BOX 190 CALIFORNIA 92648 ENGINEERING DEPARTMENT f January 14 , 1976 1 / Honorable Mayor and City Council City of Huntington Beach Attention: David D: Rowlands 'S City Administrator Subject: Water Towers, Los Patos and Anderson Dear Council Members: As reported previously, the water towers located at Los Patos Street and at Anderson Street in Surfside (Seal Beach) are in need of attention and should either be removed or repaired. This condition is the result of both age and the shrinkage of the wood as a result of drying out. The towers are no longer being used in the water system. The tower at Los Patos is not immediately adjacent to homes and does not present a great risk from the standpoint of falling. However, the potential liability of climbers is great and the graffiti has become an eyesore. This type of work is difficult to estimate, but based on inquiries of demolition companies the removal should cost no more than $5-,000. 00. It will require a Coastal Commission permit. The question ,8 of this tower becoming a historical monument must be decided by the City Council. If it is designated as a monument, you are reminded the cost of restoration would be approximately $18 ,000 and the annual cost of mainten- ance would be approximately $1,300. 00. The tower at Anderson Street is in close proximity to several buildings including the one housing the fire engine and fire personnel. Demolition would be extremely difficult at this time. We intend to shore up the tower to make it structurally sound. The appropriate time to remove it would be when the Fire Department vacates the premise and the entire site can be cleared for disposal. The water system, which included the towers and the land, was purchased with Water Utility funds in 1965. Any expenses or profit from the tower removal, or sale of property, should be credited or charged to that account. The water tank in Central City Park, as stated previously, should not be disturbed until the legal question of ownership is solved. The concern is that the property where the tanks are located was acquired with. Water Revenue Bonds, but is presently being used for other purposes. PATOS Date March 31 , 1976 . WATER TOWER PROPERTY The City Council at its February 9, 19.76 meeting authorized the removal of the restriction which the City Council had originally placed '.onr;.the Los Patos Water Tower property and directed the Planning Commission to consider incorporating a cDmparab-lie open space easement within the tract map being presented by Mr. George Armstrong to the Planning Commission. The Planning Commission at its meeting of March 2 , 1976, approved revised Tentative Tract No. 7743 which provided for a 25 foot view corridor ease- ment. This easement was a relocation on. a square foot per square foot basis of the open space restriction P.lacdd on the wat'er tower property acquired by Mr. Armstrong by the City of Huntington Beach. It has . been determined by the Planning Commission and Planning staff that this open space relocation was more desirable and usable as a public view area. Therefore, attached for your information are the following documents which will require action by the City Council : 1. Agreement regarding the relocation of an open space view easement in the vicinity of Los Patos and Marina View Place; 2 . Release of permanent open space easement from the original Los Patos Water Tower; 3. Grant of open space view easement in favor of the City of Huntington Beach. RECOMMENDATION Execute all three documents thereby relieving the applicant of the ease- ment on the Los Patos Water Tower property and replacing it with an ease- ment located within Tentative Tract No. 7743. Patos Drive and Marina View Place as surplus and stating its inten- tion to sell such surplus property . Furthermore., the City Council indicated the sale of the property should be to the contiguous prop- erty owner who intended to develop the remainder of the property in this area. (see enclosed map) The City Council did reserve a condition on this City owned property that it remain. open and not be developed upon. For purposes of this interpretation, provision for ingress and egress would. not constitute development of the property per se , and would therefore be permitted. Also , the City Council res:erved. the right of ingress and egress to provide appropriate maintenance and. operation to the chlorine station and water tower on the subject property. In essence, the City Council authorized staff to sell this surplus property to the contiguous prop- erty owner with the reservation that it. remain open and the water tower and appurtenant facilities remain intact . The intended purchaser, the contiguous property owner, has contacted I my office regarding the condition stipulating that the water tower and appurtenant facilities remain intact on the property he intends to acquire. He is concerned that. upon acquiring this property he be assured that the City hold him harmless as to any liability that could occur based upon the retention of these facilities . He has agreed to pay the appraised value of the property , which is $8 ,300 and to keep the property open as previously directed by the City Council . His only concern is the possibility of liability due to the condition of the water tower structure . Based upon his concern, Bill Hartge , Public Works Director , Eric Lovejoy, the Water Superintendent and Warren Hall , City Treasurer and Risk Man- ager, were requested to investigate this allegation. (see enclosed report) Enclosed are the observations by Mr. Hartge and Mr. Lovejoy -concerning the significance of the Los Patos tower as a historical monument and Mr. Hall as to the hazardous condition of the Los Patos water tower. Although the Historical Society made a recommendation relating to the historical significance of the water tower, this recommendation was neither transmitted nor acted upon by the City Council . CA 75-79 - 2- December 5., 1975 Based upon the most recent information relating to the structural unsoundness of the water tower, I would recommend that the tower be dismantled as soon as possible with funds to be provided from the proceeds of the sale of the property. The Historical Society, at the meeting of December 10 , 1974, agreed that the Los Patos Water Tower be designated as an official historical landmark (copy of letter attached) . I have no objection to tkat ;stand, however, ,the City Council should be aware of some information if, in fact, it does adopt the position of the Historical Society. The tower, ,as a filled reservoir, does not meet present-day seismic standards. It is presently not in use, not necessarily because of that fact, but because the Sunset Beach-Surfside area is presently being served by the City water system which does not use the tower. It is anticipated that we will continue to serve -- that area with the City system because of the questionable condi- tion of the water well at the tower location, and because of an improvement in water pressure and fire protection. If the .tower is chosen as an official Historical Landmark the City Council should take into consideration the following: 1. The tower is located on a lot of 10,800 square feet which is of some significant value. 2.. It would cost approximately $18 ,000 to paint the tower to cover the graffiti, to clear the site, to improve it with landscaping and lighting, and to install security fencing. 3. The cost to maintain the tower and grounds would amount to about $1,300 per year. Determination should be made as to whether it is a historical landmark and, if so a source of funds to restore it and to maintain it must be found. H. E. I have personally inspected this facility and recommend that action , be taken. It is a hazard in the following ways: a. The tank is not used and therefore dried out. b. The wood has not been treated or painted (except for graffiti) for . many years (over 10). c. Conditions in a and b have caused wood rot so that the ladders and decks are not safe nor is the tank roof. II. The chain link fence around the facility is not in good repair and much of the ,barb-wire has been cut and the chain link is also cut and many openings exist. 8 III. I recommend the tank come down and a new fence be build closely around the remaining facilities in order to eliminate the grave insurance liability conditions existing at this location. IV. Roof and screening on both elevated water reservoirs ( Los Patos & Anderson St. ) needs replacing. 2. Booster pump at Los Patos is worn out. . 3. Well pump is worn out as indicated by a recent pump effeciency test by Southern California Edison. 4- Wiring for well, booster pump and controls is deteriorated and intermi.ttORt " to ground has occured numerous times. All wiring needs replacing. 5. The two buildings housing well pump and booster, chlorinator and ewitchgear are in need of replacing. Corrigated iron siding, roofs and doors, etc. are beyond further use. 6. Water production meter needs overhaul. 7. The old chlorinator is still operablep but requires excessive main- tenance to maintain. 8. The float valve on inlet line to Anderson Street Reservoir leaks and has failed to open to allow water to fill reservoir. 9. The condition or ability of both elevated reservoir towers to con- time to provide safe. support is questionable. In conclusion, it is my opinion that subject facility is no longer capable of providing potable water as indicated by periodic water sample results.
