That he is the printer and publisher of the Huntington Beach V

of local and other news of a general character, and has a bona fide
subscription list of paying subscribers, and said paper has been
established, printed and published in the State of California, an

devoted to the interest of, or published for the entertainment of any /

Gentlemen:
Transmitted herewith is a copy of Code Amendment
No. 71-21. Said amendment proposes to permit that
portion of a two story dwelling which is constructed
over a garage or carport abutting an alley to be set
back ten (10) feet from the centerline of such alley.
The Planning Commission, at their September 8, 1971
meeting, unanimously approved Code Amendment No. 71-21
and recommends approval by your Honorable Body.
The State Planning Act requires that a public hearing
be held after which the Code Amendment may be adopted
by ordinance.

3 That the following changes are proposed to the Huntington Beach Ordinance
Code: The intent being to permit that portion of a two story; dwelliag
4 which is constructed over a garage or carport abutting an alley to be
set back ten (10) feet from the centerline of such alley. Said changes
5 shall read as follows:

7 RENUMBERED: (none)
8 AMENDED:
9 S.9163.3 Rear Yard: The minimum rear yard shall be ten (10) feet;
however, that portion of a two story dwelling
10 which is constructed over a garage or carport abutting an alley need
not be set back further than ten (10) feet from the centerline of such

SUBJECT: Code Amendment No . 71-21
Upon recommendation of the Planning Commission and
Council direction, the attached ordinance is submitted
amending Section 9163 . 3 to permit that portion of a
two-story dwelling, constructed over a garage or car-
port adjacent to an alley, to extend ten feet toward
such alley but not beyond the property line .
