YOUTH COALITION COMMITTEE - "WEEK OF AGAPI" - LAKE PARK CLUEEOUSE '
Mr. Jim Sampson, Chairman of the Youth Coaltion Committee informed Council
that their organization planned to hold an event called the "Week of
Agapi" at the Lake Park Clubhouse and requested that Council authorize
an expenditure of $50.00 for refreshments to be reimbursed to the City
from ticket sale proceeds. .
Mayor Green stated that this expenditure had been previously authorized,
but that he had requested Mr. Sampson's presence at the meetin� tonight
for the purpose of informing the Council of the "Week of Agapi event
planned by the committee.
FISH & CHIP'6PERATION - MUNICIPAL PIER - APPROVED
The City Administrator informed Council of a recommendation from the
Director of Harbors, Beaches and Development, that Pier Building I on the
municipal pier be leased by the city to Mr. Carl McCullah for a fish and
chip operation.
On motion by Coen, Council approved the recommendation of the' Directors
of Harbors, Beaches and Development and approved the lease of Pier Build-
ing 1 to Mr. Carl McCullah to conduct a, fish and chip operation and
authorized the Mayor and City Clerk, upon approval by the City.'.Attorney,
to execute same on behalf of the City. Motion carried.

On motion by Kaufman, Council directed the Clerk to read Ordinance
Nos. 1560, 1561, 1563 and 1564 by title, waived further reading and
passed and adopted same by the following unanimous roll call vote:

Considerable discussion was held by Council regarding Ordinance No. 1565.
Fire Chief Picard spoke briefly regarding the addition of the 'Civic
District Suffix' to the code and its effect upon the Design Review Board.
On motion by Shipley, Council directed the Clerk to read Ordinance
No. 1565 by title and waived further reading by the following unanimous
roll call vote:

PLACEMENT OF PLAQUES - PARKING AUTHORITY PROJECT
The City Administrator requested Council direction regarding the pre-
paration of the Dedication Plaque for the 2400 space Beach Parking
Authority complex.
On notion by Shipley, Council authorized the Ciby Administrator to
proceed with preparation of the Dedication Plaque on which the names
of the present Council members will be inscribed, to be placed in
the Beach Parking Authority complex. Motion carried.

designated to establisl civic district;-*, which_ may be placed around
civic centers, public park3, public buildL—IE_s or cublic grounds in order
to protect tine public, interest, in najc,r public develcpments and
the procedure for Design Review Board review of plans in this district
prior to any permit being issued and the manner in whict appeals may be
made to the City Council.
The Clerk informed Council that all legal requirements for notification,
publication and posting on said public hearing had been met and that lie
had received no communications or written protests to Code Amendment
No. 70-2, or to the recommendation of a
Mayor Green declared the hearing open.approval of the Planning Commission.
On motion by McCracken, Council continued the public hearing on Code
Amendment No. 70-2 to the meeting of March 2, 1970. Motion carried.

PUBLIC HEARING - CODE AMENDMENT 1\10. 70-3 - APPROVED
Mayor Green announced that this was the day and hour set for a, public
hearing on Code Amendment No. 70-3 which proposed to amend Articles 951
MI-A, 953 - Ml and 955 - M2 industrial Districts by adding the require-
ments that all uses which do not require Use Permit approval shall be
subject to Administrative Review by the Board of Zoning Adjustments.
The Clerk informed Council that all legal requirements for notification,
publication and posting on said public hearing had been met and that he
had recieved no communications of written protest to Code Amendment
No. 70-3 or to the recommendation of approval of tn.e Planning Commission,
The Planning Director presented a resume' of the Planning Commission's
reasons for recommending approval of Code Amendment No. 70-3.
Mayor Green declared the nearing open.
There being no one present to speak on the matter, and there being no
protests filed either oral or written, the hearing was closed by the
Mayor.
On motion by Kaufman, Council sustained the Planning Commission and
approved Code Amendment No. 7C-3 and directed the City Attorney to pre-
pare an Ordinance amending t.b.e Huntington Beach Ordinance Code. Motion
carried.

REQUSST - ACTION AGAINST OILSPILLAGE
Mrs. Ann Turner, 80 Huntington Street, City, addressed Council and
requested that action be taken to prevent, the occurrence of oil spills
which endanger the lives of animals, fowl and possibly children.
Mayor Green stated that the city is attempting to implement stricter
controls to prevent oil spillage and requested that she report occurTance
of this nature to the City Administrator. Motion carried.

Transmitted herewith is Code Amendment No. 70-3. Said
amendment proposes to amend Articles 951 - M1-A, 953 -
M1 and 955 - M2 Industrial Districts, by adding the re-
quirements that all uses which do not require use permit ap-
proval shall be subject to administrative review by the Board
of Zoning Adjustments.
The Planning Commission unanimously approved this matter on
January 20, 1970, and recommends adoption by your Honorable
Body.

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY REPEALING SECTION 9551 . 1, AND AMENDING
AND ADDING CERTAIN SECTIONS PERTAINING TO PER-
MITTED USES IN THE INDUSTRIAL DISTRICTS
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. Sections 9511(4) and 9551 .1 of the Huntington
ae
Beach Ordinance Code *!thereby repealed.
SECTION 2 . The Huntington Beach Ordinance Code is hereby
amended by amending Sections 9511, 9530 and 9551 to read as follows :
9511. USES PERMITTED. The following uses and regulations
shall be permitted in the Ml-A, "Restricted Manufacturing District , "
subject to approval of an administrative review application by the
Board of Zoning Adjustments .
9530 . USES PERMITTED. The. following uses and regulations
shall be permitted in the Ml, "Light Industrial District ," subject
to approval ..of an administrative review application by. the Board
of Zoning Adjustments .
9551. USES PERMITTED. The following uses and regulations
shall be permitted in the M2, "Industrial District , " subject to
approval of an administrative review application by the Board of
Zoning Adjustments .
General manufacturing uses .
Steam electrical generating stations .
SECTION 3 . The Huntington Beach Ordinance Code is hereby
amended by adding Section 9511 .1 thereto to read as follows :
9511 .1. USES SUBJECT TO APPROVAL OF A USE PERMIT. Commercial
and professional uses, permitted in the R5 and C2 districts, may
be permitted subject to the approval of a use permit when such
uses are not open to the public but are designed or intended to be
used only by the employees of the industrial use .

SECTION 4 . If any section, subsection, sentence , clause ,
phrase or portion of this ordinance is for any- reason held to be
invalid or unconstitutional by the decision of any court of com-
petent ,jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance . The City Council of
the City of Huntington Beach hereby declares that it would have
adopted this ordinance and each section, subsection, sentence ,
clause , phrase or portion thereof, irrespective of the fact that
any one or more sections , subsections , clauses , phrases or portions
be declared invalid or unconstitutional .
SECTION 5 . The provisions of these sections insofar as they
are substantially the same as existing provisions of the Huntington
Beach Ordinance Code relating to the same subject matter shall be
construed as restatements and continuations and not as new enact-
ments .
SECTION 6 . Neither the adoption of this ordinance nor the
repeal hereby. of any ordinance shall in any manner affect the
prosecution for violation of ordinances , which violations were com-
mitted prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinances relating to the
collection of any such license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to ,any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect .
SECTION 7 . This ordinance shall take effect thirty days after
its adoption. The City Clerk shall certify to the passage of this
ordinance and cause same to be published within fifteen days after
adoption in the Huntington Beach News , a newspaper of general circu-
lation, printed and published in Huntington Beach, California .
PASSED AND ADOPTED by the City Council of the City of Huntington
Beach at a regular meeting thereof held on the day of ,
