Gentlemen: Transmitted herewith is a copy of Code Amendment No . 71-24. Said Code Amendment proposes to amend two portions of the Huntington Beach Ordinance Code . The first portion proposes to repeal Article 913 (Rl-PD5) . The second portion proposes to clarify the yard requirements in residential districts by establishing where the setbacks are to be measured from when abutting the public right-of-way. The Planning Commission, at their November 2 , 1971 meeting , unanimously approved Code Amendment No . 71-24 and recommends approval by your Honorable Body. ADDED: (none) l of I s a MEMORANDUM TO: Planning Commission FROM: Richard A. Harlow RE: Code Amendment No. 71-24 Date: November 2, 1971 This code amendment proposes to amend two portions of the Huntington Beach Ordinance Code. The first portion proposes to repeal Article 913 (RI-PD5). The second portion proposes to clarify the yard requirements in residential districts by establishing where the setbacks are to be measured from when abutting the public right-of-way. The repeal of Article 913 was initiated by the staff because this article has been on the books since December 1962 with no indication that the district would be used. Also, there is no longer any use for this district since the adoption of Article 931, permitting Planned Residential Developments. The portion of the amendment proposing to clarify the yard requirements was also initiated by the staff because of difficulties in determining the precise location from which the setback would be measured. The staff recommends approval of Code Amendment No. 71-24.
