City of Huntington Beach Statement on Closure of Mariner's
Point Fuel Dock in Huntington Harbour
Summary As of October 1,the Mariner's Point Fuel Dock in Huntington Harbour closed This is not
the outcome the City hoped for as our elected officials and staff worked diligently over
the last several months to come up with an acceptable plan to keep the docks open
Needless to say,we are very disappointed with this unfortunate outcome as pending
solutions were in action
Who Mariner's Point Fuel Dock is a private fuel dock owned by a partnership of Nahas
Enterprises,the fuel dock operators,and Center City Properties Center City Properties
is comprised of the Miller Family Trust,which represents family members of the late
David D Miller,founder of the Miller's Outpost retail chain and Kodash, a development
company specializing in Southern California real estate projects
Background Mariner's Point Fuel Dock(Mariner's) is the only fuel dock location in Huntington
Harbour,serving up to 6,000 recreational boaters,as well as public safety and security
boats for Harbor Patrol and the Seal Beach Naval Weapons Station Over ,the summer,
the City was made aware of a rumor that Mariner's Point Fuel Dock in Huntington
Harbour would permanently close October 1, 2015
The City learned the closure of Mariner's was planned over two years ago through a
secret agreement between the partnership which would have provided no notice to the
community or City After making money from the community,the partnership simply
planned to close the business and leave the community and public safety marine
vehicles with no viable fueling alternative No efforts by the partnership to arrange
alternate ownership were made Recent efforts by the City to broker a transfer of
ownership to a new operator(through which two bids were sent to the partnership)
have been unsuccessful to date due to reluctance by the Miller Family Trust controlled
Center City Properties
The City initiated discussions with the law firm representing Center City Properties to
keep the fuel dock open beyond the October 15L deadline Most recently,the City
requested a two-week extension of the closure in order to schedule a City Council
closed session to discuss the potential of the City acquiring the facility These efforts
were denied by the Center City Properties even after personal appeals to family
members of the Miller Family Trust The City released a Request for Qualifications on
September 29 to determine a potential operator In a continuing effort to assist the
community in maintaining a fuel dock in Huntington Harbour,the City will hold a Closed
Session meeting for property negotiations on October 5 Additionally,the City retained
an environmental lawyer to determine the best course of action in which to protect the
community,as well as prevent the partnership from abandoning and/or closing the fuel
dock facilities in a manner that is not in compliance with very stringent environmental
law,thereby creating a potential hazardous situation for the community and Harbour
It is the City's desire to have the fuel docks remain open while these additional efforts
can be pursued While operating a fuel dock has never been a City function, it is clear
the City will have to take stronger action in order to continue providing for the use of a
fuel dock by the community and public safety users In that regard,the City is
aggressively pursuing other options that are proving to be very promising for the long-
term outlook of the fuel docks We are confident that ultimately our actions will prevail
for the good of the community
The City continues to hope that Center City Properties and, in particular, members of
the controlling Miller Family Trust, understand the community benefit in which they
conspired to deny the users with no notice is not good for our community and is not in
good faith The partnership needs to take into consideration the number of years the
community has supported and provided the Miller Family Trust,Center City Properties,
and Nahas Enterprises with viable income during their operation of the fuel dock and
reciprocate with the additional time requested
The City desires to have an amicable solution to this issue and we would like for Center
City Properties and the Miller Family Trust to be part of it
Action The community is encouraged to contact City Center Properties to keep the fuel docks

STATEMENT OF ISSUE:
Mariner's Fuel Dock has served the boating residents and visitors of Huntington
Harbour since 1983 through a partnership between Nahas Enterprises and Center City
Properties, Inc The partners obtained a lease with the State Lands Commission and
have an easement agreement to support the fuel operation
In June of this year, the City was made aware that the owners of Mariner's Fuel Dock at
Huntington Harbour were planning to permanently close their business The owners of
Mariner's Point have stated that the fuel tanks have reached their useful life of 30 years
and they are not interested in selling the operation to a private operator due to concerns
with potential environmental liability
Since this is the only source of fuel for the boaters in the harbor, closure of this dock is a
major concern to the Huntington Harbour residents and boat owners It is estimated
that the fuel dock serves a market base of approximately 6,000 boats in the harbor
Permanent closure of the dock could potentially affect property values and force boaters
to fuel in Newport Beach, San Pedro, and Alamitos
In an effort to address the concerns of the boating residents and visitors of Huntington
Harbour, the City has acted as a facilitator between the owners and potential buyers to
save the fuel docks The City is aware that at least two proposals have been submitted
for consideration
Recent communication between the Center City's Properties' attorney and City staff
indicate that the owners are not interested in selling to a private party but may consider
selling the business to the City While we recognize that the City should not be in the
business of operating a fuel dock, we also recognize the importance to the community
of keeping a fuel dock in the harbor In an effort to support the residents and visitors of
Huntington Harbour, we are asking our colleagues to consider the following actions

A) Direct City Manager to initiate appropriate environmental studies on the site,
research and obtain proposals for liability insurance, and report back to the City
Council with the findings, and
B) Instruct the City Manager to initiate a Request for Proposal process to identify

I understand that 2 topics will be covered on the Council's agenda that I would like to express my opinion on
1 Aft enda Item 22 concerning the Fuel Dock I support the investigation to purchase the fuel dock but this
does not mean I support it's actual purchase Getting a better understanding of the actual financial impact to
the city as a whole and non-boating residents such as myself is key to determining if I should support further
city efforts to ultimately purchasing the dock
2 Agenda Item 23, Transparency Ordinance for Employee Labor Negotiations I am 100% behind this as an
"ordinance", not just a"policy" "Private" negotiations between "public"agencies always seems to end up
costing the taxpayer more Ultimately I, a taxpaying citizen and voting resident of HB pay for the services
rendered by the union employees of the City I should be able to understand the value and benefit I derive
from it before it's final

This ordinance would require 1 an Independent Negotiator during negotiations with City

4 that the final proposed contract be posted on the City website and appear on the City Council
Agenda before approval, allowing for public comment and 5 disclosure by Council members of
any communications they have had with employee organization representatives in regard to the

sessions currently utilized.

to happen.
There are approximately 6,000 boats in Huntington Harbour. I own one of them. I would request
that the City Manager investigate the purchase of the dock, as well as issue a Request for Proposals
for an owner or operator for the dock.
The loss of this dock would have a huge detrimental impact on the area. This dock is also used by
emergency personnel and is an important safety resource for the harbor.
We do not want Huntington Harbour boaters to have to go to Alamitos Bay to fuel their boats. This
is an inconvenience that could make the difference between buying a residence or a retail business
or buying it elsewhere. It is a vital part of the harbor community.

I sure hope you all realize the impact the closure of the fuel dock is going to have,on
Huntington Beach. Not only does it greatly affect residents of the harbour, but it also
affects people from entire california that use the harbour as a visiting port I am highly
considering selling my waterfront home and moving to another city, such as Long
Beach, where the city shows better support for their residents In this respect, they have
bought the fuel docks,then leasing them out, due to them realizing how important
having a fuel dock is for their city Without a fuel dock In Huntington Harbor,there
will also be great safety concerns It is unbelievable that there will be no fuel dock in
such a major port People from everywhere are baffled on why this is happening, and
furthermore, are looking at Huntington Beach as a place that lacks support to their
residents

Good afternoon,
Writing to you in regards to the potential closure of the Huntington Harbour Mariner's Fuel Dock
As a Long time resident of Huntington Harbour(we are located on Waverly bay) And a avid boater/boat owner, it
would be incredible detrimental and a HUGE loss to have the Mariner's Fuel Dock Close
The closest full dock from the Harbour is either Newport of Long Beach, both which are not convenienity accessible to a
boater
Both which offer diesel/gas at a higher premium
Without a fuel dock in the Harbour, not only will it effect the VALUE OF OUR PROPERTIES, it will also effect the
RESOURCES of our HARBOUR'S EMERGENCY AND POLICE
The loss of the fuel dock will also decrease the usage and spending on local boating and travel
The loss of the fuel dock will result in residents considering relocating and selling their homes and boats
due to the loss of property value and inconvenience This could result in the loss of property taxes as received
for the more than 6000 boats in the Harbour
Also is will present Huntington Harbour as a NON resourceful Harbour to reside in due to the lack of services available
It will also limit and decrease our travels to other local ports and local Catalina island
It is critical that we investigate all purchase options to maintain the presence of the Fuel Dock at Mariners Fuel Dock

Agenda Item Pao.
I am writing to urge your approval of two important items on your Agenda this evening
1. Agenda Item 23 —Transparancy Ordinance- Recently, you as the sitting Council have moved toward greater
transparency and I applaud your efforts I believe each of you has at one time or another pledged your support
for transparency in our City government. Failure to adopt this Ordinance would send a message that those
pledges are not sincere, making adoption vital. I agree with those who have said that we should open up more
City contracts to the transparency envisioned by this ordinance, but urge you not to delay as the timing is
critical for contract negotiations. Instead, I am hopeful one of you will introduce an item expanding the
Transparency Ordinance in the near future I am especially pleased this is being presented as an Ordinance
and not a just an policy with no teeth.
2 Agenda Item 22—Mariner's Fuel Dock. I have spoken with dozens of people in the Huntington Harbour
Community who are grateful that the City has stepped forward and is working to assure a fuel dock remains as a
vital resource in Huntington Beach Not only is a Fuel dock critical to maintain property values in am important
part of our City, but it is a necessary safety resource as well.
