REIMBURSEMENT - H H BRUDERLIN - RESOLUTION NO 3065 - ADOPTED
The Assistant Cityy Administrator requested that Council authorize reim-
bursement of $1,0/+7.00 to Henry H. Bruderlin for the construction of an
off-site sewer in Heil Avenue and Algonquin Street and a sewer pump
station, per Reimbursement Agreement No. 102.
The Clerk read Resolution No. 3065 by title - "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF
MONEY FROM THE SEWER FUND."
On motion by Shipley, Council waived further reading of Resolution
No. 3065, and passed and adopted same by the following unanimous roll
call vote:
AYES: Councilmen: Shipley, Bartlett, McCracken, Kaufman, Matney,
Coen, Green
NOES: Councilmen: None
ABSENT: Councilmen: None
PREVENTION OF REFUSE DISPOSAL - CENTRAL CITY PARK
The Assistant City Administrator informed Council that considerable
dumping of cement, dirt, soil and other construction materials was
occuring on the site of the Central City Park and that he had conferred
with the City Attorney regarding this matter.
Discussion was held by the Council and City Attorney regarding the feasi-
bility of filing injunction action against the responsible parties.
On motion by Kaufman, Council authorized the City Attorney to file
injunction actions to restrain and enjoin the dumping of soil, cement
and other debris and fill material upon property adjacent to the Central
City Park site. Motion carried.

On motion by Coen, Council directed the Clerk to read Ordinances 1532,
1533, 1535, by title, waived further reading and passed and adopted

ORDINANCE NO 1534 - REQUIREMENTS - Ml-A & Ml ZONES - ADOPTED
The Clerk read a communication from Mr. George A. Shibata, Attorney,
17955 Beach Boulevard, City, requesting that Council study this Ordinance
further, as he believed it would hinder industrial development in the
City.
The Clerk read Ordinance No. 1534 by title - "AN ORDINANCE OF THE CITY
OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY
AMENDING SECTIONS THEREOF REGULATING THE REQUIREMENTS FOR FRONT, SIDE
AND REAR YARDS IN THE Ml-A AND M1 ZONES."
On motion by Shipley, Council waived further reading of Ordinance
No. 1534 by the following unanimous roll call vote:

ORDINANCE NO 1534 - REQUIREMENTS - Ml-A & Ml ZONES - FIRST READING

The Clerk gave Ordinance No. 1534 a first reading by title - "AN
ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH
ORDINANCE CODE BY AMENDING SECTIONS THEREOF REGULATING THE REQUIREMENTS
FOR FRONT, SIDE AND REAR YARDS IN THE Ml-A AND M1 ZONES."
Considerable discussion was held by Council a,s to the effect this pro-
posed ordinance would have in relationship to the industrial growth of
the City.
On motion by Kaufman, Council waived further reading of Ordinance
No. 1534. When put to a vote the motion passed unanimously.
REPORTS - COUNCIL COMMITTEES
Multi-family Zoning Study
Councilman Matney stated that the Multi-family Zoning Study Committee
was still in the process of gathering information and would present a
report for Council's consideration at a later date.
COMMENTS FROM COUNCIL
League of California Cities -- Committees
Mayor Green reported that the State Director of the League of California,
Cities had requested that any Council members who wish to be named to
League committees contact him as soon as possible.
COMMENDATION - SHERATON BEACH INN
Mayor Green expressed appreciation on behalf of the City Council and
Police Department to the Sheraton Beach Inn f-or their invaluable assist-
ance and co-operation for the use of their facilities in the pursuit
and supression of a vice-ring operating in this area.

ZONE CASE NO 69-14 - PUBLIC HEARING - APPE-L._- -WM BRAY - -AP ROVED
Mayor Green announced that this was the day and hour set for a public
hearing on an appeal filed by William Bray to the denial by the Planning
Commission of Zone Case No. 69-14; on property located north of Portland
Street, approximately 125 feet west of Huntington Street, for a change
of zone from R3-0 Limited Multiple Family Residence District, with a
50 foot setback from the ultimate right-of-way line.
The Clerk informed the Council that all legal requirements for notifi-
cation, publication and posting on said public hearing had been met,
and that he had received no communications or written protests to Zone
Case No. 69-14.
At this time staff reports were presented for Council's information.
Mayor Green declared the hearing open.
Mr. William Bray, appellant, 1701 Park Street, City, addressed Council
and gave reasons why he felt his application for a zone change should
be approved by Council and submitted maps of the area.
There being no one further present to speak on the matter, and there
being no protests filed, either oral or written; the hearing .was closed
by the Mayor.
On motion by Coen, Council overruled the decision of the Planning
C,,,.-=-•-��sion and-approved Zone Case No. 69-14 as ieques tgd,by Mr. Bray,
and directed the City Attorney to prepard- an ,6rdinance-limending the
Huntington Beach Ordinance Code. Motion carried.

CODE AMENDMENT NO 69-6 - PUBLIC HEARING - APPROVED
Mayor Green announced that this was the day and hour set for a contin-
uance of a public hearing on Code Amendment No. 69-6, which proposes
to. amend Sections 9430.2 (Retail Stores and 9430.5 (Services) by adding
to the permitted uses in the C2 Community Business District. Said
hearing was opened at the meeting of .Tune 2, 1969 and continued to this
date.
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor.
On motion by Coen, Council approved Code Amendment No. 69-6, and
directed the City Attorney to prepare an Ordinance amending the Huntington
Beach Ordinance Code. Motion carried.
ZONE CASE NO 69-12 - PUBLIC HEARING - CONTINUED TO AUGUST 18, 1969
Mayor Green announced that this was the day and hour set for a contin-
uance of a public hearing on Zone Case No. 69-12, on property located
400 feet south of Warner Avenue, 660 feet west of Edwards Street for
a change of zone from RI to R3. Said hearing was opened at the meeting
of .Tune 2, 1969 and continued to this date.
There being no one to speak on the matter and there being no protests
filed, either oral or written, the hearing was continued to August 18, 1969.
On motion by Green, Council continued hearing on Zone Case No. 69-12 to
August 18, 1969, to allow the Homeowner's Associations and the Macco
Corporation an extension of time to endeavor to reach a suitable agree-
ment on this matter. Motion carried.

CODE AMENDMENT NO 69-6 - PUBLIC HEARING - CONTINUED
Mayor Green announced that this was the day and hour set for a .public
hearing on Code Amendment No. 69-6, which proposes to amend Sections
9430.2 (Retail Stores) and 9430.5 (Services) by adding to the per-
mitted uses in the C2 Community Business District.
The Clerk informed the Council that all legal requirements for notifi-
cation, publication and posting on Code Amendment No. 69-6 had been
met, and stated that he had-received no communications or written
protests to Code Amendment No. 69-6, or to the recommendation of approval
of the Planning Commission.
The Planning Director presented a report on this matter for Council's
information.
Mayor Green declared the hearing open.
Mayor Green then requested interested parties to refrain from speaking
on the matter at this time and directed that the Public Hearing on Code
Amendment No. 69-6 be continued to the meeting of June 16, 1969, at
which time a further report by the Planning Director would be available
for Council's information.
ZONE CASs NO 69-11 - PUBLIC HEARING - APPROVED
Mayor Green announced that this was the day and hour set for a public
hearing on Zone Case No. 69-11, on property located on the north side
of Garfield Avenue, 150 feet west of Stewart Street and legally described
as Lot 4, Block F, Garfield Street Addition, for a change of zone from
RA-0 Residential Agricultural District, combined with oil production,
to M1 Light Industrial District.
The Clerk informed the Council that all legal requirements for notifi-
cation, publication and posting on said public hearing had been met,
and that he had received no communications or written protests to Zone
Case No. 69-11, or to the recommendation of approval of the Planning
Commission.
At this time staff reports were presented for Council's information.
Mayor Green declared the hearing open.
There being no one present to speak on the matter, and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor.
On motion by Shipley, Council sustained the decision of the Planning
Commission and directed the City Attorney to prepare an ordinance .
effecting the change of zone in Zone Case No. 69-11. Motion carried.
