HomeMy WebLinkAboutPublic Hearing to adopt Water and Sewer Service Rate Adjustm Dept ID PW 15-062 Page 1 of 4 Meeting Date 10/19/2015 �v v vel, -� Zvis, CITY OF HUNTINGTON BEACH 9, w REQUEST FOR CITY COUNCIL ACTION MEETING DATE: 10/19/2015 SUBMITTED TO: Honorable Mayor and City Council Members SUBMITTED BY: Fred A Wilson, City Manager PREPARED BY: Travis K Hopkins, PE, Director of Public Works SUBJECT: Public Hearing to adopt Water and Sewer Service Rate Adjustments- Resolution No 2015-63, Ordinance No 4073 and Ordinance No 4074 Statement of Issue Huntington Beach municipal utility rates for water and sewer have been adjusted based on established formulas set forth by City Council Resolution 99-50 for water, and Huntington Beach Municipal Code 14 55 030 for sewer service These formulas were originally adopted in 1999 In order to comply with Proposition 218, these established formulas must be readopted by the City Council every five years to adjust rates based upon the established methodology Should the City Council readopt the formulas, they will remain in effect for up to five years Water and Sewer rate adjustment methodology was the subject of an October 5, 2015, City Council Study Session Financial Impact Depending on demand, additional revenue in the amount of approximately $1,100,000 will be generated to the Water Enterprise Fund (506) in Fiscal Year 2015/16 if the proposed rate adjustment is adopted Future year revenues are unknown at this time For the Sewer Service Fund (511), the City Council voted to suspend the rate adjustment for the sewer service charge for Fiscal Year 2015/16 at the August 17, 2015, regular meeting Recommended Action A) Adopt Resolution 2015-63, "A Resolution of the City Council of the City of Huntington Beach Adjusting Water Rates and Commodity Rate Pursuant to Section 14 12 040 of the Huntington Beach Municipal Code," and, B) Approve for introduction Ordinance No 4073, "An Ordinance of the City of Huntington Beach Amending Chapter 14 12 of the Huntington Beach Municipal Code Relating to Water Fees, Rates and Deposits," and, C) Approve for introduction Ordinance No 4074, "An Ordinance of the City of Huntington Beach Re-adopting and Amending Chapter 14 55 of the Huntington Beach Municipal Code Relating to Rates, Charges, and Annual CPI-U Adjustment and Billing Methodology for the Sewer Service Charge " Alternative Action(s) 1 Do not adopt Resolution 2015-63 and direct staff accordingly 2 Do not adopt Ordinance No 4073 and direct staff accordingly 3 Do not adopt Ordinance No 4074 and direct staff accordingly HB _24;- Item 14. - I Dept ID PW 15-062 Page 2 of 4 Meeting Date 10/19/2015 Analysis Water Rates Pursuant to Huntington Beach Municipal Code Chapter 14 12 040 and City Council Resolution 99- 50, water customers of the City of Huntington Beach are charged a basic monthly meter-charge and a water-usage commodity charge The cost of the meter charge is designed to recover the fixed costs of the distribution system such as water mains, valves, and meters The cost of the commodity charge is designed to recover the costs to produce water including the purchase of water and replenishment assessment, water quality, and the operation of the wells, reservoirs and booster stations The City of Huntington Beach last raised water rates in 2011 Since that time, the cost to purchase water has increased by 7 9% and the Consumer Price Index has increased 5 6% Current Water Enterprise Fund reserves are below the current reserve policy level The increase to the city in the water rates will impact the water fund by approximately $940,000 Without a rate adjustment to cover the increasing costs, the reserve fund will continue to decrease Meter Charges -- Per Resolution 99-50, the meter rate shall be adjusted based on the Consumer Price Index-Urban (CPIU) for the Los Angeles-Orange County-Riverside Area and available as of July 1 each year This amount was 1 1 percent this year The table below shows the increase of CPIU to each size of meter in the City's system Meter Charges Meter Size/Type Current Monthly Proposed Monthly Charge Charge %" $11 2370 $11 3606 1" $22 4740 $22 7212 1-1/2" $33 7110 $34 0818 2" $56 1850 $56 8030 3" $123 6070 $124 9667 4" Compound $191 0290 $193 1303 4" FM $370 8210 $374 9000 6" Compound $370 8210 $374 9000 6" FM $752 8790 $761 1607 8" FM $1,314 7290 $1,329 1910 10" FM $2,056 37101 $2,078 9911 Commodity Charge -- Per Resolution 99-50, the commodity rate may be moderated based on the costs to the City to purchase water from the Orange County Water District (OCWD) and Municipal Water District of Orange County (MWDOC) Each year the OCWD sets the Basin Pumping Percentage (BPP), which is the percentage of the retailer's total yearly water supply that the retailer can pump from the Orange County Groundwater Basin In order to pay for OCWD's costs to manage and replenish the groundwater basin, retailers pay OCWD a Replenishment Assessment (RA) for each acre-foot of groundwater that they extract Recently the BPP has varied from 72 percent to 65 percent The remaining portion of the City's water supply, which is imported water from the State Water Project and the Colorado River by the Metropolitan Water District of Southern California (MWD) is Item 14. - 2 HB -242- Dept ID PW 15-062 Page 3 of 4 Meeting Date 10/19/2015 purchased from MWDOC who is a member agency of MWD Imported water is more expensive than groundwater In 2011, when rates were last raised, the BPP was 65% and the RA was $253 per acre-foot and the MWDOC rate for Imported water was $797 50 per acre-foot This equates to the "melded" cost of one acre-foot of water to the City being $443 58 The current BPP is 75% and the RA is $322 per acre-foot and the current MWDOC rate is $942 an acre-foot Thus, the current "melded" cost of one acre-foot of water to the City is $477, an increase of $34 52 per acre-foot One acre-foot of water converts to 435 6 billing units Increasing the commodity rate by the increase in the melded cost of water to the City equates to an increase of $0 0767 per billing unit Staff is recommending an increase of the current commodity rate from $1 7535 per billing unit, to $1 8302 Current Rate Proposed Rate Water Rate per ccf $1.7535 $1.8302 The following table shows the impact of the recommended adjustment on a single-family residence that uses the City average consumption of 12 billing units per month Charge FY 2011/12 FY 2015/16 Difference Percent Increase Commodity $21 0420 $21 9624 $0 9204 4 4% Meter $11 2370 $11 3606 $0 1236 1 1% Total $32 2790 $33 3230 $1 0440 3 2 % In addition to the rate adjustment methodology, staff is recommending amendments to Municipal Code Chapter 14 12 to address developments in the law and City Policy Sewer Rates Huntington Beach Municipal Code Section 14 55 030 provides that the Sewer Service User Rate shall be adjusted to reflect the annual percentage adjustment in Consumer Price Index for all Urban Consumers (CPIU) in Los Angeles, Orange and Riverside Counties established by the U S Bureau of Labor Statistics and available as of July 1 of each year The purpose for annual adjustment formula is to ensure that the revenues continue to fully fund the needs of the City's Sanitary Sewer program The City has not increased the Sewer Service User Rate pursuant to the CPIU since 2010 The City Council suspended the CPIU adjustment to the Sewer Service User Rate this fiscal year at the August 17, 2015, regular meeting Pursuant to Proposition 218, the City can adopt automatic pass-through adjustments for CPIU that last for five years Staff is recommending that the City Council re-adopt the ordinance to comply with Proposition 218 and allow the City to raise rates based on CPIU increase in the future, should it be financially necessary to do so Environmental Status Not Applicable Strategic Plan Goal Strengthen economic and financial sustainability HB -243- Item 14. - 4 IAB -24 - A�TACFI it RESOLUTION NO 2 015-6 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ADJUSTING WATER RATES AND COMMODITY RATE PURSUANT TO SECTION 14.12 040 OF THE HUNTINGTON BEACH MUNICIPAL CODE WHEREAS, on July 19, 1999, the City Council adopted Resolution No 99-33 establishing water rates for the City's customers effective October 12, 1999, which was subsequently repealed by Resolution 2007-77; and On July 19, 1999, the City Council Adopted Resolution No 99-50 establishing formulas for the annual adjustment of the City water rates which in part provide for an annual adjustment to the monthly meter charge based upon an annual percentage adjustment to the Consumer Price Index for all Urban Consumers for Los Angeles, Orange and Riverside Counties established by the U.S. Bureau of Labor Statistics ("CPI-U"); and Huntington Beach Municipal Code Section 14.12.170 requires in part that all monies collected from fees and charges under Chapter 14.04 through 14.20 of the Huntington Beach Municipal Code shall be deposited in a City water fund; and Huntington Beach Municipal Code Section 14.12.040 establishes a monthly Capital Surcharge. The amount of the Capital Surcharge is set by a resolution of the City Council, and Pursuant to Proposition 218, an agency providing water, wastewater, sewer, or refuse collection service may adopt a schedule of fees or charges authorizing automatic adjustments that pass through increases in wholesale charges for water, sewage treatment, or wastewater treatment or adjustments for inflation, if it complies with all of the following: (a) It adopts the schedule of fees or charges for a property-related service for a period not to exceed five years pursuant to Section 53755; and (b) The schedule of fees or charges may include a schedule of adjustments, including a clearly defined formula for adjusting for inflation. Any inflation adjustment to a fee or charge for a property-related Service shall not exceed the cost of providing that Service; and Pursuant to Huntington Beach Municipal Code Section 14 12 045, the City Council shall adjust water rates in order to maintain a balanced budget, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that Resolution No. 2007-77 is hereby repealed and replaced by this Resolution. 15-4941/127013 doc 1 Resolution No . 2015-63 BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that the adjustment formulas established in Resolution 99-50 foi water rates are adopted and will remain in effect for five years A minimum charge, as set forth below, based upon size of water meter and water commodity charge of$1.8302 per billing unit (100 cubic feet) of water for domestic, commercial and industrial service. Water commodity rate- Per Resolution 99-50, the commodity charge may change based on the cost to purchase water, the groundwater basin replenishment assessment, and basin pumping percentage. BE IT FURTHER RESOLVED by the City Council of the City of Huntington Beach that the following exceptions be made to the rates set forth in this Resolution (1) Single Family Residences With Fire Sprinkler Service: The monthly and daily basic meter charge for single family residences will be billed at the established rates for the meter size needed to serve the domestic service requirement, regardless of actual meter size to meet fire flow demand. The domestic service requirement shall be calculated in accordance with the City's adopted Plumbing Code. (2) Temporary Construction Service: In cases where water service is established on a temporary basis to accommodate construction activities (construction water), the daily meter charge shall be $2.3014 ($70 per month). The water usage charge shall equal twice (2 times) that of the established potable water rate. All monies collected as the Capital Surcharge shall be used for water projects that are consistent with the goals and objectives of the Water Master Plan adopted by the City Council. SECTION 2 Section 14.12.045 of the Huntington Beach Municipal Code is hereby amended to read as follows 14.12.045 Water Rates—Budget A. It shall be the policy of the City that a balanced budget shall be maintained for the Water Fund Pursuant to Section 602 of the Charter of the City of Huntington Beach, the City Manager shall be required to submit said Water Fund budget in a balanced condition to the City Council, together with the other budget submittals. For the purpose of this section, "balanced budget" shall mean that total appropriations for operating expenses do not exceed total estimated revenues in the annual budget of the Water Fund Use of Water Fund reserves shall follow established financial policies as adopted in the annual budget. B. I DO NOT AGREE with the proposed rate increase. Tying water and sewer rates to the Consumer Price Index (CPIU) is not an accurate way of assessing the cost and value of this commodity. It is a sneaky way of repeatedly raising the rate charged with no public oversight. The CPIU is influenced by many factors. Few of which have anything at all to do with the cost of pumping, processing and delivering water to the citizens of Huntington Beach. For instance, the CPIU can be affected solely by a change in the price of crude oil. So oil prices could go up while all other factors related to the cost of our water remain the same or even go down and you would still raise our water rates. Also, as water conservation measures take effect and the overall consumption of water goes down, the amount of money taken in by the City of Huntington Beach from the sale of water to it's citizens goes down. This rate hike and the inevitable future annual rate hikes are an attempt by you and the city to keep the same level of income from this city service. This is a typical government response to decreasing revenues. Whenever revenue decreases from any source you simply increase the rate of that source to make sure city coffers stay full. Instead of tightening your belts like the rest of us are forced to do in the face of less income, government simply ups it's take so they don't have to feel the effects of economic change. We are using reclaimed water, along with water from the aquifer • Since water revenues have decreased by 25%; should not Expenses be reduced by 25% • Less revenue should also enable the City to reduce head count • Less revenues should foster a 25% cut in the Department's budget. These are things you have done with apparent no concern for the residents of the city. I have installed solar paneling to help reduce the use of electricity supplied by Edison, yet Edison is considering raising rate on those who are trying to HELP. I am awaiting approval from the MWDOC for the installation of artificial turf in an effort to HELP with the water shortage crisis. The State legislature is proposing to increase car registration rates to pay for road maintenance, for which our gasoline taxes were levied. The State also is considering a tax on the miles driven by its citizens for specious reasons. Is there any chance that governing entities might start empathizing with the plight of the taxpayer? Maybe you believe that all taxpayers are a glut on the services already provided. If so, prove it. When you are acquiescing to the union demands for more, are you thinking about those of us on fixed incomes who are seeing the value of our dollar shrinking day by day? By the way, were any of you city fathers and mothers in the vicinity of the new Senior Center when literally thousands of gallons of water were being used at that site? Is it going to be landscaped with plants requiring water? I am beginning to believe that campaign promises made by politicians only last long enough to be voted into office. I know most homeowners put your Notice straight into the circular file and those that read it didn't see anything but some jumbled numbers....most likely taking a deep sigh of resignation before they too made their circular file deposit.The only thing the Notice availed to the homeowner was a math check but no understanding.Shame on you. I truly think this is a bad idea. While we understand that the governor declared California in a state of drought and that water shortages are unavoidable I don't understand how a motion to have the water rate adjustments increased will help solve this issue. We are already doing our part by cutting down on the water that gets used in our home. It is safe to say that our efforts have not been in vain, a little less than a month ago, a report was released on the government web page in which it still states that Californian's surpassed the conservation rate set in June; in July we reduced water use by 31.3 percent, which exceeded the governor's 25 percent mandate for a second consecutive month. Since the new emergency conservation regulation took effect Californian's have worked hard to conserve water. It is unjust to know that while we are all working hard to reduce the usage of water and are not only striving, we now face the possibility of having meter rates increased. Please reconsider your decision. We are all working hard to reduce water usage and so far, it is safe to say that we are achieving our goal. Increasing water rates will not solve the drought issue, if anything, it will add one more headache to the local population. However, that increased rate never goes away even when that commodity returns to normal supply. In the case of our water shortage: Users are letting go of thousands of dollars invested in lawns, plants, trees& shrubs as we watch these beautifications die out through no fault of our own, but rather a drought, and the bureaucrats dictating the amount of water we shall be allowed to use as well as the amounts of the monetary penalties we will be charged if more water is used than allowed. It should be noted that users are also experiencing an additional cash outlay for replacing the lost beautifications of the properties. In the case of sewer rates: Users are cutting water usage inside the homes and the meters aren't clicking off those maximum gallons anymore. Again, less revenue. It is time the bureaucrats tightened their belts along with water users. There is ALWAYS someplace to cut the budget. America was built on free enterprise and at one time a monopoly was outlawed in some areas , We protest the increases on both the water rates and sewer rates We have been told to cut back water usage and everyone has complied with the best of their ability Now we are told we will have a rate increase This is unjust in every sense of the word. Even though the increases appear to be small at this point, history proves there will be more in the future The sewers are not being monitored as they once were and there has been flooding of streets due to this abandonment of responsibilities Areas that are beyond the competency of the city's sewernng agency have requested Orange County Sanitation Districts support in the past For example Warner near Pacific Coast Highway The bottom line is when the city receives a savings on utilities we never see the outcome Another example would be when the Central Library and other public buildings installed solar panels The residents were not offered a discount to install them as well 'Nor have we ever been notified about the amount saved or seen a decrease in our bills It is ludicrous to request increases for less service Perhaps it would be smart for both agencies to review other options internally before asking the residents to cover them I would think with all the new construction of apartments they could start with those developers/owners The infrastructure of our city should have come first We're still investigating how it was possible to pass the environmental impact study. I'm sure you have received your Southern California Gas Company bills with an insert asking for another increase. This project is described as "The Pipeline Safety and Reliability Project which has more to do with San Diego County and the Riverside County line to the Marine Corps Air Station, Miramar Why should they be asking for our money as well Can't they make this a Corp of Engineers project?
