SUBJECT: Accept Sureties for Public Improvements required of the Beach
Promenade Project located at 21022 - 21190 Beach Boulevard
Statement of Issue: The required bonds for the Beach Promenade project, located at
21022 — 21190 Beach Boulevard (southeast corner of Beach Boulevard and Atlanta Avenue),
have been prepared and are ready for City Council acceptance.
Financial Impact: No funding required for this action.
Recommended Action: Motion to:
A) Accept Faithful Performance Bond No. PHSBO1400001 and Labor and Material Bond No.
PHSB000001, the sureties furnished for installation of the required public improvements;
and,
B) Instruct the City Clerk to file the bonds with the City Treasurer.
Alternative Action(s): Deny the recommended action.

REQUEST FOR COUNCIL ACTION
MEETING DATE: 8/15/2011 DEPARTMENT ID NUMBER: PW 11-050
Analysis: On June 22, 2010, the Huntington Beach Planning Commission approved,
among other entitlements, Tentative Parcel Map No. 09-079. This allowed the incorporation
of the vacated frontage road and adjacent property to enlarge the existing site from 6.74
acres to 9.42 acres, reconfigured some of the existing shopping center parcels and created
three new parcels for future building pads. In conjunction with the approved shopping
center expansion, the project developer is required to construct public improvements along
its Beach Boulevard and Atlanta Avenue frontages along with realignment of the public
storm drain pipeline that was conflicting with one of the new building pads. In compliance
with the project code requirements, the attached Faithful Performance Bond and Labor and
Material Bonds are being provided as sureties for the installation of the required public
improvements. The required bond amounts are: Faithful Performance $534,168 and Labor
and Materials $267,084.

(hereinafter designated as
"principal")is the owner of that certain property located at 21022-21190 Beach Boulevard in the
City of Huntington Beach;and
WHEREAS,on June 22, 2010 the City of Huntington Beach approved Tentative Parcel
Map No.09-079("entitlement")authorizing the development of certain improvements on the
Property("Project');and
WHEREAS,the City imposed conditions of approval on the Project,whereby Principal
agrees to install and complete designated public improvements for Beach Promenade Phase 11;and
WHEREAS,said principal is required under the terms of said entitlement to furnish a bond
for the faithful performance of said entitlement.
Now,therefore,we,the principal and Ullico Casualty Company
as surety,are held and firmly bound unto the City of Huntington Beach,hereinafter called"City",the
penal sum of Five hundred thirty-four thousand one hundred sixty-eight dollars($634,168.00
)lawful money of the United States,for the payment of which sum well and
truly to be made,we bind ourselves,our heirs,successors,executors and administrators,jointly and
severally,firmly by these presents.
The condition of this obligation is such that if the above bounded principal,his or its heirs,
executors,administrators,successors or assigns,shall in all things stand to and abide by,and well
and truly keep and perform the covenant,condition and provisions in the said agreement and any
alteration thereof made as therein provided,on his or their part,to be kept and performed at the time
and in the manner therein specified,and in all respects according to their true intent and meaning,
and shall indemnify and save harmless City,its officers,agents and employees,as therein

stipulated,then this obligation shall become null and void; otherwise it shall be and remain in full
force and effect.
As a part of the obligation secured hereby and in addition to the face amount specified
therefore,there shall be included costs and reasonable expenses and fees, including reasonable
attorney's fees incurred by City in successfully enforcing such obligation, all to be taxed as costs and
included in any judgment rendered.
The surety hereby stipulates and agrees that no charge,extension of time, alteration,or
addition to the terms of the entitlement or to the work to be performed thereunder or the
specifications accompanying the same shall in anywise affect its obligations on this bond, and it
does hereby waive notice of any change, extension of time, alteration or addition to the terms of the
entitlement or to the work or to the specifications.

WHEREAS,on June 22, 2010,the City of Huntington Beach approved Tentative Parcel

the performance of the work,to file a good and sufficient payment bond with the City cf Huntington
Beach to secure the claims to which reference is made in Title 15(commencing with Section 3082)
of Part 4 of Division 3 of Civil Code of the State of California.

bound unto the City of Huntington Beach and all contractors,subcontractors,laborers,matenalmer
and other persons employed in the performance of the aforesaid entitlement and referred to in the
