HomeMy WebLinkAboutCode Amendment 69-4 - Height Limits - CA 69-4 Page #7 - Council Minutes - 7/21/69 17 COMMUNICATION REGARDING ATTENDANCE AT.LEAGUE.OF CITIES MEETING The Clerk presented a communication from Roger Slates, Chairman of the Planning Commission requesting that Council consider sending additional commissioners to the League of Cities Conference to be held in San Francisco, California, September 28 through October 1, 1969. He further stated that he believed it would benefit the City if the Acting Secretary of the Planning Commission were also granted permission to attend the conference. On motion by Kaufman, Council authorized two Planning Commissioners, the Acting Secretary-,of the Planning Commission and two Recreation and Parks Commissioners to attend the League of Cities Conference to be held in San Francisco, California, September 28 through October 1, 1969. Motion carried. ORDINANCE NO 1511 '- ZONE CASE NO 69-14 - ADOPTED The Clerk gave Ordinance No. 1511 a second reading by title - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED BETWEEN ADAMS AVENUE AND PORTLAND STREET, AND WEST OF HUNTINGTON AVENUE (ZONE CHANGE CASE NO. 69-14)." ORDINANCE NO 1513 - AMBULANCE SERVICE - FIRST READING The Clerk gave Ordinance No. 1513 a first reading by title - "AN ORDINANCE,OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE AMENDING SECTIONS OF ARTICLE 221 CONCERNING AMBULANCE SERVICE." On motion by Bartlett, Council waived further reading of Ordinance No. 1513. When put to a vote the motion passed unanimously. f i Page #10 - Council Minutes - 6/2/69 HJ-N> 69- REQUEST - CREDIT TOWARD RECREATION AND PARKS FEE The City Clerk presented a communication from Mr. Jack Lincoln, Attorney, representing Income Property Specialists, Inc., developers of 12k acres of land located east of Sher Lane, approximately 660 feet south of Edinger Avenue, requesting credit toward Recreation and Parks Fees, and further requesting that Council authorize the developer to proceed to obtain permits for construction and defer the conveyance of the park site property until the matter can be finally determined. Mr. Jack Lincoln, Attorney, 500 S. Main, Orange, California, representing said developer, addressed Council and requested that Council consider his applicant's request for credit toward the Recreation and Parks fees for his development. The Recreation and Parks Director addressed Council and suggested that a Council committee be appointed to review this matter. Mayor Green requested that the Council Committee on Recreation and Parks Fees meet with Mr. Lincoln on Friday, June 6, 1969, at 3:30 P.M. in the Administrative Annex, to review the the request of Income Property Specialists, Inc, -7� 33 . CODE AMENDMENT NO 69-4 - HEIGHT LIMITS - APPROVED The City Clerk presented Code Amendment No. 69-4, on which a public hearing was held and closed at the meeting of March 17, 1969. This matter was then referred to the Planning Commission for further review. and determination was deferred to May 19, 1969. At this time it was again referred to the Planning Commission for revision to allow three story buildings to be erected on larger lots. On motion by Bartlett, Council approved Code Amendment No. 69-4, as revised, and directed the City Attorney to prepare an Ordinance amend- ing the Huntington Beach Ordinance Code. Motion carried. .a i AP PRECISE PLAN AMENDMENT NO 69-2 - PUBLIC HEARING - APPROVED Mayor Green announced that this was the day and hour set for a public hearing on Precise Plan of Street Alignment No. 69-2 0£ Elm and Ash Streets and Cypress and SycamoreAvenues, by reducing a portion of such rights-of-way from sixty feet to fifty-four and fifty-two feet; said streets being located south of Warner Avenue and west of Beach Boulevard, The Clerk informed the Council that all legal requirements for notifi- cation, publication and posting on said public hearing had been met and thA he had received no communications or written protests to Precise Plan Street Alignment No. 69-2, or to the recommendation of approval of the Planning Commission. At this time staff reports were presented for Council's information. Mayor Green declared the hearing open. There being no one present to speak on the matter, and there being no protests filed, either oral or written, the hearing was closed by the Mayor. On motion by Shipley, Council sustained the decision of the Planning Commission and directed the City Attorney to prepare an ordinance to effect the precise plan of the alignment of Elm and Ash Streets and Cypress and Sycamore Avenues, Motion carried. 860 Page #9 - Council Minutes - 5/19/69 REPORT - REDEVELOPMENT - SITE #12 The Assistant Planning Director -.presented maps of the Site #12 small lot consolidation project located east-of Beach Boulevard and north of Ellis Ave7iue, for Council's knformatione He then presented a brief resume' of the .,reasons this site was •chosen for possible action by the Redevelopment Agency. Mr. Clem Cole, 2446 Chislehurst-brive, Los Angeles, property owner, addressed Council and requested that Council defer this matter for.a six month,.period .of time so that'he and the other property owners may materialize their plans. Mr. Milton Monkeby, 14617 Jalon Road, LaMirada, .property owner, addressed Council and stated that he is in favor of proceeding with plans as developed by the Redevelopment Agency. Mayor Green directed that this matter be deferred to the June 16, 1969 meeting and further directed that the property owners be notified of this action s'o that they may be present to inform Council of their positions in"`this matter. CODE AMEN)16iT;NO 69-3 - APPROVED The Assistant City Clerk presented Code Amendment No. 69-3, .which pro- poses to amend Article 968 (-0- Combining Oil District) by renumbering, rewording .and adding various sections to said Article and proposes to reword Section 9700 (n) Definitions, The public hearing was held and closed on'May 5, 1969, with the decision of the Council deferred to this date. On motion by Coen, Council approved Code Amendment No.. 69-3, and directed the City Attorney to prepare an Ordinance amending the Huntington Beach Ordinance.Code. Motion carried, CODE AMENDMENT NO 69-4 - HEIGHT LIMITS .—CONTINUED , The Assistant City Clerk presented Code-Amendment No. 69-4, on which a public hearing was held and c-losed at the meeting of March 17, 1969, at which time Council directed that it be referred back to the Planning Commission to consider the feasibility of allowing three story build- ings to be erected on larger lots., The Assistant Planning Director presented Code Amendment No. 69-4 with changes requested. Considerable discussion was bald by Council regarding setback require- ments in the RI zone. On motion by Bartlett, Council directed that Revised Code Amendment No, b9-4 be referred back to the Planning Commission for change to require that three story dwellings in Rl zones be allowed by a Use Permit rather than by amendment to the Ordinance Code. Motion carried. 846 Page #13 - Council Minutes - 3/17/69 �o CODE AMENDMENT NO 69-2 - PUBLIC HEARING - CONTINUED Mayor Coen announced that this was the day and hour set for a public hearing on Code Amendment No. 69-2, which proposes to amend Division 9 of the Huntington Beach Ordinance Code (1) Permit Planned Residential Development subject to a Site Plan approval in the R1, R2, and R3 Residential Districts; (2) Define a Planned Residential Development; (3) Establish development standards .for such Planned Residential Development under Article 599 - Site Plan; (4) Establish a $100.00 filing fee for Site Plans pertaining to Planned Residential Development. The Clerk informed the Council that all legal requirements -for notifi- cation, publication and posting on. Code Amendment No. .69-2 had been met. The Clerk informed the Council that they had been provided with copies of the Planning Secretary's transmittal, and stated that he had received no communications or written protests to Code Amendment No. 69-2, or to the recommendation of approval of the Planning Commission. Mayor Coen declared the hearing open. On motion by Matney, Council continued Code Amendment No. 69-2 to the next regular meeting. Motion carried. Also amending S. 9202.6 R3 Zone to permit a maximum building height of three (3) stories when set back more than 100 feet from an Rl District. The Clerk informed the Council that all legal requirements for notifi- cation, publication and posting on Code Amendment No. 69-4 had been met. There being no one further to speak on the matter, and there being no protests filed, either oral or written, the hearing was closed by the Mayor. City of Huntington Beach P. 0. Box 190.. Huntington Beach, California Gentlemen: Re Code Amendment T #69-4 which is presently before you. Current code re R-1, R-1 PD5, R-2 and R-3 states that "the maximum building height shall not exceed 2 stories or 30 feet." Proposed change #69-4 will modify, for the R-1, R=l PD5 and R-2 Districts', the Code, to read .that such height shall not exceed 2 stories. In no event in such District shall the building height exceed thirty feet. The Code Amendment will in effect restate with greater rigidity the City's 30' height limitation in these districts . With one exception, we feel that provisions for exceeding such heights may properly be handled by the. proposed High-Rise Ordinance, which we understand the City is drafting. .The exception, we feel, is R-1 Districts . The 30'• height limit° in R-1 Districts creates a monotonous uniformity very much .like the "walled tract" requirements of our Code. In order to provide .more variation, flexibility and better design,. the Chamber recommends that no �height limit,be specified in R=l Districts. We feel .that the economics of single-family residence will effectively limit such heights to such as are reasonable and attractive and yet allow desired design variations . If deemed necessary, a home that is to exceed 30 feet could be made subject to additional plan approval of the. City. It was the unanimous recommendation of the Planning Commission to amend the proposed code amendment by adding Section 9102.6.1 (c) to allow three story structures in any R-1 zone. If this code amendment is adopted according to the suggested changes it will allow three story structures in any R-1 zone, subject to issuance of a Use Permit by the Board of Zoning Adjustments. Reynolds RE: Code Amendment No. 69-4 (Height Limits) ATTN: Doyle Miller, City Administrator Gentlemen: The Planning Commission at their May 6, 1969, meeting reviewed your request to consider expandin the provisions of Code Amendment No. 69-4 (Height Limit 5 with the possibility of permitting three story dwellings in the R-1 District. It was the unanimous recommendation of the Planning Commission to amend the proposed code amendment by permitting three story structures in the R-1 and R-2 zones. If this code amendment is adopted according to the suggested changes it will allow: 1. Three story dwellings in the R-1 zone provided the three story buildings are setback 100 ft. from the boundary of their development, and 2. Three story buildings in the R-2 and R-3 zone provided the three story buildings are setback 100 ft. from an abutting R-1 development. The 100 ft. separation may be waived when the development is separated from adjacent property by a public street in the R11 R2, or R3 zones and may be reduced to 85 ft. in the R-2 and R-3 zone where carports are constructed on the property line for separation purposes.
