HomeMy WebLinkAboutCode Amendment 70-6 - Ordinance 1601 - Section 9762.6 - Sign Page #5 - Council Minutes - 9/8/70 The Clerk read communications from the Huntington Center Merchants Association and the Huntington Beach Chamber of Commerce stating their opposition to the proposed Utilities Tax. Mr. Al Hanner, Manager of the Broadway Department Store, City, addressed Council and stated that passage of a utilities tax could have a detri- mental effect upon the business community resulting in personnel cut- backs, diminished utility usage and curtailment in promotional activities. Mr. George West, manager of J. C. Penny Department Store, City, addressed Council and stated that he was strongly opposed to the proposed utilities tax, based on the effect it would have on the economy of local businesses in competing with businesses in other communities. Mr. Dick Crowl, Newport Beach City Councilman addressed Council regard- ing this matter and the proposed increase in the business license fees for apartment dwellings. Considerable discussion on the matter was held by Council. Following reading by title, on motion by Green, Council waived further reading of Ordinance No. 1598 by the following roll call vote: AYES: Councilmen: Green, Bartlett, McCracken, Gibbs, Matney, Shipley NOES: Councilmen: None ABSENT: Councilmen: Coen On motion by Green, Council passed and adopted Ordinance No. 1598, by the following roll call vote: AYES: Councilmen: Green, Gibbs, Matney, Shipley NOES: Councilmen: Bartlett, McCracken ABSENT: Councilmen: Coen ADDITIONAL ORDINANCES FOR ADOPTION The Clerk informed Council of a correction on Section 9242 (d) of Ordinance No. 1599 pertaining to the minimum site area. On motion by Green, Council directed. the Clerk to read Ordinance Nos. 1599, 1600, 1601, and 1602 by title, waived further reading and passed and adopted same by the following roll call voter AYES: Councilmen: Green, Bartlett, McCracken, Gibbs, Matney, Shipley NOES: Councilmen: None . Page #10 - Council Minutes - 8/17/70 PUBLIC HEARING- CODE AMENDMENT 70-6 - SIGNS - APPROVED Mayor Pro Tempore Matney announced that this was the day and hour set for a public hearing on Code Amendment 70-6, continued from the meeting of August 3, 1970, to consider a proposed Code Amendment to amend. Section 9762.6 of the Huntington Beach Ordinance Code by rewording such section to prohibit all signs (including, but not limited to political signs) from public rights-of-way (city streets.) There being no one present to speak on the matter and there being no protests filed either oral or written, the hearing was closed by the Mayor. On motion by Green, Council approved Code Amendment No. 70-6 and directed the Clerk to read Ordinance Pic. 1601. Motion carried. The Clerk gave Ordinance No. 1601 a first reading by title - "AN ORDINANCE OF THE CTTY CF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9762.6 PERTAINING TO ERECTION OF SIGNS ON PUBLIC PROPERTY OR PUBLIC RIGHTS OF WAY." On motion by Green, Council waived further reading of Ordinance No. 1601, by the following roll call vote: AYES: Councilmen: Green, Bartlett, McCracken, Matney, Coen NOES: Councilmen: None ABSENT: Councilmen: Gibbs, Shipley PUBLIC HEARING - RES. OF INTENTION NO. 3192 - WARNER AVENUE VACATION Mayor Pro Tempore Matney announced that this was the day and hour set for a public hearing on Resolution of Intention No. 3192 of the City Council of the City of Huntington Beach to vacate a portion of Warner Avenue in the City of Huntington Beach. The Clerk informed the Council that all legal requirements for notifi- cation, publication and posting on said, public hearir_g had. been met and that they had been provided with copies of the Resolution of Intention; and stated that he had received no communications or written protests to the proposed. vacation or to Resolution No. 3192 of the City Council. Mayor Pro Tempore Matney declared the hearing open. There being no one present to speak on the matter, and there beir_g.no protests filed, either oral or written, the hearing was closed by the Mayor Pro Tempore. On motion by Green, Council approved the vacation of a portion of Warner Avenue and directed the Clerk to read Resolution No. 3204. Motion carried. The Clerk read Resolution No. 3204 by title - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDER THE VACATION OF A PORTION OF WARNER AVENUE IN SAID CITY." On motion by Green, Council waived further reading of Resolution NO. 3204 by the following roll call vote: AYES: Councilmen: Green, Bartlett, McCracken, Matney, Coen, NOES: Councilmen: None ABSENT: Councilmen: Gibbs, Shipley PUBLIC HEARING - ZONE CASE 70-10 - P.C. RES. OF INTENT - APPROVED Mayor Pro Tempore Matney announced. that this was the day and hour set for a public hearing for the purpose of considering a proposed change of zone in Oil Combining Districts on property bounded. by Pacific Coast Highway on the southwest, Brookhurst Street on the east, Ellis Avenue on the north and the city limits on the northwest. 249 Page 10 - Council Minutes 8/3/70 Mr. Jack Feehan, District Manager of Southern California Gas Company, addressed Council and introduced Mr. Rufus McKinley, attorney for .Southern California Gas Company, who presented. a report on the pro- posed. Car Franchise. There being no one further present to speak on the matter and. there being no further protests filed, either oral or written, the hearing was closed by the Mayor Pro Tempore. The City Clerk presented Ordinance No. 1595 for a first reading by title - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH GRANTING TO PACIFIC LIGHTING SERVICE COMPANY, A CORPORATION, THE RIGHT, PRIVILEGE AND FRANCHISE TO LAY AND USE PIPES AND APPURTENANCES FOR TRANSMITTING AND DISTRIBUTING GAS FOR ANY AND ALL PURPOSES UNDER, ALONG, ACROSS OR UPON THE PUBLIC STREETS, WAYS, ALLEYS AND PLACES, AS TITS SAME NOW OR MAY HEREAFTER EXIST, WITHIN SAID MUNICIPALITY. On motion by McCracken, Council waived further reading of Ordinance No. 1595, by the following unanimous roll call vote: AYES: Councilmen: Green, Bartlett, McCracken, Gibbs, Matney, Coen NOES: Councilmen: None ABSENT: Councilmen: Shipley PUBLIC IIEARING - PRECISE PLAN NO. 7o-6 - APPROVED Mayor Pro Tempore Matney announced that this was the day and hour set for a public hearing to consider a Precise Plan of Street Alignment to establish access to and circulation within that property bounded by Beach Boulevard on the east, Edinger Avenue on the south, Gothard Street on the west and McFadden Avenue and the San Diego Freeway on the north. The Clerk informed. Council that all legal requirements for notification, publication and posting on said public hearing had. been met and that he had received no coiimunications or written protests, other than the letter of appeal, to the recommendation of approval of the Planning-Commission. Mayor Pro Tempore Matney declared the hearing open. Mr. W. E. Foster, President of the Huntington Beach Company, addressed Council and urged approval of Precise Plan No. 70-6. There being no one further present to speak on the matter and there being no protests filed, either oral or written, the hearing was closed by the Mayor Pro Tempore. The Planning Director addressed. Council and. explained. the various aspects of the proposed Precise Plan. On motion by Green, Council sustained. the decision of the Planning Commission, approved. Precise Plan No. 70-6, and. directed. the City Attorney to prepare an ordinance effecting the Precise Plan of street alignment. Motion carried.. The Huntington Beach Ordinance Code is hereby amended by amending Section 9762.6 to read as follows: 9762.6. ERECTION OF SSIGNS ON PUBLIC PROPERTY OR PUBLIC RIGHTS OF WAY PROHIBITED. Except as otherwise permitted in this code, no person or persons shall erect , place or display (or cause any such act or acts to be done) any sign, sign structure or advertising dev.1ce. in, under, on or over any public property or any public, right of way with respect to which the city has Jurigdictfton. Any such sign, sign struc- ture or advertising device erected, placed or displayed - contrary to the provisions of this section is a public nui- sance and the Department of Pub.lic.
