In 1963 , Bill Hartge , then City Engineer, initiated the program of maintenance in Huntington Harbour . At that 'time , the only developed area was Weatherly Bay .and Channel and Admiral and Gilbert Islands . Mr. Hartge had a small , pontoon-type boat designed and constructed for use in the maintenance program. A regular schedule of picking up debris in the main channels and catch basins was started once a week, The function was under the Public Works Department from 1963 to 1965 . By 1973 , the small boat had completely deteriorated beyond repair . Christiana Development Company donated a boat which is still used in the maintenance program. It is a made-over cruise boat and it is not really equipped for the job . The maintenance schedule was increased in 1974 to once a week from October 1 to March 31 and twice a week from April 1 to September 30 of each year . Although, after storms , special schedules are run. ,In 1977 , due to budget reductions , the Harbour maintenance program �—, was dropped completely . Councilwoman Wieder went to the County of Orange and secured funds to assist the City in reinstating the program. This funding consisted of half the actual cost up to $1, 250 per quarter . The program has remained the same since that time'. Beach Budget (Davenport , Humboldt , Trinidad) Salaries : 408 hours @ $5 , 00 per hour $2 ,040 Rentals (Portable restroom) : 4 @$175 , 00 per month for approximately three months 22100 TOTAL : $4 ,140 Harbour Budget Salaries : 1.,045 hours @ $9 . 53 per hour average $9,959 Fuel : 450 gallons per year @ $1 . 37 per gallon 616 Supplies : 12 sweepernets @ $8 , 50 each 102 6 boxes of plastic trash bags @ $20 per box 120 TOTAL $10 ,797 Cleaning Procedure Reaches : Sweep sidewalks adjacent to beaches , dump trash cans , clean portable restrooms , pick all debris from beach . This procedure is followed daily June through July , twice per week April , May and September, and once per week October through March. -2- Harbors : The maintenance procedtire fN-)r the harbor i to remove :i.=1 1 objects that would cause navi�a.t-iona.l problcrns , pick Ii , all debris from the catch basins that lead in from the. flood channels , and pick up debris in known bulkhead corners where trash collects most frequently . This is done when access to corners is ava_la.ble without going onto private docks . Attached is a map depicting the prob- leni areas within t;hc Yu-i.rbor . Every attempt is made to clean these areas time .permitting . The remaining time is spent cleaning debris from main channels , . This past year, 167 cubic yards of debris were removed from the channels . . The schedule for the harbor is twice a week from April through September (Tuesdays and Fridays ) , and once a week from October through March (Fridays) , plus special mainte- nance after rain storms . Trash collects in the harbor because wind normally blows floating debris into niches, corners and behind docks . The tide moves debris into the- back end of the channel but there is not enough tide or wind to move the debris back out . Yenrly Problems Ph debris that collects In the harbor .is caused byseveral things . The debris is pushed i_rito the canals from the main channel . Construc- ti.on areas are usually the worst . While an area is developing, we pick up lumber, plasterboard, foam cups and cans . The flood channels also dump into the harbor . Additionally , we find grass , shrubs and domestic debris , indicating some residents are contributing to the problem. Moss accumulates throughout the harbor. This is usually a seasonal problem occurring when there is a change in temperature in the water- ways . The moss breaks loose from the bottom of the water and accumu- lates on top . It is also brought in from the Bolsa Chica area . The i moss is a very fine material . It breaks up into tiny pieces and spreads throughout, the harbor . It is most difficult to pick up with the present maintenance boat and equipment . Cooler temperatures correct the problem. If the City should elect to start cleaning behind private docks and in boat slips , there would be a potential liability problem with the maintenance boat working around expensive private boats . City employ- ees working on private docks may damage private property or leave debris on docks after the waterway was cleaned, furthering our liability.. i Complaints After the July 23 , 1980 , meeting at Huntington Harbour, staff handled:'-\, the following complaints : -3- Mrs . Jeanne Smith, 16048 Bonaire Street Mrs . Smith was called 'on Thursday, July 24 , 11980 . -She. related that the city employees did' a good job out in the main channels' but that she lived in a corner area which was 'not picked up every time :' Staff informed Mrs . Smith of the maintenance procedure and advised her that he.r area would be picked up on each run . However, upon checking Mrs . Smith' s area, staff found the corner opposite to her area quite littered . It is boxed in by moored boats and a boat stored. on the dock, leaving no access to the corner . Therefore, shortly after the maintenance boat would finish cleaning. Mrs.. Smith' s corner, it would be littered again from the opposite corner . Mr: Ken Bourguignon Mr. Bourguignon called complaining that there were sewer lines on the docks at Trinidad Island that were not hooked up . He indicated that ."sewage was going into the harbor. Mr . Bourguignon was called by staff at his place of business but he was not in. Staff left name and number, but no call was received from Mr. Bourguignon. Staff called him again on Friday, July 25 , and was informed that Mr . Bcurguignon had discussed the sewer line problem with the head of the Building Division and was apparently satisfied. Mr. Monte Navare , 3691 Escape Circle Mr. Navare called complaining that the maintenance crew was not cleaning the areas that needed cleaning. He indicated debris collected behind his dock and said he had in the past waved the boat over to have them clean behind his dock but that the boat kept going down the main channel . Staff explained the maintenance procedure to Mr: Navare, and the liability involved in city employees going near private property. Mr. Navare was informed that if he would clean behind his own dock and leave the debris in plastic bags on his dock, the city .would pick them up . Mr . Navare indicated he -would accept full responsibility for any liability on his dock and would clean. his own dock, but he still felt the city should clean behind the docks , Staff informed Mr. Navare that the entire harbor mainte- nance program was being studied and that he could contact the City later for additional information. Mr. .John Tillotson, 16426 tadona. Circle Staff called Mr. Tillotson to respond to his complaint ,. but only after nine telephone calls was . staff informed that Mr . Tillotson was on vacation until August 11, 1980 , Solutions For a more efficient. maintenance program, a new maintenance boat should be designed and constructed . Communicate by letter and through the Harbour News that trash left on docks in plastic bags will be picked up on regular schedule days . upon telephone request to the Beach Operation Headquarters ( 536-5281) . _4_ Complaints will be handled according to need of -public safety . E Hartge L,ty.�LV, Subject Warner Avenue Bridge at Bolsa Date February 23, 1978 Chica Bay Some months ago the Bridge Department of the California Depart- ment of Transportation inspected the Warner Avenue Bridge at Bolsa Chica Bay. Pending receipt of the results of this inspection, City crews dug an exploratory hole adjacent to the west bulkhead of the bridge. Examination of the exposed timbers and of the piling showed that. emergency repair work is essential in order for the bridge to remain open for. arterial traffic use. There is an urgent necessity for a number of the existing wooden piles to be replaced as well as the timber pile cap which is heavily rotted. Cost estimates for this work are being determined at the time of this writing; however, additional exploratory work is required. It is requested that the City Administrator authorize the purchas- ing officer to obtain the required services and materials via Section 3.02.190 of the Municipal Code titled "Exempt and Emergency Procure- ments" for the repairs to the Warner Avenue Bridge. At the present time the northerly west bound two lanes of the Warner Avenue Bridge have been closed to traffic. We are using the two southerly lanes of the .bridge which are normally east bound for two-way traffic. The replacement of the Warner Avenue Bridge at Bolsa Chica Bay is included in Orange County' s major bridge program for fiscal year 1977-78. It will, however, probably be two years before the existing bridge is actually replaced. We are pursuing this replacement as quickly asithe required paper work permits. . At the present time there -are funds available in the City's contingency account (101593) which may be used for this project if the City Council so desires. Hartge, Director of Public Works DATE: November 15, 1977 ` SUBJECT: Establishment of Pierhead Lines Adjacent to Tract 9738 (Broadmoor Homes) and Tract 10004 (McGuire Partnership) STATEMENT OF PROBLEM: Pierhead lines have not yet been designated adjacent to the subject tracts and must now be established. RECOMMENDED ACTION: Adopt the attached resolution establishing pierhead lines which provide a wharfage width of 37 . 5 feet adjacent to Tract 9738 and 60 feet adjacent to Tract 10004 . ANALYSIS: A pierhead line is the line between a bulkhead and a waterway which separates the area open for navigation from the area in which mooring and docking of vessels is permitted. Pursuant to Section 13. 32. 020 of the Municipal Code, the distance from the bulkhead line to the pierhead line is determined by the City Council. The pierhead line is generally established on the Final Tract Map. However, in this case the blue border of the Tract Maps did not include the water area. The pierhead line is normally out 30 feet from. the bulkhead in local channels such as Tract 9738 and 50 feet in the main channel such as Tract 10004 . However, due to a requirement imposed by the Coastal Commission for public access to the docks, additional width is necessary. The center 82. 5 foot width in the local channel and 290 foot width in the main , channel is sufficient for navigation. The establishment of pierhead lines is coordinated with the Army Corps of Engineers, but is actually established by the City Council. FUNDING: No expenditure of funds is involved in this action. Pursuant to Section 13.32.020 of the Municipal Code, the pierhead line is determined by the City Council. You are right in your statement that, "Subcii- eiders generally construct and then dedicate streets to a public agency and that agency then is responsible for the maintenance and operation of those streets. " The analogy does hold true for "wet streets , " however, when the wet streets are of an arterial nature, as in the case of a main channel, the abutting property owners are not requested to bear the cost of maintenance. On the other hand, if a local channel silts up the Ciy will look towards the abutting property owner to contribute significantly to the .cost of dredging through an assessment district similar to that formed for a local street. There can be no doubt that the main channel serves boaters from outside of the Huntington Harbour area, as well as those living in the Harbour and in the City. There is also no doubt that silt from area-wide major flood channels enter into waters of the harbor. . One needs to only stand on the Warner. Avenue or Edinger Avenue bridge during or after a rain storm to witness the silt-bearing drainage water. As far as forming a special district for maintenance of the waterways is concerned, as suggested in your letter, the City . Council has in the past not only opposed the formation of new dis- tricts, but has taken steps to eliminate special taxing districts. By action dated August 24, 1976 your board declined to assume the dredging responsibility. To resolve the continuing dispute, negotiation of an agreement by and between the city and the Harbors, Beaches and Parks District, each paying one-half of the project cost, is recommended. Gentlemen: The need for dredging a small area in Huntington Harbor has been the subject of controversy by and between Huntington Harbor Corporation, the city of Huntington Beach and the Orange County Harbors, Beaches and Parks District for a considerable length of time. The area is shown on the attached sketch. The city has contended that the shoaling has been caused by deposition of material brought into the harbor by the flood control system. EMA stuAies have disproved this theory and on the recommendation of the Harbors, Beaches and Parks Commission, by Minute Order dated August 24, 1976, declined .to undertake the dredging, but did have the area buoyed as a shoal area in the interest of maintaining boating safety. The controversy continues, the city still contending that the work is a county responsibility (city letter dated September 23, 1976 enclosed) . The city estimates that approximately 6700 yards of material requires removal as shown on the attached exhibit. The cost of the project will be greatly affected by the distance the dredged material must be transported for disposal. As the city has not yet located a disposal site a project cost estimate is not available. The area to be dredged is partly on city property and partly on Huntington Harbor Corporation property. Huntington Harbor has agreed to convey an easement to the city for dredging and navigation. I'n view of the continuing controversy, and the frequent grounding of boats, it is. recommended that the Harbors, Beaches and Parks District fund pay one-half of the dredging cost as paid to a contractor provided October 11 , 1977 Honorable Board of Supervisors Re Huntington Harbor Dredging (District 2) Page 2 the city secure the easement, undertakes all the work including the numerous permits required and agrees to assume the responsibility for future dredging. Harbors, Beaches and Parks District participation as proposed is consistent with your board's practice in Newport Harbor when dredging is needed in areas under city jurisdiction. There is an accumulation of approxima- tely 27,500 cubic yards of material deposited from the time the channel was originally dug in the early 1960 ' s. I have 8 discussed the matter of obtaining assistance in the cost of dredging with other agencies such as the State Lands Commission, Corps of Engineers and the Environmental Management Agency of Orange County. There appears to be no chance of aid from the first two agencies in a reasonable period of time, if at all. The Environmental Management Agency appears to be receptive to consider budgeting some money as a harbor maintenance project. It is recommended that the City Council make such a request to the County of Orange in the form of a resolution. Taking advantage of this situation can result in a total installation cost of about $10,000.00.. These docks should have a life of about 10 years. If we should turn down this opportunity we would be faced with a cost of about .$35,000 for new docks. These docks would have a life :of about 20 years. If the proposed agreement by the Yacht Club is approved., we would in effect be partners in the site and both could profit :from the venture.'. If the agreement is not entered into and means are :found to construct the fire station, the entire savings would be the City.' s. As a result of Councilman Duke's concern of the docks being tied up to the City property, .the City. Attorney arrived at a legal opinion which states that :the City is in an undue liability situation. The City Attorney suggested that we notify Mr. Thompson, the owner of the dock, to remove the dock. A copy of the opinion is enclosed. This notice was issued by my letter of January 8 (copy enclosed) . You will note I suggested the docks be cast from the bulkhead and anchored a distance of ten (10)'. feet away. This area of the channel is owned by the City and we have juris- diction of allowing the docks to occupy this space. The reason for this is to preserve the docks in the immediate area. Mr. Thompson states that he has no space for storing the docks and his other option is to haul the docks to the dump. ` Recommendation Staff should have approval from the City Council to allow the docks to be anchored in the area immediately off shore from the bulkhead pending final disposition of the fire station site. r H. QUESTION 1. At the time the 1964 Corps of Engineers' Permit, was Section 7602.7 part of the code or was the Corps act- ing on the city's behalf in establishment of a pier- head line? ANSWER: Section 7602.7 of the Huntington Beach Ordinance Code became effective September 5, 1968 . The Corps of Engineers has no authority to act on behalf of the city, unless expressly authorized by the City Council and then it would be only within clearly defined parameters. In response to your question, the Corps was not acting on behalf of the city in establishing the pierhead line, but established it pursuant to their own independent authority. At the time of approval of ,Use Variance Permit No. 707 , the city clearly had the authority to impose as a condition of the issuance of the permit, a pierhead line, if it had chosen to do so. QUESTION 2. Based on the use variance permit issued by the city, can the Marina owners construct up to 91 slips instead of the 75 presently existing? If the city established the pierhead line which prevents the expansion to 91 slips, will the city be in violation of the court decision on Use Permit 707? ANSWER: It is my understanding that building permits have been issued for 75 slips and these 75 slips have, in fact, been constructed. The Marina owners cannot construct additional slips without the appropriate building per- mits from the city. Establishment of a pierhead line by the City Council would not contravene the court's decision No. 211820 on Use Variance 707. When the city issues a harbor permit for the construction of a certain number of boat slips, can the owner increase the number of slips which does not require new cons ruction and does not violate wharfage rights without violating this permit? Pierhead lines are normally indicated on the recorded tract maps for Huntington Harbour. The tract map which included this marina, did not define the wharfage area at time of recorda- tion. In 1974 a suit was filed by city of Huntington. Beach and Huntington Harbour Property Owners Association against the Huntington Harbour Corporation over this marina. As part of this lawsuit, agreements were reached as to the number and. location of boat slips to be allowed in this marina. The docking configuration, as approved by the Corps of Engineers in March 1971, was adopted by all parties concerned and con- struction was completed in December 1974. The proposed pierhead line is in conformance with the Corps permit and will result in a minimum width of eighty (80) feet of navigable channel between pierhead lines. This is a status report for the Council members who are concerned with the matter. Background Normally pierhead lines for Huntington Harbour are .indicated on the recorded tract map. The tract map which included this marina did not define the wharfage area. The actual construction of the Davenport Marina has occurred in three phases. In 1964, the main headwalk and 18 slips were constructed prior to the development of the present City harbor permit procedure. In 1967 , City Harbor Permit No. 354 was issued for the construction of nine slips on "A" dock. In 1972, City Harbor Permit No. 518 was issued for the construction of 48 slips on "B" , "C" and "D" docks. The total number of slips constructed to date is 75. Present Status In order to establish the wharfage area for this marina we have prepared drawings which indicate possible locations for a pierhead line. The drawing marked Exhibit "A" indicates a pierhead line along the outer edges of the existing docks and would result in the elimination of four (4) side-tie moorings on the extremities of the docks and establish a minimum navigable channel width of 70. 3 between pierhead lines. The drawing marked Exhibit "B" indicates a pierhead line for this marina. that has been suggested by the Huntington Harbour Property Owners Association. Under .this plan the location of the pierhead line would result in: 1. The elimination of six (6) side-tie moorings on the extremities _of the docks. 2. . The elimination of four (4) slips. 3. The removal of approximately 195. 3 linear feet of dock. 4. Establish a minimum navigable channel width of 70. 3 ' between pierhead lines. If the City Council adopts the Huntington Harbour Property Owners Association pierhead location, the City may be required to compensate the Memo - David D. The drawing marked Exhibit "C" indicates a pierhead line for this marina that has been suggested by the marina owner. Under this plan the pierhead line would be located at a distance of 13 ' from the outside edge of the existing docks and would result in the establishment of a minimum navigable channel width of 57. 3 feet between pierhead lines. Recommendation The matter may be heard by the full City Council at a public hearing. to hear arguments from the two parties. However, I suggest that we continue negotiations with both parties. Davidson, Date September 12 , 1973 Item L-1 on City Council Agenda of 9-4-73 The problem discussed by Mr. Davidson in his letter of August 20, 1973, is one of illegal excavation and dumping on a lot behind Sam' s Seafood in the city of Huntington Beach. Reportedly the material was removed by clam bucket or drag line from the channel bottom beyond the future bulkhead in the city of Seal Beach. Due to the fact the site is at the extreme westerly end of the City our grading inspector does not normally pass by this area in his inspections, and was unaware of the earth work. We were told of the work by Mr. Davidson in August or September 1972. The owner of the lot was contacted at that time and we were told that they planned to start construction of a bulkhead wall towards the end of the year. The stockpile of dirt was to be used for backfill behind the bulkhead. Work still has not commenced at the site and no permits have been issued. I have asked the City Attorney' s office to advise us of appropriate legal advice to remedy the situation. Attached is a copy of my memo of August 28, 1973. I discussed the matter with Mr. Van Derhyden, the Acting City Manager of Seal Beach. He states that they are indifferent to the situation in view of the fact the Corps of Engineers would be the permitting agency for work in the channel. H. E. NO. 1, SACRAMENTO 14 October 18, 1962 City Clerk City Hall Huntington Beach, California RE: Local Boating Ordinances Gentlemen: During its 1959 session, the California Legislature added to the Harbors and Navigation Code a provision (Section 662, Chapter 1454, Statutes of, 1959) that a copy of the local boating ordinances or laws and amendments thereto shall be filed in this office. In Its 1961 session, the Legislature amended Section 660, Harbors and Navigation Code to provide that local boating ordinances shall be submitted to the Division of Small Craft Harbors prior to adoption and at least 30 days prior to the effective date thereof. The intent of this legislation is to effect coordination of local boating regu- lations with state law, thereby eliminating conflicts, reducing confusion in the public mind, and facilitating enforcement of valid laws, regulations and ordinances. In accordance with the objectives indicated above, the Division is re-examining all boating ordinances currently in force.. WHEREAS , there is presently no Ordinance affecting the regulation of boating and water skiing within the City of Huntington Beach outside of the ocean areas ; and WHEREAS , there is presently being dredged a channel where boating operations and skiing operations can be carried on; and WHEREAS , in such area there are high voltage submerged cable; dredges, lighters and many boats shuffling to and from the dredginp, area; dredge pines and submerged anchor lines which become taut when moving back and forth creating a hazard ; and WHEREAS , the boating and water skiing operations are con- ducted in that area without regard to speed limits and serious injury could be done to persons and property and without effective regulations the public health, safety and welfare of persons and property would be .jeopardized; and WHEREAS , the adoption of this Ordinance as an emergency measure is necessary for the immediate preservation of the public peace, health, safety and welfare; NOW THEREFORE, in consideration of and by the above preamble and statement , the City Council of the City of Huntington Beach declares and defines that an. emergency exists necessitating the following Ordinance for the immediate protec~ion and preservation Of the public health and safetv. 1 . t Ord. That the term, motor boat, as used in this section, shall mean and include any and all vessels or water craft wholly or partially propelled by naptha, gaso- line or other motive power. Section 2. That except as herein otherwise provided, no person in command of any motor boat shall operate same or permit the same to be operated in inland waters or any harbor area, within the City limits of the City of Huntington Beach at a rate of speed in excess of five (5) nautical miles per hour. Section 3. This Ordinance shall be effective and apply to all areas within the City of Huntington Beach in which motor boats , as herein defined, or water skiing is being con- ducted, excepting only therefrom, that portion of the Pacific Ocean outside the high tide line. Section 4. This Ordinance, being an emergency measure for the immediate preservation of the public health and safety which emergency is set forth and defined in the preamble here- to shall take effect and be in force from and after the pass- age and adoption hereof .
