STATEMENT OF ISSUE:
In order to have sufficient time to establish criteria by ordinance for
the location of adult entertainment facilities, the existing moratorium
on the acceptance and processing of applications for licenses and permits
for such businesses should be extended for an' additional period of
eight (8) months.
RECOMMENDATION:
Adopt Ordinance No. 2478, an interim urgency ordinance extending the
prohibition against issuance of licenses and permits for new businesses
providing adult entertainment in the City.
ANALYSIS:
At its November 3, 1980 meeting, the City Council adopted Ordinance
No. 2465, placing a moratorium for a period of four months on the
acceptance and processing of applications for business licenses and ,
permits for new businesses providing adult entertainment in order to
allow the formulation of appropriate zoning regulations and standards
for location of such businesses.
During this period, the Department of Development Services identified
conunc�rcial properties in the City which conformed with similar locations
and zoning ordinances in other jurisdictions. Staff has also identi-
fied possible sites within which adult entertainment facilities could
be located and locational criteria established subject to a conditional
use. permit application . Staff is now refining the locational criteria ;

distances between establishments; and setbacks from churches, educa-
tional institutions, and residential areas . These refined criteria
should be established within 30 days to review with the committee,
after which time the Department of Development Services will work
with the Attorney ' s Office to prepare an ordinance for review by the
Planning Commission and the City Council . In order to allow sufficient
time for the completion of these tasks and the review period, the
City Council should adopt Ordinance No. 2478 extending the moratorium
for an additional period of eight months.
FUNDING SOURCE:
None required.
ALTERNATIVE ACTIONS:
1 . Not to adopt the urgency ordinance. The existing moratorium would
expire allowing new adult entertainment businesses to locate in
the City without adequate regulation.
