NEWLAND NO. 5 ANNEXATION - REFERRED TO CITY CLERK
The Clerk presented a communication from Corine, Julien and Donna
Lecrivain, legal owners of the parcel of land located on the north-
west corner of Talbert Avenue and Newland. Street, requesting that
the city proceed with the annexation of same, said annexation to
be designated as Newland #5 Annexation.
The City Clerk further informed. Council that the property owners
have waived. any right to hearing before the City Council.
Following discussion, on motion by Green, Council deferred action
on this matter, and directed the City Clerk to present a report
on the possibility of enlarging the annexation to include the
entire parcel. The motion was passed by the following vote:

T. C. SALE NO. 1097 - COUNTY OF ORANGE
The Clerk presented a letter from the County Tax Collector stating the
intention of .his office to sell at public auction a parcel of land
located on the south side of Seventh Street, between Orange and Olive
Avenues - Lots 22 and 24, Block 306, AP 24-141-02, for a minimum bid
price of $5,000, pursuant to provisions of Division 1, Part 6, Chapter 8,
Article 2, of the Revenue and Taxation Code, State of California.
On motion by Bartlett, Council objected to Tax Collector's Sale #1097,
authorized the Mayor and City Clerk to execute an agreement to purchase
AP 24-141-02, pursuant to provisions of Division 1, Part 6, Chapter 8,
Article 2, of the Revenue and Taxation Code, State of California; agreed
to guarantee expenses of purchase and sale as set forth. in Section
3793.6 of said code; and directed the Finance Director to draw a
warrant for the required amount when billed by the County. Motion
carried.
CODE AMENDMENT NO. 70-9 - APPROVED �1
The Clerk presented Code Amendment No. 70-9 which proposes to amend
Sections 9166.6 (R2 District), 92o6.6 (R3 District), and 9236.6 (R4
District) to require all residential lots and/or parcels within the
area bounded by Pacific Coast Highway on the southwest, 23rd Street on
the northwest, Palm Avenue on the north and northeast and Lake Street
on the east and. southeast, which abut upon an alley to take access to
all garages, carports and open parking from such abutting alley only.
The Clerk stated that a public hearing had been held on Code Amendment
No. 70-9 on February 1, 1971, and any decision deferred to this meeting.
On motion by Green, Council sustained. the Planning Commission, approved
Code Amendment No. 70-9; and directed the City Attorney to prepare an
ordinance amending the Huntington Beach Ordinance Code. Motion carried.
PLAzdNING COMMISSION ZONING STUDY REPORT
The Clerk presented a transmittal from the Planning Commission of a
Zoning Study on property located at the southwest corner of Atlanta
Avenue and Newland Street.
As requested by Council, the Planning Commission considered. rezoning of
the property from R2 and R3 to R1 and submitted the following recommenda-
tions for Council consideration:
1. The existing R2 and R3 zoned. 8.68 acre parcel, located
at the southwest corner of Atlanta Avenue and Newland
Street should not be changed to R1.
2. The Planning Commission will initiate a Resolution of
Intent to rezone the remaining property within this
study area from R2 and. R2-0 to R1.
3. The Planning Commission will initiate precise plan of
street alignment for Lochlea Lane, Banff Lane, Cupar
Lane and a future street.
Councilman Matney asked. Planning Commissioner Kerins to prec;ent the
Planning Commission's minority report for Council's information.
Mr. Ed Kerins, Planning Commissioner, addressed Council and stated that
he and Planning Commissioner Duke believed that the rezonin<; of this
area to R1 would be beneficial to the City as the sphere of influence
around the area is low density and apartment development wc,ld degrade
the area.
Mr. Wellman Mills, owner of the 8.68 acre parcel on the corner of
Atlanta Avenue and Newland. Street, addressed. Co,,ncil and gave reasons
why he believed that the property should remain as current-.y zoned.
Mr. L. B. Fredricks, representing Fredericks Development Company,
addressed Council and requested that Council hold this matter in abeyance
until they research the possibility of constructing cond.om�.niums on this
property.

Mr. .Terry Shea, attorney, representing the Huntington Beach Company,
2110 Main Street, City, addressed Council and stated that his company
favored. adoption of the proposed ordinances.

being no protests filed, either oral or written, the hearing was closed
by the Mayor.
On motion by McCracken, Council directed the Clerk to read the afore-
mentioned ordinances by title, and waived further reading by the

PUBLIC HEARING - Z014E CASE NO. 70-26 - APPROVED
Mayor Shipley announced that this was the day and hour set for a. public
hearing on Zone Case No. 70-26, on property located at the northwest
corner of Yorktown Avenue and. Brookhurst Street for a change of zone
from RA Residential Agricultural District to C4 Highway Commercial
District with a 50 foot setback from the ultimate right-of-way line.
The Clerk informed Council that all legal requirements for notification,
publication and posting on said public hearing had been met and. that he
had received no communications or written protests to Zone Case No.
70-26 or to the recommendation of approval of the Planning Commission.
Mayor Shipley declared the hearing open.
There being no one further present to speak on the matter and there
being no protests filed, either oral or written, the hearing was closed
by the Mayor.
On motion by Bartlett, Council sustained the decision of the Planning
Commission; approved Zone Case No. 70-26, and directed the City Attorney
to prepare an ordinance effecting same. Motion carried.

Florida Street, 600 feet north of Garfield Avenue for a change of zone
from R2 Two Family Residence District to R5 Office-Professional District.
The Clerk informed Council that all legal requirements for notification,
publication and posting on said. public hearing had been met and that he
had received no communications or written protests to Zone Case No.
70-27 or to the recommendation of approval of the Planning Commission.
Mayor Shipley declared the hearing open.
There being no one further present to speak on the matter ar] there
being no protests filed., either oral or written_, the hearing was closed
by the Mayor.
On motion by Green, Council sustained the decision of the Panning
Commission; approved Zone Case No. 70-27, and directed the City Attorney

On motion by McCracken, Council deferred decision on Code Amendment No.
70-9 for 30 days, and referred the matter to staff for further study.

PUBLIC HEARING -- APPEAL - U.F. NO. 7o-42 - A.W. KNOX - DENIED
Mayor Shipley announced that this was the day and hour set for a public
hearing on an appeal filed by A. W. Knox, 3322 Easter Circle, City, to
the approval by the Planning Commission of Use Permit No. 70-42, to
allow the construction of a 63 unit planned. residential development on
approoximatexl�y 8.18 acres parcel of land in the RI Single Family Residence
anit,rictHumb ?t Ergerty located at the southwest intersection of Saybrook
The Clerk informed Council that all legal requirements for notification,
publication and posting on said public hearing had been met and that he
had received no communications or written protests to Use Permit No.
70-42, other than the letter of appeal.
Mayor Shipley declared the hearing open.
Mr. A. W. Knox, appellant, addressed Council and. introduced Mr. James
Dupree, representing the Huntington Harbour Property Owners Association.
Mr. Dupree stated that the Association opposed. the development because
of the detrimental effect the high density factor would have on their
property, and gave suggestions for alternative planning of the area which
would be more compatible.
Mr. A. W. Knox, then addressed Council and presented an informal petition
listing signatures of approximately 587 residents in the area who oppose
the planned development, and. stated that the major objection of the home-
owners was the overcrowding of people, housing and boats which will re-
sult if this development is allowed.
Dr. John Murphy, 16371 Ardsley Circle, City, addressed Council and stated
his opposition to the development due to the congestion which would occur,
and possible pollution of the water from the additional vessels in the
channel.
Mrs. Jo Ann Johnson, 4052 Humboldt Drive, City, addressed Council and
stated that he opposed the development due to the increased density
which would result. He stated that he would not be opposed to a standard
R1 development, however, he believed the R1 Planned Development proposed
for this area is unsuitable.
RECESS
Mayor Shipley called. a recess of the Council at 10:10 O.M. Counc:°_i was
reconvened at 10:38 P.M.
Mr. Don Byrnes, representing the Huntington Harbour Corporation, addressed
Council and. outlined in detail the suitability of this project to the
area.
Mr. Robert Jones, representing the architectural firm of Robert E�. Jones
and Edward Hahn, La Jolla, California, addressed Counc _1 and displayed
a map and. sketches of the proposed development. He urr;ed. Council approval
of Use Permit No. 70-42, stating that the developers had complied with all
requirements of a Planned Residential Development, and that the project
would in no way be detrimental to the other residences in Huntingtton
Harbour.

BID AWARD - CITY YARD STORM DRAIN - CC-168 - DABOVICH
The Clerk read a communication from the Public Works Department stating
that bids for Project CC-168 - City Yard Storm Drain, had been opened
at 10:00 A.M. on Monday, September 21, 1970, in the Administrative
Conference Room by the City Clerk, City Attorney and the City Engineer,
and that the firm of Mike Dabovich, Hacienda Heights, California, was
the low bidder with a bid in the amount of $66,974.90. The City
Engineer recommended that Council award the bid to Mike. Dabovich, and
reject all other bids. The bids submitted were as follows:

On motion by Bartlett, Council awarded the contract for Project CC-168
to Mike Dabovich - Hacienda Heights, California, the lowest responsible
bidder, for a bid amount of $66,974.90; rejected all other bids and
directed the Clerk to notify the unsuccessful bidders and return their
bid bonds. Motion carried.

GOLDVATEST & SLATER PROPERTY PROPOSAL - DEFERRED TO EVENING PORTION OF MTG
The City Administrator requested that the subject of a lease proposal
of 6.8 acres of property located at Goldenwest Street and Slater Avenue
be deferred to the 7:30 P.M. portion of the Council meeting.
Mayor Shipley directed that cots ideration of this matter be deferred to
the evening portion of the Council meeting.
AUTHORIZATION TOxATTEND CONFERENCE - ECONOMIC DEVELOPMENT OFFICER
The City Administrator recommended that Mr. Bill Back, Economic Develop-
ment Officer be authorized. to attend the Urban band Institute Conference
in Scottsdale, Arizona, from October 7, through October 10, 1970, with
reasonable expenses allowed.
On motion by Matney, Council approved the recommendation of the City
Administrator and authorized Mr. Bill Back, Economic Development Officer
to attend the Urban Land Institute Conference in Scottsdale, Arizona,
from October 7 through October 10, 1970, with reasonable expenses allowed.
Motion carried.

COASTAL & HUNTINGTON BEACH FREEWAY CONSTRUCTION
The City Administrator addressed Council and stressed the importance of
the construction of the Coast and Huntington Beach Freeways in connection
with the furthering of industrial and commercial development of the City.
On motion by Matney, Council instructed the Urban Land Institute-Citizen
Steering Committee to proceed immediately in coordinating construction
of the Coast Freeway, the Huntington Beach Freeway and related highways.
Motion carried.

ORDINANCE NO. 1605 - ADOPTED - BUSINESS LICENSE FEES
Councilman Green stated that a representative of the Apartment House
Owners Association was present to state the organization's views on the
adoption of Ordinance No. 1605.
Mr. Alan Bannick, President of the Orange County Apartment House Owners
Association addressed Council and read a letter from the Association
protesting adoption of Ordinance No. 1605.
A motion was made by Councilman McCracken to amend Ordinance No. 1605,
by deleting Section 2114.2.21 which requires a $6.00 per unit increase
in business license fees charged to apartment dwellings. when voted
upon the motion failed to pass.
Mr. Roger Slates, Planning Commission Chairman addressed Council regarding
the apartment vacancy factor in Huntington Beach.
The Clerk was directed to give Ordinance No. 1605 a second reading by
title - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTING-
TON BEACH ORDINANCE CODE BY AMENDING CERTAIN PORTIONS OF CHAPTER 21, AND
ADDING THERETO SECTION 2114.3 RELATING TO BUSINESS LICENSE FEES."

ORDINANCES FOR INTRODUCTION
The Clerk recommended two changes in Ordinance No. 1605, pertaining to
business license fees, which he believed would be beneficial to the City;
the first change would. provide for elimination of the fiscal year as
a basis for the issuing of business licenses, and secondly, to delete
Section 2114.2.35 pertaining to vending machines, from the 50 per cent
increase as provided in the proposed ordinance.
A motion was made by Councilman Matney to approve the amendment to
Ordinance No. 1605, as recommended by the City Clerk. When put to a
vote, the motion was unanimously carried.
A motion was made by Councilman McCracken to amend Ordinance No. 1605
by deleting S. 2114.2.21, which requires a $6.00 per unit increase in
business license fees charged to apartment dwellings. When voted
upon, the motion failed. to pass.
On motion by Green, Council directed the Clerk to read Ordinance
Nos. 1603, 16o4, and. Ordinance 1605 as amended, by title, and. waived.

Mayor Shipley announced. that this was the day and hour set for a public
hearing to consider an appeal filed by Wm. Lyon Development Company,
to the denial by the Planning Commission of Zone Case 70-11, for a
change of zone from C4 Highway Commercial District to R3 Limited
Multiple Family Residence District on property located. on the north
side of Holland Drive, approximately lbO feet east of Beach Boulevard.
The Clerk informed Counc _1 that all legal requirements for publication,
notification and. posting had beer. met and. that he had received no commu-
nications or written protests to Zone Case 70-11 or to the recommendation
of denial of the Planning Commission.
Mayor Shipley declared the hearing open.
Mr. Clarence Walton, representing Lambert Ross, addressed Council and.
gave reasons why he believed Council should approve Zone Case No. 70-11.
Mr. Bob Farrell, Project Manager for William Lyon Development Co.,
addressed Council and. presented an outline of the proposed development
of the property.
Mr. Thomas Murdock, 8271 Holland Drive, President of the Dutch Haven
Homeowner's Association, addressed Council and stated that the residents
of the area opposed a change of zoning, as they believed. commercial
development of this property was preferable to residential use.

The Clerk informed Council that all legal requirements for notification,
publication and posting on said public hearing had been met and that
he had received no communications or written protests to Zone Case
No. 70-10 - Resolution of Intent of the City Planning Commission.
Mayor Pro Tempore Matney declared the hearing open.
There being no one present to speak on the matter and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor Pro Tempore.
On motion by Green, Council continued this matter to the meeting of
September 8, 1970. Motion carried.

Mayor Pro Tempore Matney announced that this was the day and. hour set
for a public hearing to consider a proposed code amendment amending
Article 981 - Board of Zoning Adjustments, Article 942 - C2 Community
Business District, and Article 945 - C3 General Business District to:
1. Require a public hearing on a complaint for Home
Occupation by the Board of Zoning Adjustments.
2. Add hardware stores, animal grooming, car wash and
mortuary to the uses within the C2 District. Also
adding a provision for other re-:ail uses or services
not specifically provided for that may be permitted
subject to approval of a Use Peamiit application; and
3. Require approval of administrat:_ve review by the Board
of Zoning Adjustments for all u;;es in the C3 zone which
do not require use permit approval.
The Clerk informed. Council that all legal requirements for notification,
publication and. posting can said public hearing had been met and that
he had received no communications or written protests to Code Amendment
70-10 or to the recommendation of approval of the Planning Commission.
