BEARDSLEY, PE, DIRECT L WORKS SUBJECT: Adopt Resolution Declaring Surplus Water Exists for Temporary Water Service to Harriett Wieder Regional Park Statement of Issue,Funding Source,Recommended Action,Alternative Action(s),Analysis,Environmental Status,Attachment(s) Statement of Issue: Municipal Code Section 14.16.180 requires that before the City may sell water to consumers outside the City limits, Council must first declare by resolution that a surplus of water exists in excess of that required by the inhabitants of the City. PLC Land Company has requested a temporary water connection for the purpose of plant establishment for the portion of Harriett Wieder Park adjacent to Edwards/Ellis Tract 15690. The temporary water connection would not exceed nine (9) months in duration. Funding Source: Water delivery is funded through a variety of accounts under the Water Fund (506). These expenditures are offset by water sales revenue that is directed back into the Water Fund. Recommended Action: Motion to: Adopt Resolution 2006- J3 declaring surplus water exists for temporary water service to Harriett Wieder Regional Park. Alternative Action(s): Do not adopt the resolution. REQUEST FOR COUNCIL ACTION MEETING DATE: 4/17/2006 DEPARTMENT ID NUMBER: PW 06-017 Analysis: On January 16, 2006, PLC Land Company requested a temporary water service to a 6.5 acre portion of Harriett Wieder Regional Park, located in the unincorporated area of Orange County, near the intersection of Ellis Avenue and Edwards Street, immediately adjacent to its single family development, Tract 15690 Attachment 2. PLC was conditioned to plant this area as a County requirement for Tract 15690; but, without a source of water supply, only weeds have germinated on this land. The request is for a period not to exceed nine (9) months, sufficient to allow establishment of California coastal native plant material which, once established, is expected to thrive without additional irrigation. An existing water service is available to serve the site but is not connected. The Department of Public Works, Utilities Division has analyzed this request and has determined that the temporary service would use approximately 5,800 gallons per day, or approximately 0.018% of the City's average daily system demand. Staff has also concluded that there is an adequate supply of water available to meet PLC's request for this finite, limited period of time over this limited area. Huntington Beach Municipal Code Section 14.16.180 provides that it is unlawful for the City Water Department to sell water to consumers outside the City, or to allow any consumer outside the City to use any water furnished by the City system unless the City Council shall by resolution determine and declare a surplus of water exists in excess of that required by the inhabitants of the City. WIEDER REGIONAL PARK WHEREAS, PLC Land Company, a California corporation ("PLC") owns certain unincorporated real property (the "Subject Property") that is generally located adjacent to the westerly boundary of the City and within the City's Sphere of Influence, and more particularly described in the legal description and sketch attached hereto as Exhibit "A" and incorporated by this reference as though fully set forth herein; and PLC is developing the subject property as a regional park; and PLC has requested the City to provide water to the Subject Property for a limited period of time not to exceed nine (9) months, for the establishment of native plant mix for the Park, after which said provision of water shall be discontinued; and Huntington Beach Municipal Code Section 14.16.180 provides that it is unlawful for the City Water Department to sell water to consumers outside the city, or to allow any consumer outside the city to use any water furnished by the city system unless the City Council shall by resolution determine and declare a surplus of water exists in excess of that required by the inhabitants of the city; and The City Council is informed that a limited surplus supply of water is available to provide the aforesaid water service for a limited period of time,not to exceed nine (9) months, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and declare that a surplus of water exists in excess of that required by the inhabitants of the city, and that such surplus may be sold to provide the temporary water service to the Park for a period not to exceed nine (9) months.
