SUBJECT: Payment to West Orange County Water Board
STATEMENT OF PROBLEMS:
The City has been billed by the West Orange County Water Board
for $26 ,460. 00 as its share of the lawsuit settlement with the
Orange County Flood Control District for relocating feeder No. -
2 . No funds were budgeted for this item.
RECOMMENDED ACTION:
Approve payment to West Orange . County Water Board in the amount
of $26, 460. 00, and use of the Water Utility Fund for this payment.
ANALYSIS:
A legal action was brought in 1972 by the Orange County Flood
Control District against the West Orange County Water Board to
recover the cost of relocating Orange County Feeder No. 2 at the
Anaheim-Barber city flood control channel. In October the District
and Board agreed to a settlement wherein the Board agreed to pay
the District $50,400 as full settlement. The City' s share is
52. 5% of the total; i.e. $2.6 ,460. 00 . Councilmen. Coen and Bartlett
are our representatives to the West .Orange County Water Board.
They both concur with the recommended action.
FUNDING SOURCE:
Transfer $26,460. 00 from Water Utility Fund to Account 920707
(West Orange County Water Board Expense) . FIR attached.

Orange County Feeder No. 2
Relocation
In response to a request from the Public Works Department to prepare a financial
Impact Report on the above subject, I am submitting the attached.' At the present
time there are funds available in the Water Utility' s Unappropriated Fund Balance
to pay this request if the City Council so 'desires. These funds have been accumu-
lated from prior year surpluses.
The funding for this project has been included in a resolution to revise appropria-
tions for the fiscal year 1977-1978•

Project is already completed. The lawsuit was to decide who _shuld may fnr the
relocation. The feeder is used by the WOCWB and the City 12ays 52.5-'/, of its
maintenance and operating costs and we purchase water from them.
5. PROJECT USAGE
Water customers of the City of Huntington Beach and other WOCWB member cities
customers.
6. EXPENDITURE TIMING
When approved.
7. COST OF NOT IMPLEMENTING THE PROJECT
The City would be sued by WOCWB for payment plus interest.

Gentlemen:
In view of the fact that some entities of the Nest Orange County
Water Board do not have sufficient money on deposit in the
Maintenance and Operation Fuod to cover engineering costs of
work being done on both Feeder No. 1 and . Feeder No. 2; and
since such engineering costs will be increasing each month as
work on Feeder Number 2 progresses, the Board by resolution
set up a Construction Fund at their meeting held January 23, 1963,
to handle these charges independently of Maintenance and Operation

Charges assessed against the City of Huntington Beach for con-
struction costs for January, 1963, are as follows :

Gentlemen:
At the regular meeting of the West Orange County Water Board,
held in Memorial Hall in Huntington Beach on the 27t of March,
1963, I was directed to transmit to -you one copy- of Final Plans
and Specifications for the Construction of Feeder # 2, for your
information.
Transmitted herewith also is a copy of a communication from
J. A. Woolley, Consulting ]Engineers and Associates, of Santa
Ana, providing a description and a cost breakdown to each -entity
on a final estimate.
Your Honorable Body is respectfully requested to formally approve. _
the action of the West Orange County eater Ooard in the ratif ica-
tion! of these Plans and Specifications. It is further requested
that the Secretary of the West Orange County eater Board be
notified of the action of your Honorable Body, and be furnished
immediately with a ,certified copy of such ratification, as the
y Board will meet on April 10, 1963, to authorize the advertising
for bids. Your cooperation in this matter will be extremely
appreciated.
Also, enclosed please find copies of Resolution Nos. 38-63, and
39-63 of the West Orange County Water Board.

CONTRACT
THIS AGREEMENT, made and entered into this loth day of
June , 196_1, by and between the WEST ORANGE COUNTY
WATr.R. BOARD, a political entity organized under Sections 6500 to 6547 of
the Government Code of the State of California, hereinafter referred to as
First Party, and ED,-400 J. VA NWS, 0E; UL WVVIL fiXIIW hereinafter
referred to as Second arty.
WITNESSETH:
1. Second Party, under the direction and to the satisfaction of First
Party will furnish all labor, materials, equipment, transportation and ser-
vices for the construction of the West Orange County Water Board Feeder
No. 2 for the West Orange County Water Board in accordance with the plans
and specifications, bid form, notice inviting bids, walze scale and resolution
of First Party, dated «"ay 22 , 19 65, all of which are in-
corporated herein and made a part hereof, as though set out in full.
2. This Contract is to include all of the work, materials, transpor-
tation and services called for in the plans and specifications.
3. The Second Party agrees that he will pay to any laborer or
mechanic employed by him, the prevailing rate of hourly wages andrates
for legal holidays and overtime work, which rates are shown and set forth
in the Notice Inviting Bids. The Second Party shall as a penalty forfeit to
the First Party Ten Dollars ($10. 00) for each calendar day or portion there-
of for each workman paid less than the prevailing wage under this Contract,
by Second Party and by any Sub-Contractor under him.
4. Second Party agrees to commence construction of the work pro-
vided for herein within ten (10) days from the execution of this Contract and
to continue in a due and diligent workmanlike manner without interruption
and to complete construction thereof within the time limits specified (or
approved extensions thereof).
5. First Party agrees to pay to Second Party and Second Party agrees
to accept as work progresses according to specifications, subject to additions
and deductions provided therein, for the furnishing of all materials, equip-
ment, transportation and services for said construction, all in accordance
with the applicable provisions of Section C-9, Measurement and Payment of
the General Provisions of the Project Specifications, which sums shall be
computed from the prices set forth in the bid submitted by Second Party.
6. Second Party agrees to use and supply only such unmanufactured
materials as have been produced in the United States, and only such manu-
factured materials as have been manufactured in the United States, substan-
tially all from materials produced in the United States.

7. Second Party shall forfeit as a penalty to the First Party, the
sum of Ten Dollars ($10. 00) for each alien knowingly employed in the execu-
tion of this Contract, for each calendar day or portion: thereof.during which
such alien shall be'permitted or required to labor, in violation of Section
1853 of the Labor Code of the State of California.
IN WITNESS WHEREOF, the parties hereto have hereunto set their
hands.and. seals the day and year first hereinabove written.

May 22, 1963.
This Resolution provides for an iwmendment to the Joint Powers Agree-
ment between the entities comprising the West Orange County Water Board,
and requires ratification by the governing body of each entity.
