California 92648 SUBJECT: Justification for 1988-89 Budget Dear Directors: The information submitted herein is in response to your request at the regular meeting held on March 15, 1988 for a statement of justification for the tele- metry installation proposed to be constructed during Fiscal Year 1988-89. The West Orange County Water Board Feeder No. 1 was constructed in 1956 and Feeder No . 2 was constructed in 1964. The metering and control equipment originally installed was "state of the art" equipment in the water industry at that time. Water was relatively inexpensive and the cost of labor, materials and equipment for operating a water transmission main through an urban area with little traffic was not too difficult. Remote control of valves and telemetry equipment to transmit flow and pressure to a central control monitoring and recording location were not standard practice at that time. Over the last 25 years highly dependable telemetry and control equipment has been developed and tested by the water industry to help reduce the cost of controlling and recording flow and pressure in water systems. The increased traffic and congestion make it much more difficult to manually operate and monitor large water systems than in the past. In 1964 a water change or meter reading could be made in an underground vault by one or two men in a relatively short period of time. Due to the present Occupational Safety and Health Act (OSHA) regulations at least three trained people and special equipment are required to enter an underground vault to make a water flow change or read a meter. Because of the increased traffic and congestion it is necessary to place additional traffic control devices, includ- ing barricades, cones, flashing lights, signs and other equipment before enter- ing a vault. With properly designed and constructed telemetry equipment flow rate changes can be made from a central control room and the flow rates recorded by equipment in the control room. This type of equipment would greatly reduce the amount of field labor and equipment required to operate the WOCWB system. Honorable Board of Directors West Orange County Water Board April 8, 1988 page 2 When the proposed telemetry and control equipment has been installed the costs of labor and equipment to operate the system will be less and the level of safety of the operating personnel will be increased. The opera- tion personnel will also be able to respond to requests for flow changes in emergency situations much faster and/or to detect system malfunctions. The total estimated cost for purchasing and installing this equipment is $200,000. As shown on page two of the proposed budget this cost will be distributed to the respective cities based on the actual costs for each take-out plus a pro-rata share of costs for the facilities at OC-9 and OC-35 and the operations center at the city of Huntington Beach. It is estimated that there will be a carry-over of funds from Fiscal Year 1987- 88 of approximately $106,000. The net increase in the proposed 1988-89 budget, including the telemetry installation, remote flow control and meter replacements item, is $96,500. Without the addition of the telemetry and remote flow control equipment and two meter replacements, the operation budget would need to be increased by approximately $30,000 to cover the added costs of labor and equipment to operate and monitor the system in its present state. This additional cost would be a recurring item in future budgets and would be subject to annual increases due to anticipated inflation factors. BOX 190, Huntington Beach, CA 92648, if the City undertakes to abandon or vacate any street or highway within the City boundaries within which WOCWB has an easement or right-of-way. An original and two copies of this letter are furnished to your office. The original should be kept on file with your office, a copy should be placed in the information request index of the City pursuant to Streets and Highways Code §8346(b) , and WOCWB requests that the second copy be conformed as to the date filed and returned to the WOCWB offices in the envelope provided for your convenience. WOCWB will , from time to time, update these diagrams and maps as new facilities, easements and rights-of-way are obtained or released by WOCWB. Council approval is sought to pay verified charges. Recommendation: Reimburse and pay the Mesa Consolidated Water District verified billings in the amount of $103,922. 03, to be paid from the unappropriated water fund. \ Analysis: \,,The nine-mile San Joaquin Transmission main is jointly owned by the City and Mesa Consolidated Water District, and conveys water from San Joaquin Reservoir to the City. Major leaks were noted in Oct. 1979 in the 42" line near its San Diego Creek crossing. Under an operation-maintenance agree- ment, the District is authorized to make major repairs` and bill the City for its share, 41. 4%. Repairs to the 42" steel line were complex due to its-encasement in a 60 corrugated metal pipe. After the Oct. 1979 repairs, major leaks occurred in an adjacent reach in Dec. 1979 and Jan. 1980 . Contract repairs paid by the District total $268 , 637 . 14 , and on April 21, 1980 the City received a bill for its share, $111, 215.78 . Staff has veri- fied the billings except for standby work during a number of rainy days. The amount of the total verified bill is $251,019 .40, with the City' s share being $103, 922. 03 . This is our response. When JOHN C.P.A. the leak developed in October of 1979 , the City of H.RODGER HOWELL Huntington Beach was advised, and the District began Attorney repair work. The necessary repair work was beyond the capacity of both District owned equipment and man- power, so it was necessary to hire an outside contractor. The only available qualified contractor at the time was Luna General Engineering, Inc. Since time was of the essence .due to winter months , inclement weather, and the need to keep the 42" line in service, Luna was hired on a cost-plus basis to do the necessary repair work. As we described in our letter to you of December 26 , 1979 , Luna had previously successfully repaired other damages to the 42" line in the Back Bay area. Due to the nature of the deteriorating steel line, and because it is within a corrugated steel casing, repairs were complex. As .you know, the main was shut down on two separate occasions to facilitate repairs: the joints at engineer 's station 335+76 (H.B. designation "S") on December 11-18 , 1979 , and station 336+26 (H.B. designation "P") on January 4-17 , 1980 . In our effort to keep expenses as low. as possible, the District directed Luna to keep regular working hours whenever possible, thus avoiding premium time pay. However, in order to keep the .job running smoothly, some overtime, weekend, holiday, and rain day work' was required to keep the de-watering pumps and generators operating. Enclosed is a copy of the District inspectors account- ing of Luna' s overtime activities . We would point out that pipeline repair work in a flood control channel during winter months is without question a very difficult task. All factors considered, in our view, the work went quite smoothly. You have received our invoice dated April 21, 1980 , for $111,215. 78 representing the City of Huntington Beach' s share of the repair work to the 42" transmission main. In view of the fact that Mesa Water has used its reserves. to pay all the bills since October 1979 , we would appreciate your payment as soon as possible. You should also be aware that we have not billed you for any loss of water but only for repairs. For your information, in addition to our normal paperwork docu- mentation, the District has also documented the project on film. Eventually the Waterworks Districts were dissolved and became apart of the municipal water systems of Garden Grove and Westminster. Much later Seal Beach became a part of the compact. The object of this was to form a provincial district which could con- tract with the only agency (Orange County Municipal Water District) with the authority to obtain Metropolitan Water District water and to finance and con- struct the works to deliver it to the entities represented by West Orange County Water Board. The far sighted decision of the 1953 City Council was instrumental in Huntington Beach being the major city it is today.. W.O.C.W.B. was our spring- board from 1953 into the future. Were the Board to be dissolved the several cities served would continue to be faced with sharing fifty percent of the cost of the operation (total budget for 1970-71; $38,810) without the benefit of the Board coordinating its activities. While nearly .all of the major work has been accomplished the maintenance and operation has to proceed in an orderly manner and the interests of the four cities must be protected. Unlike Talbert Water District, this District is an arm of the cities it serves. Relinquishing the duties and responsibilities of this Board to Orange County Municipal Water District would be an abdication of those duties and responsibilities by the member cities and vest them in a Board that may not be primarily concerned in the matters of the cities that comprise the W.O.C.W.B. It seems that attention should be directed towards economies in the area of administration and engineering with the idea of grossly reducing this fifty percent of the budget. For years the city of Huntington Beach, as fiscal agent for the District, has provided the accounting at no cost to the member cities. It might will be that other functions could be done on the same basis. Further, consideration could be given to fewer regular Board meetings. At the present time the meetings are monthly and are convened for the principal purpose of approving payment of bills. If this function could be delegated, subject to periodic ratification by the Board a goodly savings could result. In conversations with Ray Woodside (Manager) and Alex Bowie (Counsel) I have found a willingness on their part to relinquish their positions with the District. The proposed amendment would provide that the Board may establish a per diem, applicable when a member of the Board is directed to per- form duties other than attending Board meetings . This proviso has been approved by the Cities of Seal Beach, Garden Grove and West- minster, the other parties to the Agreement. Possibly additional information should have been submitted with the draft of the proposed Agreement for your consideration. Inasmuch as the proposed amend- ment is a more economical means of accommodating the problem at hand as opposed to holding adjourned meetings , the West Orange County Water Board would request that additional consideration be given to the proposed amendment. Some of this correspondence reflects misimpressions you have conveyed in your October Newsletter No. 7 on that issue. I wish to take this opportunity to clarify several points raised in that letter. With regard to the transmittal of the feasibility report on the Peripheral Canal to the Legislature , this action was taken by my office as required by Sections 450-453, of the California Water Code . This point is important since your Newsletter indicated that this action was not required by law. With regard to your statement that I have been urging reconsideration of the entire California Water Plan, this is not true_. My remarks, except for my steadfast opposition to the flooding of Round Valley, have been chiefly aimed at developments required beyond the initial stages of the State Water Project, which is presently being constructed and sized to meet the 1990 water requirements under some 31 water supply contracts. I have expressed the opinion on several occasions that we need to give greater consideration to the environmental impact of water development proposals, but at no time , except for my opposition to flooding Round Valley, have I made proposals that were intended to impinge upon contract commitments for State Water Project water which is required to meet estimated 1990 demands . Waldie -2- November 18, 1969 It has been emphasized repeatedly by me that the decision to construct the State Water Project was made by all the people in the State when the Burns- Porter Act became law. The ultimate decision regarding any proposed change in the State Water Project, therefore , lies with the people of California . It is, however, my responsibility to coordinate the views of all state agencies and to develop a position on individual projects which become a part of the overall project. I assure you that the position which I finally endorse on the Peripheral Canal Project will be based on a comprehensive review and analysis of all issues and upon recommendations made by the Legislature and various Departments of State Government. As I am sure you know, Legislative Committees held public hearings on this subject, and I will carefully peruse these and other recommenda- tions before passing on my detailed suggested State position. While your Newsletter did not touch on the subject of water pollution in the Delta , I would appreciate information from you as to what has been and is being done by waste dischargers , particularly industries and municipalities, in your district to improve the quality of waste being disposed of into the waters of the Bay-Delta system . I recently attended the dedication of the Humble Oil Company Refinery and was favorably impressed with the large sum of money (some six percent of the total plant investment cost) they had expended to protect the environment. If this kind of attention to the treatment of waste water can be given all other dischargers in the western Delta , certainly the pollution problem there would be greatly reduced. It would appear to me that you could perform a real public service if you urged the offending polluters in your district to follow more actively the good example set by the Humble Oil Company. The Board, by minute action, approved the proposed bud- get and directed that copies be sent to each entity for use in preparing their respective City budgets. It is obvious that any budget prepared for the operation of a joint powers system, such as the W 0 C W B. must allow considerable leeway on certain items contained therein because of the variances which might occur in water usage and in Engineering and Maintenance items. I have been directed to point out to your Honorable Body that this budget does not include an approximate sum of $4300.00 which is encumbered for certain engineering fees in connection with litigation between U.S. Industries, Inc. (a contractural pipe supplier) VS E.J. Vadnais & Son (the prime contractor in the construction of W 0 C W B Feeder No. 2) . The West Orange County Water Board has been named as co-defendent in this suit, along with J.A. Woolley & Associates, Consulting Engineers for the Board . There has been no determination made at this time re- garding the legal responsibility of the Board for the pay- ment of these bills on which payment has been deferred, and consequently there has been no distribution of costs made to the various entities which comprise ;the Board. Industries, Inc. against the West Orange County Water Board, a contractor who had been constructing pipeline for the Board, and the engineer for the West Orange County Water Board, Mr. J.A. Woolley. In view of the fact that the city is a party to the Joint Powers Agreement which created the West Orange County Water Board, we believe it would be desira- ble for you to put your insurance carrier on notice as to the existence of this action. The legal proceeding to which we refer is pending in the Superior Court of Los Angeles County, No. 844492, and is set for trial on March 6, 1967. The portion of this ac- tion which we feel you should. bring to the attention of your insurance carrier pertains to allegations that Mr. J. A. Woolley arbitrarily and intentionally induced the contractor involved to refuse to accept delivery of cer- tain pipe, which resulted in damage to U. S. Industries, Inc . in the amount of $73, 101. 60. Additionally, it is alleged that Mr. Woolley unreasonably, arbitrarily, and intentionally refused to approve plans for the fabrication of the pipe that was to be used, resulting in delays where- by the contractor has back-charged U. If Mr. Woolley is held liable in regard to the foregoing, and if he is able to recover from the West Orange County Water Board, it would appear that the entities which are parties to the agreement creating the West Orange County Water Board would be liable for such sums on a prorata basis. The foregoing statement is predicated on the provisions of Section 895 .6 of the Government Code. B-3 Each entity should utilise available Wells and storage facilities to reduce that requirements on Feeder No. 1 and Feeder No. 2 during peak useate periods or sat event of emergency. B-4 It shall be the individual entities' responsibility to maintain and keep all of their wells and storage facilities in operating condition in the event of peaks, shortages, outage and/or emergencies. (d) Annual cleaning and painting of enclosures, exposed equipment and piping. . (a) Daily and weekly meter readings and visual inspection of all stations. "Maintenance Spare Parts Fund" in the amount of $1,000.00 for handling repair parts stock purchases. It was determined by the Board that an initial payment of $200.00 per Entity would be 'necessary to set up the Fund and as material is used each Entity will be charged for that portion used on their lines or connections. The West Orange County Water Board directed their engineers, J. A. Woolley and Associates, .•to prepare plans and specifications for k;he installation of the meters on the connections r-iithin the jurisdiction of the ;dater Board. The installation of the City's meter on Feeder No. 1 on Newland Street could be included in the project presently under design by Woolley's office and the work could be accomplished in the near future. In their action, the Supervisors set a limit of $100.00 per month on the Secretary' s salary, and a further limit of three paid meetings per month for each Director. Your Honorable Body by Minute action, on June 3, 1963, approved Resolution No. 43-63 of the West Orange County Water Board and ratified the amendment to the Joint Powers Agreement provided therein. West Orange County Water Board the sum::of $8000,00 at this time. This amount was increased during the past year from $4000.00 to $8000.00 in two steps of Two Thousand each. The billing for the City's water for the month. of June has been received in the amount of $8627.90. Consequently it is apparent that the City is again in a position in which they do not have sufficient funds on deposit to cover their billing for June. Our experience shows that the water demand for July and August will exceed that of June. In view of the foregoing, and the fact that the City will be obtaining water from two West Orange County Water Board lines by April 1, 19649 it is recommended that the Council consider making an increase at this time in the deposit with the West Orange Lounty Water Board Maintenance and Operation Fund, of $6000.00. LAMBERT, DIRECTOR ' December 14, 1962 Honorable Mayor .and City Council w City of Huntington Beach Huntington Beach, California Gentlemen: From May through September of 1962, the Metropolitan Water District through the Orange County Municipal Dater District has been supply- ing the Nest Orange County Dater Board with unsoftened water. The rate charged the various entities of the West Orange County Water .Board for unsoftened water has been $19.00 per acre foot. Begin- ning the First of October, 1962, in compliance with the requests from most` of the entities supplied by the MWD, they have been fur- nishing softened water, and the rate for this is $27.00 per acre foot. As a result the water furnished to the City of Huntington .Beach during October amounted to $6,248.11 , and in November, to -86 ,'�99.03. These amounts represent water only and do not include maintenance and .operation expenses of the Board distributed to the City:-. It is apparent that each of these bills exceeds the amount which the City _of Huntington Beach has in the West Orange County Water Board Fund, which is $6,000.00. The City' s water usage .is increasing as a re- sult of new homes' being added. It is , therefore, respectfully requested that your Honorable Body consider increasing the City' s portion in the Water Fund by at least $2,000.00, in order that we may meet the bills coming up for payment on January 10, 1963.
