation, the pump station equipment would have to be realigned. Because of the scarcity of import water due to the drought, there exists an urgent need to perform the required repair work immediately to assure the operation of this well during the forthcoming summer months. Transmitted herewith is a resolution declaring the urgency of the work. It is recommended that the City Council adopt the resolution and authorize this expenditure from the water fund.
