HomeMy WebLinkAboutCode Amendment 70-4 - Ordinance 1599 - Article 924 of Chapte Page #5 - Council Minutes - 9/8/70 The Clerk read communications from the Huntington Center Merchants Association and the Huntington Beach Chamber of Commerce stating -their opposition to the proposed Utilities Tax. Mr. Al Hanner, Manager of the Broadway Department Store, City, addressed Council and stated that passage of a utilities tax could have a detri- mental effect upon the business community resulting in personnel cut- backs, diminished utility usage and curtailment in promotional activities. Mr. George West, manager of J. C. Penny Department Store, City, addressed Council and stated that he was strongly opposed to the proposed utilities tax, based on the effect it would have on the economy of local businesses in competing with businesses in other communities. Mr. Dick Crowl, Newport Beach City Councilman addressed Council regard- ing this matter and the proposed increase in the business license fees for apartment dwellings. Considerable discussion on the matter was held by Council. Page #9 - Council Minutes - 8/17/70 PUBLIC HEARING - CODE AMENDhIENT NO. 70-4 - MOBILEHON+IE STANDARDS 4' Mayor Pro Tempore Matney announced that this was the day and hour set for the continuance from the meeting of August 3, 1970, of a public hear- ing for the purpose of considering a proposed Code Amendment to add to Division 9 of the Huntington Beach Ordinance Code Article 924 - MH - Mobilehome District; such district to be established to set `orth minimum standards for mobilehome parks. Several provisions of the proposed ordinance amendment were discussed by Council. A motion was made by Councilman Matney to delete S. 9242.1 (c) pertaining to on site mobile home sales from the proposed Code Amendment 70-4. When put to a vote the motion was carried unanimously. On motion by McCracken, Council directed that the Planning Director's recommendation that the minimum site area be designated in the code as 9242.2 (d) rather than 9242.3. Motion carried. Mr. Bob McIntosh, representing Signal Landmark Mobile Home Division, addressed Council and stated that he believed that this proposed amend- ment would create a better environment in general for mobile home facilities. There being no one further present to speak on the matter and there being no protests filed either oral or written, the hearing was closed by the Mayor Pro Tempore. On motion by Green, Council approved Code Amendment No. 70-4, as amended, and directed the Clerk to read. Ordinance No. 1599. Motion carried. (., AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING THERETO ARTICLE 924 OF CHAPTER 9,2 ESTABLISHING REGULATIONS FOR MOBILEHOME PARKS The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by adding thereto Article 924 of Chapter 92 , being Sections 9240 through 9242. 17 , to read as follows : CHAPTER 92 ARTICLE 924 MOBILEHOME DISTRICT 9240 . INTENT AND PURPOSE . This article is established to set forth minimum standards for mobilehome parks in recog- nition of the fact that mobilehomes are being used to satisfy a portion of the demand for permanent housing and as such, the establishment of minimum standards for mobilehome parks is a necessary step toward the promotion of a better living environment . In those areas concerning mobilehomes and mobile- home parks in which the city has no authority to adopt regula- tions , the state regulations shall apply, and in those areas in which the city has authority to adopt regulations and both the city and state have adopted regulations , the more restric- tive regulations shall apply. 9241. DEFINITIONS. Except as specifically defined in Article 970 of thie code, the terms in this article are used as defined in the Mobilehome Act in Health and Safety Code Sections , 18000 et seq. , and in Title 8 of the California Administrative Code, commencing with Section 16250 . 9242. 1. USES PERMITTED. The following uses are permitted in the "MH," Mobilehome Di"strict subject to the regulations contained herein provided an application for use permit is first approved by the Board of Zoning Adjustments : 1 . (a) Mobilenomes within a mobilehome park . (b) Use;, normally found in conjunction with mobilehome parks that are incidental to the park and operated for the convenience of the residents thereof. (c) In a newly-established mobilehome park, on-site sale of new mobilehomes may be permitted provided such mobile- homes are to be loca ed on the perimeter of the mobilehome park In order to maintain n integrated , aesthetically-pleasing , architecture and desig four such mobilehome park. After filling; the spaces on the perim t,er and upon issuance of a use permit by the Planning Commission, ,as set forth in Article 984 of thiU code, on-site sale of m•�bi' ehomes to be located in other portions of the mobilehome park ma e permitted . The Planning Commis- sion may impose any co? ditio upon the issuance of such permit which it deems reasonable and necessary to preserve the appear- ance of the mobilehome park ad the city ' s planned development . 9242. 2 . CRITERIA FOR APPROVAL. Prior to approving an application for an "MH" zone , the Planning Commission shall consider the following: (a) The relationship of the proposed mobilehome park to surrounding land use . (b) Soil conditions . (c) Access to the area under consideration . (It is preferred that such area abut an arterial highway from which the primary //means of access should be obtained . ) ""- `d)MINIMUM SITE AREA. The minimum site area shall be ten (10) acres . 9242 . 4 . MAXIMUM DENSITY . The maximum density shall be nine (9) spaces per gross acre . Such area shall not include open or public land as defined in this code . A maximum of one mobilehome .hall be permitted per mobile- home space, provided that this requirement shall not prohibit the combining of two or more mobilehome modular units to create a single residence. 9242. 5 . MAXIMUM BUILDING HEIGHT. (a) The maximum building height for mobilehomes shall not exceed twenty (20) feet and shall not exceed one story ex- cept that two-story mobilehomes that do not exceed a height of thirty (30) feet may be permitted upon approval of a use permit application therefor by the Planning Commission. 2 . (b) The maximum building height for all structures other than recreation buildings and mobilehomes shall not ex- ceed fifteen (15) feet and shall not exceed one story. (c) The maximum building height for recreation buildings shall not exceed thirty-five (35) feet . 9242.6. RECREATION AREA. A minimum of two hundred (200) square feet of recreation and leisure area shall be provided for each mobilehome space within the park . Such area may be in one or more locations and shall be arranged so as to be readily accessible to all residents of the mobilehome park. 9242.7. STORAGE SPACE. The mobilehome owner shall pro- vide a minimum of 150 cubic feet of enclosed, usable storage space on his mobilehome space. Said storage space shall be provided prior to occupancy of such mobilehome . Storage space within the mobilehome shall not satisfy all or any part of the requirements of this section. 9242. 8. SCREENING REQUIREMENTS . In order to provide a buffer between mobilehome parks and abutting uses , the standards set forth in this section shall apply . (a) An opaque screen having a minimum height of six (6) feet shall be installed and maintained along but no closer than six (6) feet from the ultimate right of way of any public street . Where there is a difference in elevation on opposite sides of the screen, the height shall be measured from the highest grade level. Such screen shall consist of one or any combination of the following: (1) Walls . A wall constructed of concrete , stone, brick, the or similar type of solid masonry material, having a minimum thickness of six (6) inches . (2) Berms . A berm shall not exceed twenty (20) feet in width at the-Fa—se and shall be constructed of earthen materials and it shall be landscaped to the right of way line . (b ) The setback between the walls or berm and the right of way line shall be landscaped, equipped with a sprinkl- ing system or adequate substitute approved by the Board of Zon- ing Adjustments, and such area and sprinkling system or substi- tute shall be permanently maintained. Cc) Screening along public streets and variations in the type of screening along public streets and in landscaping is encouraged, and a plan depicting the location and type of screen and a general landscaping scheme shall be submitted to the Board of Zoning Adjustments with the use permit application. 3 . (d) A six (6) foot high concrete or masonry wall shall be provided as a buffer along all interior boundaries of the mobilehome park. The height of such walls shall be measured from the highest grade level . (e) The Board of Zoning Adjustments may grant exceptions to the requirements of this section if the Board determines that the intent of these requirements will be carried out. 9242. 9. MINIMUM SETBACKS FOR MOBILEHOMES . The follow- ing setback requirements shall apply to mobilehomes and all accessory structures : (a) Front Yard Setback. The minimum front yard setback shall be five (5) feet . Such front yard shall be landscaped. (b) Rear Yard Setback . The minimum rear yard set- back shall be five (5) Peet . (c) Side Yard Setback. The total side yard set- back for both side yards shall not be less than ten (10) feet . In no case shall the minimum side yard on any one side of the mobilehome be less than three (3) feet . 9242 . 10. MAXIMUM COVERAGE . The area of space covered by a mobilehome and related structure shall not exceed seventy- five percent (75%) of the mobilehome space . 9242. 11. PARKING REQUIREMENTS . Two conveniently acces- sible parking spaces shall be provided for each mobilehome space . Each parking space shall have a minimum dimension of nine feet by nineteen feet (9 ' X 191 ) and may be arranged in tandem. One of the required spaces shall be covered (this requirement shall be satisfied prior to occupancy of each mobilehome) . Guest parking shall be provided at the rate of one (I) parking space for each three (3) mobilehome spaces . Such parking shall be provided in off-street parking bays and shall conform to the requirements of Article 979 of this code . Where parking is permitted on one or both sides of a driveway , such parking may be used to meet the guest parking requirements . Guest parking shall be evenly distributed throughout the park so as to be available to all spaces . 9242. 12. DRIVEWAY STANDARDS. (a) The minimum driveway width for all driveways within a mobilehome park shall be thirty-three (33) feet 4 . except where parallel parking is permitted on both sides of the street , in which case a minimum street width of forty-one (41) feet shall be provided . (b) The inside radius on turns for driveways shall be twenty-five (25) feet . (c) Construction of base paving, curbs and gutters on all private driveways shall. be approved by the Department of Public Works . (d). , Surface drainage along the driveway within the mobilehome park shall be by means of concrete gutters . (e) A lighting system shall be installed along all driveways . Such lighting system shall be approved by the Department of Public Works . 9242. 13 . TREE PLANTING. (a) Public Streets . One twenty (20) inch box tree shall be provide or each e ghty ( 80) feet of mobilehome park frontage along a public street . The arrangement of such trees shall be approved by the Street Tree Superintendent . (b) On-Site Trees . One fifteen (15) galion . tree shall be provided on each mobilehome space . This requirement shall be satisfied prior to occupancy of the mobilehome on such space . 9242. 14 . SCREENING OF UNDERCARRIAGE. The undercarriage of all mobilehomes shall be screened from view on all sides except that an access panel shall be provided according to state requirements. 9242. 15. BOAT OR TRAILER STORAGE. Areas in the mobile- home park shall be set aside for boat or trailer storage . Such areas shall be enclosed or screened from view by a six (6) foot high fence or wall and shall be maintained in a neat and orderly manner. Consideration should be given to adjacent uses and the area should be situated in such a manner as to maintain a compatible relationship between uses on same property and adjacent prop- erty . 9242. 16. TRASH COLLECTION. Trash collection areas or individual trash .pickup for each space shall be provided. Where trash collection' areas are provided, such areas shall be ade- quately distributed throughout the park and shall be enclosed or screened from view by a six (6) foot high fence or wall and shall 5 • be maintained in a neat and sanitary condition. 9242. 17. SIGNS . All sign-- shall conform to the require- ments of Article 976 of this code . SECTION 2. This ordinance shall take effect thirty days from its adoption. The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days of its adoption in the Huntington Beach News , a newspaper of general circulation, printed and published in Huntington Beach, California .
