At the request of the Planning Director, the Mayor directed that second reading of
Ordinance No. 1796 pertaining to Zone Case No. 72-36 be deferred pending the sub-
mission of an Exemption Declaration.
On motion by Bartlett, Council directed the Clerk to read Ordinance Nos. 1808, 1809,
1810 and 1811 by title; waived further reading and adopted same by the following

The Administrator informed Council that due to typographical errors they had been
provided with corrected copies of Ordinance No. 1802, and the Clerk stated that they
had been provided with corrected pages 2 and 3 of Ordinance No. 1814.
On motion by Matney, Council directed the Clerk to read Ordinance Nos. 1802 and 1814
by title and waived further reading by the following roll call vote:

AMENDMENT NO. 2 - JOINT RECREATION AGRMT. - FOUNTAIN VALLY - H.B. - APPROVED -
Approved Amendment No. 2 to the Joint Development - Arevalos School Comity
Recreation Agreement to add the Samuel Talbert School as an additional location .
of said agreement; that location plans, and construction schedules be provided

JOINT p0WERS AGRMT. INTERGOVRaNMENTAL COORDINATING COUNCIL OF O.C. CONTINUED
The Assistant City Clerk presented the Joint Powers Agreement Creating the Inter-
governmental Coordinating Council of Orange County with the revisions made by the
Intergovernmental Coordinating Council Committee as directed by Council at the
October 16, 1972 and November 6, 1972 meetings.
Mayor Coen spoke regarding his reservations about the Council continuing on as a.
prospective member of the Joint Powers Agreement and stated that he believed the
Council should refrain from taking any further action which will cbmmit.the City
in any respect to being a part of the agreement, including any financial commitment,:. .
until the Council finds out more specifically what the majority of the other cities
are doing and why, relative to the Intergovernmental Coordinating Council.
Discussion was held by Council on the matter.
On motion by Green, Council continued consideration of the Joint Powers Agreement -
Intergovernmental Coordinating Council of Orange County to the meeting of February 20,
1973, by the following roll call vote:
AYES: Councilmen: Bartlett, Gibbs, Green, Matney, Duke, Coen
NOES: Councilmen: None
ABSENT: Councilmen: Shipley
The Council directed that a letter be sent to the organisation's representative ex-
pressing the Council's concern relative to their continued involvement and stating
that action might be taken by Council to reverse their previous decision.
. c PUBLIC HEARING CODE AMENDMENT NO 72-11 APPROVED ORD, No, 1811 - FIRST RFADIM
Mayor Coen announced that this was the day and hour set for a public hearing .on Code:
Amendment No. 72-11, initiated by the Planning Commission, to provide for variation
in the yard requirements, establish procedures for review of truck and rail loading
facilities, and to amend landscaping requirements of off-street parking facilities
(Article 979) in the Ml-A Restricted Manufacturing District.
The Assistant City Clerk informed.Council that all legal requirements for publication
and posting had been met, and that she had received no communications or written prow-
tests to Code Amendment No. 72-11 or to the recommendation of approval by the
Planning Commission.
The Planning Director presented a resume' of the Planning Commission's reasons for
recommending approval of Code Amendment No. 72-11.
Mayor Coen declared the hearing open.
There being no one present to speak on the matter, and there being no protests filed,
either oral or written, the hearing was closed by the Mayor.

PUBLIC HEARING - ZONE CASE NO. 72-35 - CONTINUED
Mayor Coen announced that this was the day and hour set for a public hearing on- Zone
Case No. 72-35 for a change of zone on approximately 48 acres of land from M2-02 Indus-
trial District, combined with .oil production, to RA-02 Residential Agricultural: District,
combined with oil production, on property located at the southwesterly corner of Golden-
west Street and Garfield Avenue.
The Planning Director stated that his department had submitted a communication requesting
that the hearing be opened and continued to the next meeting in order that it may be heard
concurrently with Code Amendment No. 72-33 which requires right of way dedication and im-
provement for agricultural uses subject to review by the Board of Zoning Adjustments and
criteria contained therein.
Mayor Coen declared the hearing open.
Mr. W. E. Foster, 2110 Main Street, City, representing the property owner, addressed
Council briefly on the matter.
A motion was made by Councilman Bartlett to continue the public hearing on Zone Case No.
72-35 to the meeting of January 15, 1973.
In response to a question from Councilman Matney, Mr. Marcus Porter, Planning Commission
Chairman, stated that it had been the Planning Commission's intent that the hearings on
Zone Case No. 72-35 and the forthcoming Code Amendment be held concurrently.
The motion made by Councilman Bartlett to continue the public hearing on Zone Case No.
72-35 to the meeting of January 15, 1973, was passed by the following roll call vote:

Gentlemen:
Transmitted herewith is a copy of Code Amendment No. 72-11.
This code amendment will amend the M1-A District and require
variations in yard requirements, establish procedures for re-
view of truck and rail loading facilities and will amend
landscaping requirements for off-street parking facilities.
The Planning Commission unanimously approved Code Amendment
No. 72-11 at its December S , 1972 meeting, and recommends
approval by your Honorable Body.
The State Planning Act requires that a public hearing be held
after which the Code Amendment may be adopted by ordinance.
Background Information:
On November 11 , 1971 , the staff and representatives of the
Lusk Company met to discuss several sections of the code dealing
with industrial development.
In February of this year the staff and Planning Commission re-
viewed the following problem areas :
1. Landscaping requirements
2. Front, exterior and side yard setbacks
3. Interior side yard setbacks

4. Trucking and loading facilities
S. Through traffic west on McFadden Avenue
Our ideas were referred to the industrial committee of the
Chamber of Commerce for a report.
On May 23, 1972 , the Planning Commission reviewed the proposed
revisions and a letter submitted by the Chamber of Commerce
Industrial Committee in which the Committee recommended adoption
of the proposed changes. The staff was directed to prepare a
code amendment.
On November 7 , 1972 the Planning Commission reviewed the
fourth draft of Code Amendment No 72-11 and instructed the
staff to set it for a public hearing.

PURPOSE: To provide for variation in the
yard requirements, establish
procedures for review of truck and
rail loading facilities , and to
amend landscaping requirements of
off-street parking facilities
(Article 979) in the Ml-A Restricted
Manufacturing District.
Code Amendment No. 72-11 is a proposal to amend the Ml-A
District to provide for variations in yard requirements ,
establish procedures for review of truck and rail loading
facilities and to amend the landscaping requirements of off-
street parking facilities.
This code amendment was reviewed with the Planning Commission
at the November 7 , 1972 meeting at which time the Commission
instructed the staff to set Code Amendment No. 72-11 for a
public hearing. It was the consensus of the Commission that
provisions should be included to provide for a landscaping
buffer between the permitted industrial use and residential
property. Section 9514 .5 "Landscaped Buffer" has been
added for your review with the width of such buffer to be
determined by the Commission. Changes proposed by Code
Amendment No. 72-11 have been underlined for your convenience.
The staff recommends approval of Code Amendment No. 72-11
and will be prepared to discuss any questions the Commission
may have at the December 5 meeting.

If approval has been recommended, the City Council will be required to
hold a public hearing on this matter. Although there is a 10 day appeal
period, we suggest that the matter be set for the earliest possible City
Council meeting, because the purpose of any appeal is to have a hearing
before the City Council and this is already being accomplished. We
