ORDINANCES FOR INTRODUCTION
Mayor Coen directed that Ordinance No. 1758 pertaining to business licenses and
permits be held out for separate discussion.
The City Administrator informed Council of a communication received from Signal
Oil and Gas Company concerning Ordinance No. 1759 pertaining to Oil Production .
Business License Tax, and the Mayor directed that this communication be noted in
the record.
On motion by Matney, Council directed the Assistant City Clerk to read Ordinance
Nos. 1756, 1757 and 1759 by title, and waived further reading of same by the fol-
lowing roll call vote:

Lot "B": (an unnamed street) of Tract 876 in the City of Huntington Beach, County
of Orange, State of California, as per map recorded in Book 26, page 36 of Mis-
cellaneous Maps in the Office of the County Recorder of said County and the north
6 feet of Lot "C" (Hillhead Drive) of Tract 876 in the City of Huntington Beach,
County of Orange, State of California, as per map recorded in Book 26, Page 36
of Miscellaneous Maps in the Office of the County Recorder of said County.
The Clerk informed Council that all legal requirements for notification and publi-
cation had been met, and that no communications or written protests to Resolution
No. 3483 had been received.
Mayor Coen declared the hearing open.
There being no one present to speak on the matter and there being no protests filed
either oral or written, the hearing was closed by the Mayor.
On motion by Bartlett, Council approved the vacation of Lot "B" and a portion of
Lot "C" in Tract 876; and directed the City Attorney to prepare a resolution ordering
said vacation.
The motion was passed by the following roll call vote:
AYES- Councilmen: Shipley, Bartlett, Gibbs, Matney, Duke, Coen
NOES: Councilmen: Alone

PUBLIC HEARING - CODE AMENDMENT NO. 72-3 - APPROVED
Mayor Coen announced that this was the day and hour set for a public hearing on
Code Amendment No. 72-3 as initiated by the Planning Commission, to provide for
combining of the "02" Combining Oil District, with the base zone RA Residential
Agricultural District, by amending S. 9686.1 to read, "Restricted Areas: The
"02" District may be combined only with the M1, 142 and RA Districts."
The Clerk informed Council that all legal requirements for publication and posting
had been met. and that he had received no communications or written protests to
Code Amendment No. 72-3 or to the recommendation of approval of the Planning Com-
mission.
Mayor Coen declared the hearing open.
There being no one present to speak on the matter and there being no proteste
filed either oral or written, the hearing was closed by the Mayor.
On motion by Matney, Council sustained the decision of the Planning Commissions;
approved Code Amendment No. 72-3 - initiated by the Planning Commission, and directed
the City Attorney to prepare an ordinance effecting the amendment to the ordinance
code. The motion was passed by the following vote:

Transmitted herewith is a copy of Code Amendment :
No. 72-3. Said amendment was initiated by the Planning
Commission to provide for combining the 110211 Combining
Oil District with the RA Residential Agricultural
District by amending S. 9686.1 to read, "Restricted
Areas: The 110211 District may be combined only with
the M1, M2 and RA Districts".
The Planning Commission at its May 2, 1972 meeting
unanimously approved Code Amendment No. 72-3 and
recommends approval by your Honorable Body.
The State Planning Act requires that a public hearing
be held after which the Code Amendment may be adopted
by ordinance.

DATE: May 29 1972
Code Amendment No. 72-3 proposes to amend Section
9686. 1 of the Oil Combining Districts by permitting
the -02 suffix to be combined with the RA district
in addition to the M1 and M2 districts .
This code amendment was initiated when it was
pointed out to the Commission that property must
be zoned industrial in order to attach the 02
suffix.
It was noted that there are several oil fields
that are not suited to industrial use and
therefore it would not be appropriate to zone the
property industrial and risk the possibility of
having encroachment of industrial uses into
these areas.
The staff recommends approval of Code Amendment
No. 72-3.

If approval has been recommended, the City Council will be required to
hold a public hearing on this matter. Although there is a 10 day appeal
period, we suggest that the matter be set for the earliest possible City
Council meeting, because the purpose of any appeal is to have a hearing
before the City Council and this is already being accomplished. We
further suggest that you not accept any appeal, as it will serve no purpose.
If approval has been recommended other than as requested, the City Council
will be required to hold a public hearing on this matter. However, there
is a possibility that the Planning Commission's decision will be appealed;
therefore, we suggest that publication be held off until the 10 day
appeal period has expired.
If denial has been recommended, the City Council may summarily deny the
request. However, we suggest that the matter not be scheduled on the
City Council agenda until the 10 day appeal period has expired.
